Smith,RN, BSN, Director of Health Services 93 RE: Authorization to amend the 2016-2020 Contract between the Texas Department of Family and Protective Services and the City of Port Arthur to clarify changes in the funding source and sub-recipient status to be effective throughout the remainder of the contract. NO CHANGES IN THE BUDGET Introduction: The intent of this Agenda Item is to seek the City Council's approval for the City Manager to enter into amending the contract between the Texas Department of Family and Protective Services (DFPS) and the City of Port Arthur for the Nurse Family Partnership Program, P.R. No. 20659. The 2016-2020 Contract Amendment was approved by council March 29, 2018 per Resolution No. 18-132, and now the state wishes to amend the contract to clarify changes in the funding source and the sub-recipient status. Background: The Nurse Family Partnership Program provides educational, health, guidance, and other resources for low-income, Medicaid eligible, first-time pregnant women during pregnancy, and during the first two years of their infant's life through visits by highly trained registered nurses. This Program serves 125 families. Budget Impact: There is no budget impact with this amendment. Recommendation: It is recommended that City Council approve P.R. No. 20659 amending the contract with Texas Department of Family and Protective Services for the Nurse-Family Partnership Program as discussed and/or outline above. A RESOLUTION APPROVING AMENDMENT NO. FOUR (4) TO 2016-2020 CONTRACT BETWEEN THE TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES AND THE CITY OF PORT ARTHUR FOR THE NURSE-FAMILY PARTNERSHIP PROGRAM WHICH CLARIFIES CHANGES IN THE FUNDING SOURCE AND SUB-RECIPIENT STATUS WHEREAS, the State of Texas, by and through the Texas Department of Family and Protective Services (DFPS) awarded grant funds to eligible entities to support the establishment and operation of local Nurse-Family Partnership (NFP) programs to provide educational, health, guidance, and other resources for low-income, first-time pregnant women during pregnancy, and during the first two years of their infant's life through visits by highly trained registered nurses; and, WHEREAS, pursuant to Resolution No. 15-332, Council approved the FY2015- 2016 contract between DFPS and the City of Port Arthur for the NFP program with a contract period ending in August 31,2016; and, WHEREAS, pursuant to Resolution No. 16-247, Council approved Amendment No. 1, extending the contract period to August 31, 2017; and, WHEREAS, pursuant to Resolution No. 17-204, council approved the amendment extending the contract period to August 31, 2020; and, WHEREAS, pursuant to Resolution No. 18-132, council approved the amendment revising the budget and the performance measures; and, P.R.No. 20659 01/22/19 WHEREAS, Texas Department of Family and Protective Services is now amending the contract to clarify changes in the funding source and sub-recipient status to be effective throughout the remainder of the contract period ending August 31, 2020. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That,the facts and opinions in the preamble are true and correct. Section 2. That, the City Council of the City of Port Arthur hereby authorizes the amendment as stated in Exhibit A to be in effect for the Nurse Family Partnership under the City of Port Arthur Health Department. Section 3. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Purpose. To clarify changes in the funding source and sub-recipient status for state fiscal year 2018 to be effective throughout the remainder of the contract. II. Amendments: A. Section 2.01 Background of the Original Agreement is deleted in its entirety and replaced with the following: The Nurse-Family Partnership Program(NFP)that is the subject of this Agreement is a project under the supervision of the Texas Home Visiting Program; this Agreement requires specified approvals from and adherence to standards promulgated by the Texas Home Visiting Program. The Nurse-Family Partnership Program is funded by the State of Texas in response to Senate Bill 156, 80th Legislature, Regular Session, 2007 and the U.S Department of Health and Human Services Temporary Assistance for Needy Families (TANF); CFDA 93.558. The purpose of the funding is to support the statewide implementation or expansion of NFP Programs. B. Section 2.02 Objectives of Amendment One is deleted in its entirety and replaced with the following: It is the intent of DFPS to support the Nurse-Family Partnership Program in Chambers, Hardin, Jefferson, and Orange County, Texas through the Agreement. CONTRACTOR shall be considered a sub-recipient of federal grant funds for the purposes of the Agreement. C. Exhibit E"Additional Contract Requirements"of the Base contract shall be amended by adding the following requirement: Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards found at 2 CFR 200 shall be added as a requirement that the subrecipient shall comply with. Amendment No. 3, Section 4.01 that amended Amendment No. 1 and Amendment No. 2 originally shall be deleted in its entirety and replaced with the following: 1. The total amount of this Contract will not exceed$3,225,632.00 for State of Texas Fiscal Years (FY)2016—2020. Each maximum FY amount is note FY 2016 not to exceed$580,633.00; FY 2017 not to exceed$580,633.00; FY 2018 not to exceed$688,122.00; FY 2019 not to exceed$688,122.00; FY 2020 not to exceed$688,122.00. 2. Payments to the contractor will be made from available funds for services rendered in accordance with the terms of this Contract upon receipt of a proper and verified statement and after deduction of any known previous overpayment made by DFPS. For the purposes of this contract, City of Port Arthur, (DUNS 137134909) is considered a sub-recipient and is funded by the State of Texas in response to Senate Bill 156, 80th Legislature,Regular Session, 2007; Senate Bill 426, 83rd Legislature,Regular Session,2013; and the U.S. Department of Health and Human Services Temporary Assistance for Needy Families(TANF); CFDA 93.558. The exact amount of state and/or federal funding is determined at the end of the state fiscal year. DFPS will notify the CON IRACTOR in writing of the exact amount of federal monies used to fund this Agreement as soon as this data is available, at least once annually upon request. III. This Amendment will be effective as of 12/15/2018 IV. Except as amended and modified by this Amendment, all terms and conditions of the Contract will remain in full force and effect.
