R. No. 20626 Introduction: Authorize the purchase of cement slurry from Southern Cement Slurry, L.L.C. of Porter, Texas, to be used in rehabilitation of streets throughout the city. This product is from a sole source vendor with a projected budgetary impact of$200,000. Background: Cement slurry is a mixture of cement, sand, water and other additives used for large scale construction projects. This product produces less dust, which is a safety concern for staff and citizens, and less clean up then standard concrete. Slurry also adds structural strength, making the base material more even and reliable than other concrete mixes. In an effort to ensure stable and safe road, our Public Works Department Streets Division will be using this product on various street rehabilitation throughout the city. Budget Impact: Funds are provided in account numbers 001-1203-531.36-00, Public Works Department Streets Service Division — Streets and 307-1601-591.86-00, Capital Improvements Fund — Capital Projects— Streets. A RESOLUTION AUTHORIZING THE PURCHASE OF CEMENT SLURRY FROM SOUTHERN CEMENT SLURRY, L.L.C. OF PORTER, TEXAS FOR THE PUBLIC WORKS DEPARTMENT STREETS DIVISION WITH A PROJECTED BUDGETARY IMPACT AMOUNT OF $200,000. FUNDS ARE PROVIDED IN ACCOUNT NUMBERS PUBLIC WORKS STREETS DIVISION 001-1203-531.36-00 AND CAPITAL IMPROVEMENTS FUND — CAPITAL PROJECTS — STREETS 307-1601- 591.86-00. WHEREAS, cement slurry is a mixture of cement, water and assorted dry and liquid additives that produces less dust and is more structurally sound than other cement mixtures; and, WHEREAS, this product will be used in the rehabilitation of streets throughout the city; and, WHEREAS, Southern Cement Slurry, L. L. C. of Porter, Texas is a sole-source vendor; and, WHEREAS, this purchase is authorized by Procurement Policies and Procedures Section 3-105 Sole Source Procurement, a) One-of-a-Kind—the product has no competitive product and is available from only one supplier. The product has essential unique design/performance features providing superior utility not obtainable from similar products; and, WHEREAS, this procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions (A)(7)(A), items that are available from only one source because of patents, copyrights, secret processes, or natural monopolies; and, WHEREAS, the sole source for bid has been evaluated by the Public Works Department and Purchasing, attached as Exhibit"A"; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, P.R.20626 12/20/18 aw THAT, the City Manager is hereby authorized and directed to purchase, on behalf of the City of Port Arthur, cement slurry, for the unit price listed in Exhibit "B", with a projected budgetary impact amount of$200,000; and, THAT, funding for these materials is provided for in account numbers Public Works Department - Streets Division - Streets Maintenance — 001-1203-531.36-00 and Capital Improvement Fund—Capital Projects—Streets—307-1601-591.86-00; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
