Freeman, Director of Housing&Neighborhood Revitalization RE: P.R. 20796—Rescinding Authorization of a Homebuyer Written Agreement Nature of the request: The Housing Division recommends the City Council adopt Proposed Resolution 20796 rescinding Resolution No. 18-243 in its entirety. StaffAnalysis/Considerations: The Housing Division identified and certified the homebuyer as eligible to receive up to $30,000 to assist with the purchase of a new construction home located at 1125 5th Street, Port Arthur, Texas. The funds were to be used to assist with down payment assistance and closing fees associated with the purchase of the home. Resolution No. 18-243 authorized the execution of a homebuyer's written agreement to receive up to $30,000 for the purchase of a newly constructed home located at 1125 5th Street, Port Arthur, Texas, the City's Homebuyer Assistance Program. After reviewing the identified homebuyer file, it has been determined that the identified homebuyer is no longer eligible to receive up to $30,000 down payment and closing cost assistance from the City's Homebuyer Assistance Program to purchase 1125 5th Street, Port Arthur,Texas. Recommendation: The Housing Division recommends the City Council adopt Proposed Resolution 20796 rescinding Resolution No. 18-243 in its entirety. Budget Consideration N/A P. R. 20796 04/15/2019--BAF/Housing RESOLUTION NUMBER A RESOLUTION RESCINDING RESOLUTION NO. 18-243 IN ITS ENTIRETY, WHICH AUTHORIZED THE EXECUTION OF A HOMEBUYER'S WRITTEN AGREEMENT FOR THE PURCHASE OF 1125 5TH STREET, PORT ARTHUR, TEXAS THROUGH THE CITY'S HOMEBUYER'S ASSISTANCE PROGRAM. WHEREAS, the City Council, by its adoption of Resolution Number 18-205, (authorizing submission of the 2018 Action Plan) has obligated itself to provide assistance to low and moderate income persons/families; and, WHEREAS, a homebuyer was identified and certified to receive up to $30,000 down payment assistance and closing fees associated with the purchase of a home located at 1125 5t' Street, Port Arthur, Texas, from the City's Homebuyer Assistance Program; and WHEREAS, after reviewing the identified homebuyer file, it has been determined that the identified homebuyer is no longer eligible to receive up to $30,000 down payment and closing cost assistance from the City's Homebuyer Assistance Program to purchase 1125 5th Street, Port Arthur, Texas; and WHEREAS, the City Council deems it is appropriate to rescind Resolution No. 18-243 in its entirety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. THAT, the facts and opinions in the preamble are true and correct. Section 2. THAT, Resolution No. 18-243 is hereby rescinded in its entirety. Section 3. THAT, a copy of the caption of this Resolution be spread up the minutes of the City Council.
