Introduction:
Approval of Proposed Resolution No. 20448 authorizing the third year, second and final
renewal, of an agreement with J. M. Kaufinan, Redwine Enterprises, and Mid County, LTD, of
Port Arthur, and Ross Ridge Sand Company, LP of Vidor,Texas for the excavating and
hauling of materials.
Background:
This is an annual contract for excavating and hauling materials for different departments.
Historically, the City's Landfill, Streets, and Parks division have been major users of this
service. This is the third and second and final renewal for this contract.
Budget Impact:
Funds are available the Public Works Landfill— Landfill Construction account no. 403-1274-
533.59-02,Public Works Streets—Streets Maintenance account no. 001-1203-531.36-00, and
Parks Maintenance—Land Maintenance account no. 001-1207-531.31-00.
Recommendation:
It is recommended that City Council authorize the City Manager to approve P. R. 20448, as
discussed and/or outlined above.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE THIRD YEAR, SECOND AND
FINAL RENEWAL, OF THE AGREEMENT WITH J. M. KAUFMAN,
REDWINE ENTERPRISES AND MID COUNTY, LTD. OF PORT
ARTHUR, TEXAS AND ROSS RIDGE SAND COMPANY, LP OF
VIDOR, TEXAS FOR THE EXCAVATING AND HAULING OF
MATERIALS WITH A PROJECTED BUDGETARY IMPACT OF
$800,000; FUNDS ARE AVAILABLE IN THE PUBLIC WORKS
LANDFILL - LANDFILL CONSTRUCTION ACCOUNT NO. 403-1274-
533.59-02, PUBLIC WORKS STREETS — STREETS MAINTENANCE
ACCOUNT NO. 001-1203-531.36-00, AND PARKS MAINTENANCE —
LAND MAINTENANCE ACCOUNT NO. 001-1207-531.31-00.
WHEREAS, the City requires the services of a contractor to provide for the excavating
and hauling of materials for various projects within different departments; and,
WHEREAS, per Res. 16-310, on December 8, 2016, the City entered into an agreement
with J. M. Kaufman, Redwine Enterprises and Mid County Land Company, Ltd. of Port Arthur,
Texas, and Ross Ridge Sand Company, LP of Vidor, Texas for a one (1) year term, with the
option of renewing for two(2) additional one(1) year terms; and,
WHEREAS, per Resolution No. 17-247, on October 10, 2017, the City entered into the
second year of the agreement; and,
WHEREAS, the City desires to enter into the third year, second and final renewal, of the
agreement with J. M. Kaufman, Redwine Enterprises and Mid County Land Company, Ltd. of
Port Arthur, Texas, and Ross Ridge Sand Company, LP of Vidor,Texas;
WHEREAS, the prices will be indexed by using the Consumer Price Index category
"Transportation", which reflects a 4.1%increase, for this year; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,

THAT, the City Manager is hereby authorized to execute a third year, second and final
renewal, of the agreement with J. M. Kaufman, Redwine Enterprises and Mid County Land
Company, Ltd. of Port Arthur, Texas, and Ross Ridge Sand Company, LP of Vidor, Texas,
attached as Exhibit "A" for the excavating and hauling of materials for City of Port Arthur with
the subsequent year's prices of each contract adjusted according to the Consumer Price Index
category"Transportation"; and,
THAT, a copy of the caption of this Resolution he spread upon the Minutes of the City
Council.

AND HAULING SOIL MATERIALS
THIS AGREEMENT,made this the of , 2018,by and between the City of
Port Arthur, a municipal corporation organized under the laws of the State of Texas,hereinafter
called"OWNER"or "CITY", and Ross Ridge Sand Company,LP,hereinafter called
"CONTRACTOR". WITNESSED: That for and in consideration of the payment terms,
conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Agreement shall be for one(1) year from the date stated on the Notice to
Proceed unless sooner terminated under the provision hereof. The City can terminate this
contract at its convenience which includes,but is not limited to, funding not being
available in any budget cycle within thirty(30) days written notice. Prices quoted shall
be indexed for the next year using the Consumer Price Index category"Transportation".
Each subsequent yearly contract renewal shall require approval of the City Council.
2. During the term of this Contract,the CONTRACTOR will furnish at his own expense all
of the materials, supplies,tools, equipment, labor, and other services necessary to
connection therewith, excepting those supplies specifically not required on
CONTRACTOR in the Specifications.
3. The CONTRACTOR agrees to perform all the work described in the Specifications and
contract documents and comply with the terms therein for unit prices as stated below:
