RE: P.R. 20808—Third Year (2nd and Final Renewal) Annual Striping of City
Streets
Introduction:
City Council to approve P.R. 20808 authorizing the City Manager to execute the third year
(second and final renewal) of an agreement with Crabtree Barricade Systems, Inc. of
Beaumont, Texas with an annual projected budgetary impact of$30,000.00.
Background:
This is an annual contract to provide striping of city streets with the option to renew for two
additional one year terms as per Resolution No. 17-098. Per Resolution 18-068, the City
executed the second year (first renewal) of this contract. This resolution is for the third year
(second and final renewal) of this contract.
Budget Impact:
Funding available in PW/Other Contractual Service Account No. 001-1205-531.59-00.
Recommendation:
It is recommended that City Council approve PR 20808 authorizing the City Manager to
execute the third year (second and final renewal) of an annual striping contract with Crabtree
Barricade Systems, Inc.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE THIRD YEAR (SECOND AND
FINAL RENEWAL) OF THE CONTRACT BETWEEN THE CITY OF
PORT ARTHUR AND CRABTREE BARRICADE SYSTEMS, INC. OF
BEAUMONT, TEXAS, FOR THE ANNUAL STRIPING OF CITY
STREETS, WITH AN ANNUAL PROJECTED BUDGETARY IMPACT OF
$30,000. FUNDING IS AVAILABLE IN PUBLIC WORKS — OTHER
CONTRACTUAL SERVICE ACCOUNT NO. 001-1205-531.59-00.
WHEREAS, pursuant to Resolution No. 17-098, the City entered into an
agreement with Crabtree Barricade Systems, Inc. for the annual striping of city streets,
with the option to renew for two (2) additional one-year periods; and,
WHEREAS, pursuant to Resolution No. 18-068, the City renewed the contract
for an additional one (1) year with Crabtree Barricade Systems, Inc. for the annual
striping of city streets, with the option to renew for one (1) additional one-year period;
and,
WHEREAS, this contract is for the second and final renewal of this contract;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is hereby authorized to execute the third year (second
and final renewal) of the contract with Crabtree Barricade Systems, Inc. of Beaumont,
Texas (attached as Exhibit "A") for the annual striping of city streets, with an annual
projected budgetary impact of $30,000.00, funding is available in account 001-1205-
531.59-00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

SECOND AND FINAL RENEWAL CONTRACT
FOR THE ANNUAL STRIPING OF CITY STREETS
THIS AGREEMENT, made this the of , 2019, by and between the
City of Port Arthur, a municipal corporation organized under the laws of the State of
Texas, hereinafter called "OWNER" or "CITY", and Crabtree Barricade Systems,
Inc. , hereinafter called "CONTRACTOR".
WITNESSED: That for and in consideration of the payment terms, conditions and
agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. Pursuant to Resolution No. 17-098, the City entered into a one (1) year
contract with the option to renew for two additional one year periods.
2. Pursuant to Resolution No. 18-068, the City renewed an additional one (1)
year contract with the option to renew for an additional one year period.
The parties hereby agree to exercise said option for the third year (final
renewal).
3. The term of this Contract shall be from May 13, 2019 to May 12, 2020,
unless sooner terminated under the provision hereof. The City can
terminate this contract at its convenience which includes, but not limited
to, funding not being available in any budget cycle with ten (10) days
written notice.
4. During the term of this Contract, the CONTRACTOR will furnish at his own
expense all of the materials, supplies, tools, equipment, labor, and other
services necessary to connection therewith, excepting those supplies
specifically not required of CONTRACTOR in the Specifications.
5. The CONTRACTOR agrees to perform all the work described in the
specifications and contract documents and to comply with the terms
stated in the contract per Resolution 17-098.
6. The term "Contract Documents" means and includes the following:

4) Specifications *
5) Bid *
6) Bidder's Information Sheet *
*These items were attached to the original letting contract. This
agreement is only included in this renewal.
7. This Agreement shall be binding upon all parties hereto and their respective
heirs, executors, administrators, successors, and assigns.
8. IN WITNESS WHEREOF, the parties here to have executed, or caused to be
executed by their duly authorized officials, this Agreement in two (2) copies,
each of which shall be deemed an original of the date first written above.
