A RESOLUTION AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE PREPARTION OF ALL DOCUMENTS NECESSARY, FOR CITY COUNCIL CONSIDERATION AND ACTION AT A LATER DATE, TO ISSUE CERTIFICATES OF OBLIGATION, SERIES 2019, THROUGH THE TEXAS WATER DEVELOPMENT BOARD IN AN APPROXIMATE AMOUNT OF $56.13 MILLION FOR THE REHABILITATION OF THE MAIN WASTEWATER TREATMENT PLANT WHEREAS, the City of Port Arthur's main Wastewater Treatment Plant is in need of major rehabilitation; and WHEREAS, the City of Port Arthur has engaged Freese and Nichols to design the necessary improvements to the Plant; and WHEREAS, on September 25, 2018, the City Council adopted Resolution 18-385 authorizing application be made to the Texas Water Development Board(TWDB) for funding assistance; and WHEREAS, on December 19, 2018, the TWDB granted preliminary approval of up to $4.25 million in disadvantaged community funding,principal forgiveness; and WHEREAS, on February 5, 2019 and March 19, 2019, city staff presented the City Council information on the funding requirements and the debt service options available to accomplish this needed project; and WHEREAS, the TWDB is expected to approve the final Financial Commitment to the City of Port Arthur at the April meeting of the Board. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the City Council does hereby direct the Interim City Manager to proceed with preparing all documents necessary for Council consideration and approval to issue 20 year, Certificates of Obligation, Series 2019, through the Texas Water Development Board, in the amount of approximately $56.13 million for the purpose of rehabilitation of the Main Wastewater Treatment Plant. THAT the City Council will consider, and potentially take action on an Ordinance to publish notice of the Certificate of Obligation at a regular posted meeting in late 2019.
