Director of Human Reso1 RE: A Resolution Approving a Property Damage Settlement in the Amount of$11,233.58 for Damages to City of Port Arthur Trash Unit#2206 Nature of the request: On September 27, 2018, Trash Unit #2206 (2018 Freightliner Grapple Truck) was backed into by a vendor's truck damaging the grill and hood of the unit at the landfill. Staff Analysis, Considerations: The City has Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TML) with a $2,500.00 deductible. TML has offered the City a settlement of$11,233.58, less the $2,500.00 deductible, making the final settlement offer $8,733.58. This amount is sufficient to cover the estimated property damages for Unit #2206. If additional damages are discovered, TML may issue a supplemental payment. TML will attempt to obtain subrogation recoveries on behalf of the City of Port Arthur. Recommendation: I recommend approval of Proposed Resolution No. 20571 authorizing the property damage settlement against TML for damage sustained to Trash Unit #2206 (2018 Freightliner Grapple Truck). TML has offered to settle the claim for $11,233.58, less the $2,500.00 deductible, making the final settlement offer $8,733.58. This is considered a fair and reasonable settlement. TML will attempt to obtain subrogation recoveries on behalf of the City of Port Arthur. TML will attempt to obtain subrogation on behalf of the City of Port Arthur. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That. the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $11,233.58, less the Physical Damage deductible amount of $2,500.00, making the final settlement offer $8,733.58.
