RE: P.R. No. 20768—A resolution calling for a public hearing to consider granting a specific
use permit at 4248 9th Avenue/3701 41St Street.
Introduction:
The intent of this Agenda Item is to request a public hearing to consider a specific use permit for
approximately 0.4374-acre of Land consisting of All of Tracts 11-A & 13-A, Block 13, Rosemont Park
Addition [A.K.A. 4248 9th Avenue/3701 41st Street], Port Arthur, Jefferson County, Texas.
The purpose of this request is to allow for the construction of a retail strip center and office space or other
commercial development in Planned Development District— 14 (PD-14).
Background:
In accordance with Ordinance No. 89-054, the "PD-14", Planned Development— 14 District permits uses
as prescribed in Appendix A, Section 7-100 of the City of Port Arthur Code of Ordinances, for:
1. All uses in the "NS", Neighborhood District.
2. All uses in the "LC", Light Commercial District by Specific Use Permit.
The Planning &Zoning Commission will hold a public hearing on April 15, 2019.

Recommendation:
It is recommended that City Council approve P.R. No. 20768, calling for a public hearing to consider a
specific use permit for approximately 0.4374-acre of Land consisting of All of Tracts 11-A & 13-A, Block
13, Rosemont Park Addition [A.K.A. 4248 9th Avenue/3701 41st Street], Port Arthur, Jefferson County,
Texas, for the construction of a retail strip center and office space or other commercial development in
Planned Development District— 14 (PD-14).
The public hearing shall be held on Tuesday, May 7, 2019 at 9:00 a.m.

A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER
GRANTING A SPECIFIC USE PERMIT FOR APPROXIMATELY 0.4374-ACRE OF
LAND CONSISTING OF TRACTS 11-A AND 13-A, BLOCK 13, ROSEMONT
PARK ADDITION [A.K.A.4248 9TH AVENUE/3701 41ST STREET],CITY OF PORT
ARTHUR, JEFFERSON COUNTY, TEXAS
WHEREAS, the applicant — Heraldo Munoz, is requesting that the City of Port Arthur consider
granting a Specific Use Permit for approximately 0.4374-acre of Land consisting of Tracts 11-A and 13-A,
Block 13, Rosemont Park Addition [A.K.A. 4248 9th Avenue/3701 41st Street], Port Arthur, Jefferson County,
Texas for the construction on a retail strip center and office space in Planned Development District-14 (PD-
14), as delineated in Exhibit"A"; and,
WHEREAS, pursuant to Chapter 211 of the Texas Local Government Code, a public hearing must
precede any zoning change.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT in accordance with Section 211.007 of the Texas Local Government Code, the Planning and
Zoning Commission will hold a public hearing for this case on April 15, 2019, as well as written notices will
be sent to each owner, before the 10th day of the public hearing, as indicated by the most recent approved
municipal tax roll, or real property within 200 feet of the property on which the change in classification is
proposed.
THAT a public hearing to consider whether to grant this applicant a specific use permit for
approximately 0.4374-acre of Land consisting of Tracts 11-A and 13-A, Block 13, Rosemont Park Addition
[A.K.A. 4248 9th Avenue/3701 41st Street], Port Arthur, Jefferson County, Texas for the construction on a
retail strip center and office space in Planned Development District—14(PD-14), as delineated in Exhibit"A",

shall be held on May 7, 2019 at 9:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 Fourth
Street.
THAT notice of the public hearing shall be published in the official newspaper of the City at least
fifteen days before going to the City Council.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
READ, ADOPTED AND APPROVED this day of April, A.D. 2019, at a Regular Meeting
of the City Council of the City of Port Arthur, Texas, by the following vote:
