A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF PORT
ARTHUR AND JEFFERSON COUNTY PRECINCT-3 TO CUT THE
GRASS FOR THE NORTH AND SOUTH LEVEES OF PLEASURE
ISLAND, REPAIR A PORTION OF S. 1ST STREET FROM THE PORT
AUTHORITY GATE TO THE END OF THE STREET (BOAT LAUNCH)
(2800'), REPAIR BACKRIDGE ROAD FROM THE COUNTY LINE TO
THE STATE LINE (5000') IN SABINE PASS, AND PERMISSION TO
USE PROPERTY ID 137914 (TRACTS 47 AND 48, 167 JOHN
MCGAFFEY 6, LOTS 47 AND 48) CEMETERY LOT, WITH A
PROJECTED BUDGETARY IMPACT OF $77,117.57. FUNDING IS
AVAILABLE IN THE PUBLIC WORKS MAINTENANCE ACCOUNT NO.
001-1203-531.36-00
WHEREAS, pursuant to Resolution No. 19-206, the City Council authorized the
City Manager to request on behalf of the City, an Interlocal Agreement between the City
of Port Arthur and Jefferson County Precinct-3 to cut the grass for the North and South
levees of Pleasure Island , repair S. 1st street in Sabine Pass from the Port Authority gate
to the dead end (boat launch) (2800'), repair Backridge Road from County Line to the
State Line (5000'), and permission to use property ID 137914 (Tract Nos. 47 & 48, 167,
John McGaffey 6, Lots 47 & 48) cemetery lot, with a projected budgetary impact of
$77,117.57, as shown on Exhibit "A" attached hereto and made a part hereof.
WHEREAS, a one-year renewable agreement of the Interlocal Agreement for
cutting the grass for the North and South Levees of Pleasure Island will be required; and,
WHEREAS, the Jefferson County Commissioners' Court is scheduled to consider
and possibly approve and authorize the County Judge to execute the Inter-local
Agreement between Jefferson County and the City of Port Arthur to allow Precinct-3 to

perform work and services pursuant to Sec. 791.014, Texas Government Code, on
Monday, June 3, 2019.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct.
THAT, the City Council hereby authorizes the City Manager to enter into on behalf
of the City, an Interlocal Agreement between the City of Port Arthur and Jefferson County
Precinct-3 to cut the grass for the North and South levees of Pleasure Island , repair S.
1st street in Sabine Pass from the Port Authority gate to the dead end (boat launch)
(2800'), repair Backridge Road from County Line to the State Line (5000'), and permission
to use property ID 137914 (Tract Nos. 47 & 48, 167, John McGaffey 6, Lots 47 & 48)
cemetery lot, with a projected budgetary impact of $77,117.57, in substantially the same
form as attached hereto as Exhibit "A".
THAT, funding being available in the Public Works Maintenance Account No. 001-
1203-531.36-00; and,
THAT, this resolution is contingent upon the Jefferson County Commissions'
Court's approval and authorization for the County Judge to execute the Interlocal
Agreement between Jefferson County and the City of Port Arthur to allow Precinct-3 to
perform work and services pursuant to Sec. 791.014, Texas Government Code, on
Monday, June 3, 2019.
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

RE: Assistance through Inter-local Agreement
Dear Commissioner Sinegal:
The City of Port Arthur requests the assistance of Jefferson County through an inter-local agreement for the North and
South Levees of Pleasure Island, Backridge Rd from County Line to State Line (5000'), S. I' Street in Sabine Pass
from the Port Authority Gate to the Dead End (Boat Launch)(2800'), and permission to use property ID 1379H (TRS
47&48 167 JNO McGaffey 6 Lot 47 48)Cemetery lot.
1. Cut the grass for the North and South Levees of Pleasure Island by using one slope mower,two side arms
and two bush hogs. One Gradall and a dump truck to clean the scattered pieces of waste and trash. And a
Dozer to clear all the rocks. so it will not damage the equipment on future mowing. The City of Port
Arthur Requests mowing the North and South Levee twice a year as needed and determined by Pct. 3 or
City of Port Arthur. As not to bind future Commissioners or City officials to said Interlocal agreement.a 1
year renewal of the Interlocal for Pleasure Island will be required.
2. Level up and repair S. 1st Street from the Port Authority Gate to the Dead End (Boat Launch)(2800')with
hot mix asphalt then come back with seal coat.
3. Level up and repair pot holes on the Port Arthur section of Backridge Road (5000')with hot mix asphalt
then come back with seal coat.
4. Permission to use a Cemetery Lot(ID 137914) in Sabine Pass as a depository of surplus soil from
clearing/cleaning ditches in Sabine Pass. It is understood that the City will use all due care to avoid
damage to the area and any leveling or smoothing of the soil will be the responsibility of the City.
The City of Port Arthur will provide the following for your assistance:
1. To provide the City of Port Arthur the initial assistance in the North and South Levee during the road
building months, Jefferson County Pct. 3 will have to work on overtime as not to hold up their regular
scheduled projects. The initial payment to Pct. 3 will be the overtime, fuel for the six(6)pieces of
equipment used, and miscellaneous items.
Labor—60 hrs of overtime X $37.00/hr X 9 employees= $19,980
Fuel—200 gallons X $3.00/gallon=$600

