A RESOLUTION AUTHORIZING THE SECOND AND FINAL RENEWAL OF THE CONTRACT WITH MCCREARY, VESELKA, BRAGG & ALLEN, P.C. OF ROUND ROCK, TEXAS, FOR COLLECTION OF MUNICIPAL COURT FINES WHEREAS, pursuant to Resolution No. 15-270, the City Council approved a two-year contract with McCreary, Veselka, Bragg & Allen, P.C. (MVBA) of Round Rock, Texas, for collection of Municipal Court Fines, which included an option to renew for two additional two- year periods; and WHEREAS, pursuant to Resolution No. 17-241,the City Council approved an additional two years (first renewal) of the collection service contract with MVBA; and WHEREAS, the City desires to renew said collection service contract for an additional two-years (second and final renewal). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Council of the City of Port Arthur hereby approves the second and final two-year renewal of the existing contract between the City of Port Arthur and McCreary, Veselka, Bragg & Allen, P.C. Of Round Rock, Texas, in substantially the same form as attached hereto as Exhibit"A". Section 3. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. READ,ADOPTED AND APPROVED this day of A.D., 2019, at a Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: AYES: Mayor: Councilmembers: NOES: Thurman "Bill" Bartie Mayor ATTEST: Sherri Bellard City Secretary APPROVED AS TO FORM: h Lets/ o€ Val: Tiz o Ci , •tto APPROVED FOR ADMINISTRATION: Ron Burton, Interim City Manager EXHIBIT "A" SECOND AND FINAL RENEWAL COLLECTION SERVICES CONTRACT FOR MUNICIPAL COURT THIS AGREEMENT, is made the day of , 2019, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and McCreary, Veselka, Bragg & Allen, P.C. Of Round Rock, Texas, herein acting by and through hereinafter called "VENDOR" agree as follows: WITNESSETH: That for and in consideration of the payments, terms, conditions, and agreements set forth herein, OWNER and VENDOR agree as follows: 1. Pursuant to Resolution No. 15-270, the City entered into a two (2) year contract with the option to renew for two (2) additional two-year periods. 2. Pursuant to Resolution No. 17-241, the City renewed the contract for an additional two (2) year, with the option to renew for one (1) additional two-year period. The parties hereby agree to exercise said option for the second and final renewal (final renewal), unless sooner terminated under the provisions hereof 3. The term of this Contract shall be for two (2) years, second and final renewal, from the date of the Notice to Proceed. The City can terminate this contract at its convenience with thirty (30) days written notice. 4. The Vendor will provide collection services as delineated and submitted in RFP P15-051, dated June 2, 2015. 5. During the term of this Contract, the Vendor will furnish all of the services as stated in the specification, described as: Maximize Your Delinquent Court Collections submitted on June 2,2015. 6. The Vendor agrees to enforce the collection of delinquent Court fees and fines as stated in the proposal dated June 2, 2016. 7. This agreement is only included in this renewal. 8. This agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in (2 copies) each of which shall be deemed an original on the date first written above.
