Introduction: The intent of this Agenda Item is for the acceptance of Change Order No. 1 for the Reconstruction of 15th Street from Vera Drive to Main Avenue. This change order is to request a time extension by adding 27 calendar days due to delays in local concrete mix plants(Martin Marietta and Knife River)and reworking driveway and culvert elevation errors found in the field. The delays were caused by the back order of concrete this summer(three to four weeks delay). Contract amount will remain the same. Background: Excavation and Construction LLC of Port Arthur,Texas was awarded the contract to reconstruct 15th Street from Vera Drive to Main Avenue with a contract amount of$289,350.70. The project is being funded through the City's Capital Street Improvement Program. The agreed upon contract term for this project is 150 calendar days Budget Impact: Funds are available in account 307-1601-591.86-00, Capital Improvement Account. Project No. ST1PO4. Contract amount stays the same. Recommendation: It is recommended that the City of Port Arthur City Council approve PR 20988 authorizing the City Manager to execute Change Order No. 1 with Excavation and Construction LLC of Port Arthur,Texas for the Reconstruction of 15th Street from Vera Drive to Main Avenue. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND EXCAVATION AND CONSTRUCTION, LLC OF PORT ARTHUR, TEXAS FOR 15TH STREET IMPROVEMENTS FROM VERA DRIVE TO MAIN AVENUE INCREASING THE CONTRACT COMPLETION TERM BY 27 CALENDAR DAYS TO A NEW TERM OF 177 CALENDAR DAYS WITH NO CHANGE TO THE CONTRACT AMOUNT OF $289,350.70. FUNDING IS AVAILABLE IN THE CAPITAL IMPROVEMENT STREETS ACCOUNT NUMBER 307-1601- 591.86-00. PROJECT NO. ST1PO4 WHEREAS, pursuant to Resolution No. 19-038, the City of Port Arthur City Council awarded a contract for the Reconstruction of 15th Street Improvements from Vera Drive to Main Avenue to Excavation and Construction, LLC of Port Arthur, Texas with a projected budgetary impact of $289,350.70 and a completion term of 150 calendar days; and, WHEREAS, proposed Change Order No. 1 increases the contract completion term by 27 calendar days due to the delays in local concrete mix plants (Martin Marietta and Knife River) and reworking the driveway and culvert elevation errors found in the field; attached hereto as Exhibit "A"; and, WHEREAS, the delays were caused by the back order of concrete this summer (three to four weeks delay); and, WHEREAS, approval of Change Order No. 1 herein deemed an appropriate action; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. 20988 Page 2 THAT, the facts and opinions in the preamble are true and correct; and, THAT, Change Order No. 1 is herein approved and the City Manager is authorized to execute said Change Order No. 1 (Attached as Exhibit A) to the contract between the City of Port Arthur and Excavation and Construction, LLC of Port Arthur, Texas; and, THAT, Change Order No. 1 will increase the contract term by 27 calendar days to a new contract time of 177 calendar days and the contract amount will remain the same; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