Herbicide spraying (2 times)$915.07
Miscellaneous- 15% total = $3,087
Total =$24,582.07
After the initial cost, the Pct. 3 shall accept 14 tons of High Performance Hotmix and 1,200 gallons of
CRS-Oil for the next time Pet. 3 cuts the grass at the North and South Levee.
- High Performance Ilotmix- 14 tons X $98.25 = $1375.50
- CRS-Oil- 1,200 gallons x $2.11 =$2,532.00
Total =$3,907.50
2. Material for 1' Street
- Oil (CRS 2) 3,000 gallons X$2.11 - $6,330.00
- Hot Mix Asphalt- 120 tons X $68.90 - $8,268.00
- Cover Stone-220 tons X $27.00 =$5,940.00
Total --- $20,538.00
- For the labor and equipment used by Pct. 3, The City will reimburse Pct. 3 with 2,500 of(CRS-2)
- 2,500 gallons (CRS-2) X $2.11 =$5,275.00
3. Material for Backridge Rd.
- Oil (CRS 2) 3000 gallons X $2.11 =$6,330.00
- Hot Mix Asphalt - 100 tons x $68.90=$6.890.00
- Cover Stone- 160 tons x $27.00 =$4,320.00
Total -$17,540.00
- For the labor and equipment used by Pct. 3, The City will reimburse Pct. 3 with 2.500 of(CRS-2)
- 2,500 gallons of(CRS-2) x $2.11 = $5,275.00
4. For permission to use a cemetery lot, the City of Port Arthur shall level the cemetery lot to eliminate the
ponding.
In total, the City cost shall not exceed the amount of$77,117.57 to cut the grass in the North and South levee twice,
rehabilitate ls` Street and Backridge Rd and the City will grant the County permission to use the cemetery lot to deposit
surplus soils.

)( INTERLOCAL AGREEMENT
COUNTY OF JEFFERSON )(
WHEREAS, Jefferson County, Texas, by and through its Commissioners' Court as authorized by
Chapter 791 of the Government Code and the City of Port Arthur, a body politic of the State of
Texas, for the mutual benefit of the citizens they serve, desire to enter into a contract to provide
certain services to each other, and;
WHEREAS, Jefferson County, Texas through Commissioner Precinct Three has, from time to
time, capacity to provide labor and equipment suitable for the repair of roadways, and;
WHEREAS, the City of Port Arthur, has, from time to time, the need to maintain and repair
streets and roadways which it owns, and;
WHEREAS, the city of Port Arthur, does not have the labor or equipment suited for such
construction and/or maintenance, and;
Now,therefore, know all men by these presents:
City of Port Arthur and Jefferson County hereby agree as follows:
1. Jefferson County shall furnish labor and equipment to repair certain streets, and
provide services listed on Exhibit A incorporated herein when and as determined
at the discretion of the Commissioner for Jefferson County Precinct Three, subject
to the requirements of Section 791.014 of the Government Code.
2. The City of Port Arthur shall furnish Precinct Three, with materials and funding
needed in exchange for the labor and equipment.
3. Consideration for the repairs herein contemplated shall be determined and
mutually agreed from time to time depending on the scope of the repair needed.
4. This agreement shall be effective on the date of its execution and may be
terminated at the will of either party.
5. This agreement shall be construed according to the laws of the State of Texas.
6. Nothing in this agreement shall be construed to create the existence of an agency
relationship between the parties.
7. Any employee of a party performing services pursuant to this agreement shall not
be deemed to be the agent of the party receiving services under this agreement.
8. The parties further agree, pursuant to Sec. 791.105, Texas Government Code, that
any dispute regarding the terms of this agreement will be submitted to and agreed
upon mediator.
