RE: A Resolution Approving a Property Damage Settlement in the Amount of$6,609.75 for
Damages to City of Port Arthur Lift Stations
Nature of the request: On August 29, 2017, Hurricane Harvey struck the City of Port
Arthur, resulting in flood damage to multiple lift stations.
Staff Analysis, Considerations: The City has Property Damage insurance coverage through
Texas Municipal League Intergovernmental Risk Pool (TML). TML has offered the City a
settlement of $6,609.75 (Exhibit "A" attached). This amount is sufficient to cover expenses
incurred during temporary repairs to the lift stations.
Recommendation: I recommend approval of Proposed Resolution No. 20993 authorizing the
property damage settlement against TML for damage sustained to various lift stations. TML has
offered to settle the claim for$6,609.75.
Budget Considerations: The funds received will be deposited in the Miscellaneous
Income/Insurance Proceeds Account#147-0000-369.85-00, Project#082617.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE THE SETTLEMENT OF A CLAIM
IN THE AMOUNT OF $6,609.75 MADE AGAINST
TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TML)
AS A RESULT OF THE TEMPORARY REPAIRS OF LIFT STATION DAMAGE DUE TO
HURRICANE HARVEY
WHEREAS, on August 29, 2017, Hurricane Harvey struck the City of Port Arthur,
resulting in flood damage to multiple lift stations as listed in Attachment "A" (attached); and,
WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League
Intergovernmental Risk Pool (TML); and,
WHEREAS, TML has offered to settle the claim for $6,609.75 for the temporary repairs
to the listed lift stations, which is considered a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR, TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to execute the settlement in the
amount of $6,609.75. for the claim against Texas Municipal League Intergovernmental Risk
Pool (TML) for the temporary repairs to lift stations. This amount is based on actual cost
relating to lift station repairs.
Section 3. That, a copy of this Resolution be spread upon the minutes of the City
Council.
