Introduction: Staff recommends that City Council adopt P.R. No. 20791, authorizing the City Manager to execute contracts with six (6) vendors for the mowing of Privately-owned and City-owned residential and commercial vacant and developed lots in Area A. The Contractors are: (1) J. B. Lawn Service of Port Arthur, Texas @ $0.0030 per square foot; (2) K & D Affordable Lawn Service of Port Arthur, Texas @ $0.0030 per square foot; (3) Newcost Company of Port Arthur, Texas @ $0.0033 per square foot; (4) SMO Unlimited of Port Arthur, Texas @ $0.0033 per square foot; (5) No Problem Lawn Service of Beaumont, Texas @ $0.0033 per square foot; and (6) Mary's Land Maintenance of Port Arthur, Texas @ $0.0035 per square foot. (Due to an abundance of high grass in Port Arthur, the Environmental Health Division needs multiple contractors to maintain each area. Background: Bids were opened on March 6, 2019 for the mowing of privately-owned and city-owned vacant and developed lots in Area A, an area of the city which includes El Vista, Vista Village, Lakeside, Port Acres and Montrose One Subdivision. Bid award is based on the lowest and most responsive bids. Twenty-three companies submitted bids for Area A, eight were disqualified due to lack of proper equipment and nine were disqualified due to price. Eight contractors did not submit a bid for Area A. Recommendation: Staff recommends that City Council adopt P. R. 20153 thereby authorizing the City Manager to execute six (6) contractual agreements between the City of Port Arthur and (1) J. B. Lawn Service of Port Arthur, Texas @ $0.0030 per square foot; (2) K & D Affordable Lawn Service of Port Arthur, Texas @ $0.0030 per square foot; (3)Newcost Company of Port Arthur, Texas @ $0.0033 per square foot; (4) SMO Unlimited of Port Arthur, Texas @ $0.0033 per square foot; (5) No Problem Lawn Service of Beaumont, Texas @ $0.0033 per square foot; and (6) Mary's Land Maintenance of Port Arthur, Texas @ $0.0035 per square foot. WHEREAS, there are a large amount of properties that the City maintains by mowing the grass, due to the lack of care by the owners; and WHEREAS, multiple contractors are needed for each area due to the volume; and WHREAS,the City advertised for bids on February 12, 2019 and February 19, 2019; and WHEREAS,the City received thirty-one (31) bids on March 6, 2019; and WHEREAS,the bid tab is attached hereto as Exhibit"A"; and WHEREAS, mowing assignments will be given to the awarded contractor with the lowest awarded contract price for Area A that is available at the time; and WHEREAS,the list of successful bidders are attached hereto as Exhibit"B"; and WHEREAS,the City received identical bids for contractors shown in Exhibit"B"; and WHEREAS, Section 271.901, Texas Local Government Code states the lowest bidder by casting of lots in the case of identical bids to determine position in rotation; and WHEREAS, the contract is for one (1) year with the option to renew for two (2) additional one (1) year periods; and said contracts are attached as Exhibits C through H. P.R. NO. 20791 04/10/2019 PD NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That,the facts and opinions in the preamble are true and correct. Section 2. That the City Manager is hereby authorized to execute, on behalf of the City of Port Arthur, contracts with(1)J. B. Lawn Service of Port Arthur, Texas @ $0.0030 per square foot; (2) K & D Affordable Lawn Service of Port Arthur, Texas @ $0.0030 per square foot; (3) Newcost Company of Port Arthur, Texas @ $0.0033 per square foot; (4) SMO Unlimited of Port Arthur, Texas @ $0.0033 per square foot; (5)No Problem Lawn Service of Beaumont, Texas @ $0.0033 per square foot; and (6) Mary's Land Maintenance of Port Arthur, Texas @ $0.0035 per square foot. for the mowing of vacant and developed lots located in the area designated as Area A,in substantially the same form as attached hereto as Exhibits C thru H respectively. Section 3. That, in the presence of the governing body, and in a manner prescribed by the mayor, lots were cast, and the official rotation after the casting of lots is delineated in Exhibit B-1. Section 4. That, a copy of the caption be spread upon the Minutes of the City Council.
