ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE CONVEYANCE OF THE
PROPERTY LOCATED AT 649 STADIUM ROAD, PORT ARTHUR,
TEXAS, ALSO KNOWN AS THE FELIX AND MILTON BARKER
COMMUNITY CENTER, TO GOLDEN TRIANGLE CHURCH ON THE
ROCK
WHEREAS, the City Council of the City of Port Arthur finds it in the best interest
of the citizens of Port Arthur for the City to execute a special warranty deed to Golden
Triangle Church on the Rock, as attached hereto as Exhibit "A"; and
WHEREAS, this will allow Golden Triangle Church on the Rock to maintain a
distribution location solely for non—perishable food and volunteer activities that promote
a public purpose for the citizens of Port Arthur.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager is hereby authorized to execute a special
warranty deed to Golden Triangle Church on the Rock, for the land and improvements
located at 649 Stadium Road, Port Arthur, Texas, Also Known As The Felix And Milton
Barker Community Center, pursuant to Section 253.011 of the Texas Local Government
Code, in substantially the same form as attached hereto as Exhibit "A".
Section 3. That pursuant to 253.001 of the Texas Local Government Code, the
ownership of these tracts will automatically revert to the City of Port Arthur if Golden
Triangle Church on the Rock ceases to exist as it now does as a church, religious
organization, or shall cease to maintain its mission to provide non-perishable food and

volunteer activities that promote a public purpose for the citizens of Port Arthur at the
location of 649 Stadium Road, Port Arthur, Texas.
Section 4. That if Golden Triangle Church on the Rock fails to repair and
subsequently maintain the premises according to all Building Code requirements, the
property reverts back to the City.
Section 5. That the name of the Building shall remain the Felix and Milton
Barker Community Center.
Section 6. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.

Consideration: Pursuant to 253.011 of the Texas Local Government Code, the
ownership of these tracts will automatically revert to the City of Port Arthur if Golden
Triangle Church on the Rock fails to use this property and improvements thereon
described as 649 Stadium Road, Port Arthur, Texas, also known as the Felix and Milton
Barker Community Center (S11' of L6 ALL OF L7 DELMAR TERR N8' OF L8 BLK 37)
primarily for a public purpose, as delineated in Ordinance No. 18- .
Property (including any improvements): Being Lot 26 Res 22 RES, according to the
map used by the City of Port Arthur Jefferson County, Texas, being more particularly
described by metes and bounds as follows, to-wit:
The South Eleven feet of Lot No. Six (S11' of 6), all of Lot Number Seven
(7), and the North Eight feet of Lot Number Eight (N8' of 8), in Block No.
Thirty-seven (37), of DELMAR TERRACE, an Addition to the City of Port
Arthur, Jefferson County, Texas, according to the map or plat of record in
Vol. 7, page 61 Map Records in the office of the County Clerk of said
County and State.
All of the improvements located upon the above described property are
being conveyed "AS IS, WHERE IS" with no warranty whatsoever being
given in regard to their quality or condition.
This conveyance is made subject to all zoning laws, restrictions,
covenants, conditions, easements, and mineral and/or royalty reservation
of record, if any, affecting the property.
Locally known as 649 Stadium Road, Port Arthur, Texas also known as
the Felix and Milton Barker Community Center.
Reservations from and Exceptions to Conveyance and Warranty: That such deed
is subject to all restrictions, covenants, conditions, easements, rights -of-way and
prescriptive rights whether recorded or not, and all recorded reservations if any
and zoning and other laws affecting the property.
Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty, grants, sells and conveys to Grantee the property, together
with all and singular the rights and appurtenances thereto in any wise belonging, to
have and to hold it to Grantee, Grantee's heirs, executors, administrators,
successors, or assigns forever. Grantor binds Grantor and Grantor's heirs,
executors, administrators, and successors to warrant and forever defend all and
singular the property to Grantee and Grantee's heirs executors, administrators,
successors, and assigns against every person whomsoever lawfully claiming or to
claim the same or any part thereof, except as to the reservations from and exceptions
to conveyance and warranty by and through only the grantor.
