No. 20708—Environmental Consulting Services for Development of Technically-Based Local Limit Study Introduction: The intent of this Agenda Item is to seek City Council's approval for City Manager to negotiate a contract with Freese and Nicholas, Inc. for Environmental Consulting Services for the development of Technically-Based Local Limits.The City received qualification proposals from two environmental consulting firms. Having reviewed such proposals, and scoring each firm using a published evaluation criteria, find that Freese and Nicholas, Inc. has the highest rating. The funds are budgeted and available in Environmental Regulatory Service Division, Account No. 410-1260-532.54-00. Background: The Federal Pretreatment regulations, 40 CFR 403.5 (c) requires Publicly Owned Treatment Works(POTW), to develop and enforce local limits for discharge and to implement the general and specific prohibitions in 40 CFR 403.5(a) and (b). The pretreatment regulations also require POTW to continue to develop these local limits as necessary and effectively to enforce such limits. The National Pollutant Discharge Elimination System(NPDES) regulations in 40 CFR 122. 44(j)(2)(ii)require publicly owned treatment works to provide a current Technically Based Local Limit Study in conjunction with permit reissuance. The City of Port Arthur Main Treatment current NPDES permit was reissued on October 22, 2018. "Remember, we are here to serve the Citizens of Port Arthur" - e City of („ r r t h r�— 7crus Budget Impact: The Local Limit Study for Environmental Consulting work is budgeted in Environmental Regulatory Service Account No. 410-1260-532.54-00, Professional Services. Recommendation: The Environmental Regulatory Division recommends City Council adopt Proposed Resolution No. 20708 authorizing the City Manager to negotiate a contract with Freese and Nicholas, Inc. A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT WITH FREESE AND NICHOLS, INC. OF PEARLAND, TEXAS FOR ENVIRONMENTAL CONSULTING SERVICES FOR LOCAL LIMIT DEVELOPMENT. FUNDING AVAILABLE IN ENVIRONMENTAL REGULATORY SERVICE ACCOUNT NO.410-1260-532.54-00. WHEREAS, the City's National Pollutant Discharge Elimination System (NPDES) wastewater discharge permit,issued by the Texas Commission on Environmental Quality(TCEQ) requires the City to enforce categorical pretreatment standards of the Clean Water Act,prohibiting discharge standards as set forth in 40 CFR 403.5(a) and (b), or local limitations (Local Limits) developed by the City in accordance with 40 CFR 403.5 (c), whichever are more stringent, to applicable nondomestic users discharging wastewater to the collection system of the City's Publicly Owned Treatment Works (POTW); and WHEREAS,the City's NPDES wastewater discharge permit requires the City to evaluate and revise Local Limits within reissuance of its permit to regulate pollutants of concern present in discharges to the City's POTW that may cause inhibition or pass-through to the POTW; and WHEREAS, the City of Port Arthur has received qualification proposals from two (2) environmental consulting firms concerning development of Technically-Based Local Limit Study; and WHEREAS, City Staff having reviewed such proposals, and scoring each using the published Evaluation Criteria, finds that Freese and Nicholas, Inc., has the highest rating and recommends same to perform the Environmental Consulting Services for the redevelopment of Technically Based Local Limit Study; (See Exhibit"A"); and WHEREAS, funds are budgeted and available for this Consulting Services in fund Account Number 410-1260-532.54-00; and P. No. 20708 02/18/19 1g Page 2 of 3 WHEREAS,the City Council of Port Arthur finds it to be in the best interest of the citizens of Port Arthur to negotiate a contract with Freese and Nicholas, Inc. for the Environmental Consulting for Local Limit Development. NOW THEREFORE,BE IT RESOLVED BY CITY COUNCIL OF CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to negotiate a contract with Freese and Nichols, Inc. of Pearland, Texas on behalf of the City of Port Arthur for Environmental Consulting Services for the Development of Local Limit Study with said contract being subject to the final approval of the City Council. THAT a copy of the caption of this resolution be spread upon the minutes of City Council.
