City of 4 /Al „ r r t h u- Ti.rus www.PortArthurTx.gov INTEROFFICE MEMORANDUM Date: January 24, 2019 To: The Honorable Mayor and City Council Through: Harvey Robinson, Interim City Manager From: Rebecca Underhill, Assistant City Manager RE: PR 20657—A Resolution Appointing a Member or Members to the Port Arthur Downtown Reinvestment Zone Background: On November 9, 2012,the City Council approved Ordinance 12-75 establishing a Tax Increment Reinvestment Zone. The ordinance also established a Board of Directors for the Zone, which"shall consist of at least five (5) members" serving two year terms. The Board has been inactive for at least three years, so all of the previous two year terms have expired. Each entity is allowed at least one appointed member. "However,the City Council reserves the right to also appoint additional members to the Board of Directors in the event a taxing entity does not appoint a member or to add additional members to the board not to exceed 15 members." In addition to the City,the participating taxing entities are Jefferson County, Sabine Neches Navigation District and Drainage District#7. With one appointee each,there would only be four(4) members on the board, and five (5) are required. Recommendation: Proposed Resolution 20657 provides for the City Council to appoint two members to the board of the Downtown Reinvestment Zone. A RESOLUTION APPOINTING A MEMBER OR MEMBERS TO THE PORT ARTHUR DOWNTOWN REINVESTMENT ZONE BOARD WHEREAS, much of the area of downtown Port Arthur has fallen into disrepair; and WHEREAS, there have been numerous plans and strategies for refurbishing and revitalizing the said downtown area of Port Arthur; and WHEREAS, pursuant to Chapter 311 of the Texas Tax Code the City of Port Arthur created a reinvestment zone to promote development or redevelopment of the area on November 9, 2012 ; and WHEREAS, Chapter 311 of the Texas Tax Code requires municipal governments to give notice to other taxing entities that they may participate in the reinvestment zone and appoint a member to the Board of Directors for the Zone as does the City Council reserve the right to also appoint its own members or member to the Board of Directors; and WHEREAS, the City reserves the right to also appoint additional members to the Board of Directors in the event a taxing entity does not appoint a member; and WHEREAS, the term of the Board members shall not exceed two (2) years; and WHEREAS, the term of the last City Council appointee has expired. NOW THEREFORE, BE IT RESOLVED BY THE CITY OF PORT ARTHUR: Section 1 . That the facts and opinions in the preamble are true and correct . Section 2 . That and are hereby appointed to the Downtown Reinvestment Board. Section 3 . That the term shall not exceed two (2) years effective immediately after passage . Section 4 . That a copy of the caption of this Resolution be spread upon the Minutes of the City Council .
