NO. 20866—A resolution calling for a public hearing for a zoning change Introduction: The intent of this Agenda Item is to request a public hearing to consider a zoning change from Single (SF)to Heavy Commercial (HC) for approximately 8.512-Acres of Land consisting of part of Block 386, and all of Blocks 387, 402, and 403, together with adjacent alleys and rights-of-way, Port Arthur, Jefferson County, Texas. The purpose of this request is to allow for the proposed construction/development of the City's municipal Animal Shelter, as well as other municipal and drainage district operations/development, in accordance with Appendix A, Section 7-100 of the City's Zoning Ordinance. The property is located at 1401 19th Street (formerly the site for the municipal Water Purification Plant) and adjacent properties. Background: The Planning & Zoning Commission held a public hearing on Monday, May 20, 2019. There were no objections from members of the public regarding this zoning change request; however, citizen(s) did express concerns regarding the use of heavy commercial vehicles, as well as the possibility of increased property taxes to adjacent properties. In accordance with Appendix A, Section 24-104. Public hearing requirements, a public hearing shall be held by the city council before adopting any proposed amendment, supplement or change. Notice of such hearing shall be given by publication in a newspaper of general circulation in the City of Port Arthur stating the time and place of such hearing, which time shall not be earlier than 15 days from the date of publication. The city council hearing may be conducted as a joint hearing with the planning and zoning commission in accordance with the provisions of V.T.C.A., Local Government Code § 211.007. Unless a proposed amendment, supplement or change has been approved by the planning and zoning commission, or if a protest against such proposed amendment, supplement or change has been filed with the city secretary, duly signed and acknowledged by the owners of 20 percent or more, either of the area of the lots or land included in such proposed changes, or of the lots or land immediately adjoining the same and extending 200 feet therefrom, such amendment shall not become effective except by the favorable vote of three-fourths of all the members of the city council. Budget Impact: None Recommendation: It is recommended that City Council approve P.R. No. 20866, calling for a public hearing to consider a zoning change from Single (SF)to Heavy Commercial (HC)for approximately 8.512-Acres of Land consisting of part of Block 386, and all of Blocks 387,402, and 403, together with adjacent alleys and rights-of-way, Port Arthur, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A ZONING CHANGE FROM SINGLE FAMILY TO HEAVY COMMERCIAL FOR APPROXIMATELY 8.512-ACRES OF LAND CONSISTING OF PART OF BLOCK 386, AND ALL OF BLOCKS 387, 402, AND 403, TOGETHER WITH ADJACENT ALLEYS AND RIGHTS-OF-WAY, CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS WHEREAS, it is being requested that the City of Port Arthur consider this zoning change for the area delineated in Exhibit"A" from Single Family"SF"to Heavy Commercial "HC"; and, WHEREAS, pursuant of Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission reviewed this case on May 20, 2019. THAT a public hearing to consider whether to grant this applicant the zoning change request on approximately 8.512-acres of Land consisting of part of Block 386, and all of Blocks 387, 402, and 403, together with adjacent alleys and rights-of-way, in Port Arthur, Jefferson County, Texas, as delineated in Exhibit"A" shall be held on August 13, 2019 at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 Fourth Street. THAT notice of the public hearing shall be published at least fifteen days prior in the official newspaper of the City before going to the City Council. THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
