ORDINANCE NO.
AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE
RESULTS OF THE RUNOFF ELECTION, HELD ON JUNE 22, 2019 FOR
THE PURPOSE OF ELECTING A MAYOR IN THE CITY OF PORT
ARTHUR, TEXAS
WHEREAS,the City of Port Arthur is a home rule city with a governing body composed of a Mayor
and eight (8) Councilmembers as delineated below:

WHEREAS, the term for Mayor was due to expire in May 2019; and
WHEREAS, on May 15, 2019 the City Council adopted Ordinance No. 19-19 that called for a
Runoff Election on June 22, 2019 for the purpose of electing a Mayor; and
WHEREAS,the City Secretary certified that the following candidates filed for the office of Mayor:
Derrick Ford Freeman
Thurman "Bill" Bartle
WHEREAS, the City Council has a duty to canvass the election returns, pursuant to Chapter 67 of
the Election Code; and

WHEREAS, the date to canvass the election returns is July 3, 2019.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the returns of said Runoff Election, after being canvassed by the City Council,
are found and declared to be true and correct. There were cast at said election for the respective
candidates the number of votes as shown on the tabulated statements that are attached hereto and
made a part hereof as Exhibit "A" and as delineated below:
Mayor: Derrick Ford Freeman 1593
Thurman "Bill" Bartle 1885
Section 3. That based on the representations of the City Secretary, that she conducted the
Election in accordance with state, local and federal law, and based on the presumption under the law that
the election judges are presumed to have done their duty, the City Council has determined that the
Runoff Election was duly called, ordered, and held in accordance with the laws of the State of Texas, the
Charter of the City of Port Arthur, and Ordinance No. 19-19, that the Order for the conduct of the Runoff
Election and the returns thereof, have been made by the proper officials, and that the June 22, 2019
election resulted in the election of the following:
Mayor: Thurman "Bill" Bartle
Therefore, Thurman "Bill" Bartie is herby declared to be elected as Mayor. That the term for the
Mayor shall commence on the date that Thurman "Bill" Bartie is duly qualified and shall expire in May,
2022, or until his/her successor has been duly qualified.
Section 4. That the City Council shall therefore be composed of the following members:

Section 5. That this being an Ordinance for which publication is not required under the Charter
of the City of Port Arthur, it shall not be published, but shall take effect and be in force immediately from
and after its passage.
Section 6. That a copy of the caption of this Ordinance be spread upon the Minutes of the City
Council.

a Meeting of the City Council of the City of Port Arthur, Texas, by the following vote:
