Introduction:
The intent of this Agenda Item is to request the City Council's approval of P.R. No. 20907
authorizing the City Manager to execute a contract with Classic Sports of Spring,Texas for the
replacement of the basketball court at Barbara Jacket Park in an amount not to exceed
$38,250.00.
Background:
On August 24, 2017, the Mayor of the City of Port Arthur issued a Disaster Declaration due to
Hurricane Harvey. Barbara Jacket Park, one of the most utilized parks in the city, was
severely affected. The basketball court sustained severe damage due to substantial rain and
flooding caused by Hurricane Harvey. It is necessary to replace the basketball court in order
for the park to continue to be a highly utilized park for the citizens of Port Arthur.
Budget Impact:
Funding in the amount of$38,250.00 is available for this purpose in the Hurricane Harvey
Fund Account 147-2300-901.39-00 Project No. 082617.
Recommendation:
It is recommended that the City Council approve P.R. No.20907 authorizing the City Manager
to execute a contract with Classic Sports of Spring,Texas for the replacement of the basketball
court at Barbara Jacket Park in an amount not to exceed $38,250.00.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO A CONTRACT WITH CLASSIC SPORTS OF SPRING, TEXAS
FOR THE REPLACEMENT OF THE BASKETBALL COURT AT
BARBARA JACKET PARK IN AN AMOUNT NOT TO EXCEED
$38,250.00 ACCOUNT NUMBER 147-2300-901.39-00, PROJECT NO.

WHEREAS, on August 24, 2017, the Mayor of the City of Port Arthur issued a Disaster
Declaration due to Hurricane Harvey; and,
WHEREAS, the basketball court at Barbara Jacket Park was severely damaged due to
the substantial rain and flooding caused by Hurricane Harvey; and,
WHEREAS, three (3) quotes were received from three (3) companies for the
replacement of the basketball court on Barbara Jacket Park; and,
WHEREAS, the quote tabulation is attached hereto and made a part hereof as Exhibit
"A"; and,
WHEREAS, Classic Sports of Spring, Texas provided the lowest and most responsible
quote for the replacement of the basketball court at Barbara Jacket Park and; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR,TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Classic Sports of Spring, Texas, the lowest and most responsible
quote in accordance with Exhibit "A", is awarded a quote for the replacement of the basketball
court at Barbara Jacket Park.
Section 3. That the City Manager of the City of Port Arthur is hereby authorized and
directed to execute on behalf of the City of Port Arthur a contract, a copy of which is attached
hereto as Exhibit "B", between the City of Port Arthur and Classic Sports of Spring, Texas, in

the amount not to exceed $38,250.00, for the replacement of the basketball court without
painting the new pavement at Barbara Jacket Park.
Section 4. That a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

Exhibit "B"
AN AGREEMENT FOR REPLACING THE BASKETBALL COURT AT
BARBARA JACKET PARK BETWEEN THE CITY OF PORT ARTHUR
AND CLASSIC SPORTS.
THIS AGREEMENT, made this day of , 2019 by and between the City of
Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter
called "OWNER" or"CITY" and CLASSIC SPORTS, hereinafter called "CONTRACTOR".
WITNESSED: That for and in consideration of the payments, terms, conditions, and agreements
set forth herein , OWNER and CONTRACTOR agree as follows:
1. The CONTRACTOR will commence the work required by the Contract Documents upon
Receipt of a Notice to Proceed. The work to be performed under this Contract will be
completed within 30 days of commencement.
2. The CITY can terminate this contract at its convenience, which includes, but is not limited to,
funding not being available in any budget cycle with ten (10) days written notice. Any terms
and conditions stated in original specifications will apply to any extended periods.
3. The CONTRACTOR will replace basketball court at Barbara Jacket Park [100 Gilham
Circle Port Arthur,Texas] for the City of Port Arthur as stated in the Contract Documents.
4. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of
the materials, supplies, tools, equipment, labor and other services necessary to perform the
repairs delineated in the bid specifications.
5. The CONTRACTOR agrees to perform all the work described in the specifications and
contract documents and to comply with the terms therein for a price not to exceed
$38,250.00.
6. The CONTRACTOR will ensure the basketball court at Barbara Jacket Park is free of all
debris and ready for City use once all repairs are complete.
7. The term "Contract Documents" means and includes the following:
1) Agreement
2) Quote/Specifications
3) Notice to Proceed
8. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
9. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by
their duly authorized officials, this Agreement in (2 copies) each of which shall be deemed an
original on the date first above written.

PROPOSAL
We hereby submit specifications and estimates for:
City of Port Arthur
Barbara Jacket Park 100 Gillham Cicle, Port Arthur TX
Community Park Basketball Court
Replace the concrete slab 5,400 square feet
Install temporary fence
Demo the existing pavement for the court
Excavate as needed
Compact base
Install forms and#4 rebar 16" oc, both directions
Pour and install 3,000 PSI concrete, light finish
Stripe the new court with boundary and free throw lines
Jobsite clean-up daily and final clean
All materials, equipment and labor to complete entire project $ 38,250
Add $ 6,500 to paint all the new pavement
standard pavement colors : dark green and california red
Expect 3 weeks to complete all work after the purchase order has been received
If approved to paint all the pavement, add 30 days to job completion date for concrete curing
Protect all property and grounds
All debris to be removed from worksite for completion of project
All material is guaranteed to be as specified. All work to be completed in a workman like
manner according to guidelines set by specifications. Any alterations, changes or additions to
contract must be written notice and signed by both parties. Safety equipment and material to be
provided by McKenna Contracting
Not included : relocation of any utilities, landscaping or any other obstructions
Sales tax to be added to invoice, unless Sales Tax exemption form is provided
Terms: 50% downpayment at time of ordering, balance due upon installation
