Background: "Chuy" is a 10 year-old Belgium Malinois that the police department has owned for approximately 9 years and has been under the control of Detective Peter Croak for its entire police career. Chuy is at his end of service with the department. Detective Peter Croak has agreed to purchase Chuy for$1 and take ownership and to personally care for and assume all responsibility and future care and cost associated with K-9 Chuy. Budget Impact: The is no budgetary impact for the retirement and transfer of ownership. Recommendation: It is recommended that City Council approve the retirement of police canine"Chuy"and transferring the ownership of the canine to the personal care of Detective Peter Croak, as discussed and/or outline above. AN ORDINANCE AUTHORIZING THE RETIREMENT OF POLICE CANINE "CHUY" AND TRANSFERRING THE OWNERSHIP OF THE CANINE TO THE PERSONAL CARE OF DETECTIVE PETER CROAK. WHEREAS, the Police Department has a police canine known as Chuy that has been in service for the City for the past 9 years and has been assigned to K-9 handler Detective Peter Croak; and WHEREAS, because of Chuy' s age at 10 years old and deteriorating physical condition, he is at his end of service with the department; and WHEREAS, Detective Peter Croak has agreed to purchase Chuy for $1 and take possession and ownership of Chuy and assume all future expenses and liability involved in the care and maintenance of the canine; and WHEREAS, it is deemed in the best interest of the City to approve the retirement and transfer of Chuy to Detective Peter Croak to personally care for and assume all responsibility and future care and cost of ownership. NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1 . That the facts and opinions in the preamble are true and correct. Section 2 . That the City Council and the City of Port Arthur hereby authorizes the retirement of police canine "Chuy" and transfers the ownership of the canine to the personal care of Detective Peter Croak, who agrees to assume all future responsibility, ownership, cost and care of the canine . Section 3. That a copy of the Ordinance shall be spread upon the Minutes of the City Council . Section 4 . That Detective Peter Croak shall sign this ordinance agreeing to the terms therein. READ, ADOPTED AND APPROVED on this day of A.
