A RESOLUTION APPROVING THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION CONTRACTING THE SERVICES OF PLUMBING SPECIALTIES, LLC OF BEAUMONT, TEXAS FOR THE INSTALLATION OF A SEWER MANHOLE IN THE SPUR 93 BUSINESS PARK IN AN AMOUNT NOT TO EXCEED $7,400.00; FUNDING AVAILABLE IN EDC ACCOUNT NO. 120-1429-582.59-02 WHEREAS, per Resolution 18-386, the City Council of the City of Port Arthur approved the City of Port Arthur Section 4A Economic Development Corporation ("PAEDC") selling land in the Spur 93 Business Park to Walden Road Properties, LLC for the purpose of the development of the property for the relocation of Industrial Scaffolding, LLC from Beaumont, Texas to Port Arthur. Texas; and WHEREAS, in order to properly serve the new development's infrastructure, the installation of a sewer manhole is necessary on the north end of South Business Park Drive; and WHEREAS, bids were received for the installation of a junction box and sewer manhole at the Spur 93 Business Park, and upon review of the bids, it was determined that the least expensive option was to separate the projects (see Exhibit"A"); and WHEREAS, Plumbing Specialties, LLC of Beaumont, Texas provided a quote in an amount of$7,400.00 for the installation of the sewer manhole needed; and WHEREAS, that the City Council of the City of Port Arthur hereby recommends that PAEDC contracts the services of Plumbing Specialties, LLC for the installation of the sewer manhole on the basis of their quoted fee of$7,400.00 (Exhibit "B"). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council of the City of Port Arthur authorizes PAEDC to contract the services of Plumbing Specialties, LLC of Beaumont, Texas for the installation of a sewer manhole on the north end of South Business Park Dr. in the Spur 93 Business Park in an amount not to exceed $7,400.00. Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Re-install paving patch and curb to match existing concrete thickness including drilling and dowelling into existing concrete. 7. Perform compaction testing of soils as specified and compression testing of concrete cylinders by a third-party testing laboratory. 8. Perform housekeeping of areas affected by our activities. Excess spoils generated from excavations will be loaded,hauled and dumped at an approved on-site location. 2. Removal of unidentified underground obstructions,and any associated delays or downtime due to the same,will be considered as extra to this proposal. 3. All permits to be by others. 4. Our pricing is based on using sprayed on membrane curing compounds only. Wet curing or flooding of concrete is not included. 5. Our proposal includes one(1)mobilization/demobilization to the jobsite with the necessary equipment for one (1)continuous operation.Additional mobilization charges, if required, shall be considered extra work and charged as mutually agreed upon. Our proposal is based on continuous work activity without delays beyond our control. 6. Proposal excludes delays caused by others,beyond the control of Bo-Mac,and shall be extra to this proposal. 7. Bo-Mac shall be granted extensions of time for weather delays beyond its control. Weather delay shall consist of time lost due to weather, with respect to accomplishing tasks identified as critical in the construction schedule. A weather delay shall exist where field conditions,remediable by favorable weather,de-mucking or removal of rainwater prevent accomplishment of a critical task. 8. This proposal is subject to revision and/or withdrawal unless accepted as a part of a mutually agreeable contract within thirty(30)days of the above date. 9. Proposal is based on safety supervision performed by our Project Superintendent with supplemental visits by representatives of our Health and Safety Department. If a full - time dedicated safety supervisor is required, it will be extra and can be furnished for a mutually agreed upon price. 10. We have visited the site to verify access for personnel and equipment. Our pricing is based on the site conditions viewed during our site visit including any visible above ground obstructions. Site conditions that differ from this description could have cost impact. 11.No SWPPP work (Silt Fence, Hay Bales, etc.) is shown on the plans or included in our pricing. Page 2 of 3 12. Bo-Mac reserves the right to seek equitable time and compensation for delays (including suspensions) and damages not caused by Bo-Mac or those under its control, including any unknown underground obstructions, and changes to the Work. 13.All references to a schedule and/or sequence shall refer to a mutually agreeable schedule or sequence which Bo-Mac has taken part in the planning of and to which Bo-Mac agrees to be bound.
