INVOCATION, PLEDGE & ROLL CALL Councilmember Scott gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Special Session on Tuesday, February 26, 2019 at 4:06 p.m. in the City Council Chamber, City Hall, with the following members present: Mayor Derrick Freeman; Mayor Pro Cal Kinlaw, III.; Councilmembers Raymond Scott, Jr., Harold Doucet, Sr. and Kaprina Frank; Interim City Manager Harvey Robinson; City Secretary Sherri Bellard and City Attorney Valecia Tizeno. Councilmember Cal Jones joined the Special Executive Meeting at 4:38 p.m. Councilmember Charlotte Moses joined the Special Executive Meeting at 4:57 p.m. II. *CLOSED MEETING (EXECUTIVE SESSION) Closed Meeting: (1) Section 551.071 Government Code — To Discuss With The City Attorney Pending Litigation Regarding Cause No. E- 200319; City Of Port Arthur V. German Pellets Texas, LLC And Texas Pellets, Inc. (2) Section 551.071 Government Code — To Discuss With The City Attorney And Receive Legal Advice Regarding Potential/Pending - Claim/Litigation Against The City Of Port Arthur Police Department (3) Section 551.071 Government Code — Attorney Consultation To Provide Advice And Counsel In Connection With The City's Rights, Duties, Privileges, And Obligations In Connection With Pending Negotiations With The Port Arthur Fire Firefighters IAFF Local No. 397 (4) Section 551.071 Government Code — To Discuss With The City Attorney And Receive Legal Advice Regarding Potential Claims/Lawsuits Initiated By The City Of Port Arthur (5) Section 551.072 Government Code — To Discuss The Value Of The Land In The City's Extraterritorial Jurisdiction (6) Section 551.074 Government Code — To Discuss With The City Attorney And Receive Legal Advice Regarding Employment Law Matters And Contractual Liability (7) Section 551.074 Government Code — To Discuss The Duties And Responsibilities Of The City Manager (8) Section 551.087 Government Code — To Discuss Incentives For Commercial, Residential, And /Or Industrial Business Prospects The City Council recessed their meeting at 4:06 p.m. to meet in Executive Session to consider the above-mentioned topics, and reconvened their meeting at 5:41 p.m. with the following members present: Mayor Freeman; Mayor Pro Tern Kinlaw; Councilmembers Scott, Jones, Moses and Frank; Interim City Manager Robinson; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Tim Duriso. MOTIONS IN OPEN SESSION The City Attorney read the following motion into the record: A Motion To Authorize The City Manager To Extend The Existing Contract Between The City Of Port Arthur And The Port Arthur Firefighters IAFF Local No. 397. The Extension Is Authorized For A Period Of One Additional Year Along With A 2.5% Wage Increase Upon the motion of Mayor Pro Tern Kinlaw, seconded by Councilmember Moses and carried, the above-mentioned motion was adopted. Voting Yes: Mayor Freeman; Mayor Pro Tern Kinlaw; Councilmembers Scott, Jones, Moses and Frank. Voting No: None The City Attorney read the following motion into the record: A Motion To Authorize A Refund And Credit To GT Omniport Due To Overpayments Previously Made By The Company To The City Of Port Arthur. The Total Amount Of The Refund And Credit Is $123,035.91. The Initial Amount Of $41,011.97 Is To Be Refunded To The Company On March 31, 2019. The Remaining Balance Will Be Credited To The Company With The 2019 And 2020 In Lieu Of Payments. Upon the motion of Mayor Pro Tern Kinlaw, seconded by Councilmember Frank and carried, the above-mentioned motion was adopted. Voting Yes: Mayor Freeman; Mayor Pro Tern Kinlaw; Councilmembers Scott, Jones, Moses and Frank. Voting No: None III. ADJOURNMENT Upon the motion by Mayor Pro Tern Kinlaw, seconded by Councilmember Moses and carried unanimously, the City Council adjourned their Special Meeting at 5:40 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
