NO. 20588 —A resolution calling for a public hearing to consider an abandonment for a portion of a street right-of-way. Introduction: The intent of this Agenda Item is to request a public hearing for a proposed abandonment of approximately 0.2261-acre of land consisting of an improved portion of the 76th Street right-of-way, Newport Heights No. 1 Addition, Port Arthur, Jefferson County, Texas. The purpose of this request is to allow for the development of a medical office/clinic. Background: The Planning & Zoning Commission held a public hearing on Monday, November 19, 2018. There were no objections from members of the public regarding this abandonment request. Budget Impact: None Recommendation: It is recommended that City Council approve P.R. No. 20588, calling for a public hearing to consider a proposed abandonment of approximately 0.2261-acre of land consisting of an improved portion of the 76th Street right-of-way, Newport Heights No. 1 Addition, Port Arthur, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A PROPOSED ABANDONMENT FOR 0.2261-ACRE OF LAND CONSISTING OF AN IMPROVED PORTION OF THE 76TH STREET RIGHT-OF-WAY LOCATED IN THE NEWPORT HEIGHTS NO. 1 ADDITION, CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS. A18-01 (CITY OF PORT ARTHUR) WHEREAS, the Port Arthur Planning and Zoning Commission is recommending that City Council consider an abandonment for approximately 0.2261-acre of land consisting of an improved portion of the 76th Street right-of-way located in Newport Heights No. 1 Addition, as delineated in Exhibit "A"; and, WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to consider the abandoning, vacating and relinquishing streets, alleys and easements; and, WHEREAS, the City Council has the authority to vacate, abandon or close a street under Section 311.001 and 311.007 Transportation Code; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That the Planning and Zoning Commission heard this case on November 19, 2018. SECTION 3. That upon abandoning and vacating the alleys, the City shall have the right, if it so desires, to retain utility easements. SECTION 4. That a public hearing to consider whether to grant the applicant the abandonments as delineated in Exhibit "A" shall be held on January 8, 2019 at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 Fourth Street. That notice of the public hearing shall be published at least fifteen (15) days before the date of the hearing in the official newspaper of the City pursuant to 211.006 of the Texas Local Government Code. SECTION 6. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council.
