Introduction:
The intent of this Agenda Item is to seek the City Council's approval of Proposed
Resolution No. 21036, authorizing an excavation permit for 44.2-acres of Land out of
and part of Lots 1-4, Block 13, Range "M", Port Arthur Land Company Subdivision, Port
Arthur, Jefferson County, Texas.
The issuance of the permit will grant the requestor (V. Investments, LLC) approval to
operate a commercial dirt pit at said location.
Background:
On January 2, 2008, City Council approved Ordinance No. 08-03, granting a permit for
V. Investments, LLC to excavate earth material on a 96.4383-Acre Tract of Land, which
included part of Lots 1-4, along with Lots 6-8, Block 13, Range "M", Port Arthur Land
Company Subdivision.
The permit expired on January 2, 2018; therefore, prompting the permittee to submit a
new application to the city planning and zoning commission for permitting of a smaller
area.
In accordance with Chapter 94, Article VII, Section 94-451(Required) of the Code of
Ordinances of the City of Port Arthur, no person shall dig, excavate, remove, or cause
to be dug, excavated or removed, any dirt, clay, rock or other material below the surface
of the ground without having first obtained an excavation permit in accordance with the
provisions of this article. All excavations for which a permit is required shall be subject
to an annual inspection to ensure compliance with the requirements of this article. This
inspection shall be conducted by the director of public works or his/her designee. A
written inspection report evaluating compliance with this article shall be filed with the
City Secretary. Any excavations in violation of this article are declared to be public
nuisances.
The permit shall be for a time period of fifteen (15) years, expiring of October 22, 2034.
Budget Impact:
In accordance with Section 94-453 (Application; fee) of this Article, each application
shall be accompanied by a nonrefundable permit fee of $250.00. Said fee was
deposited to Escrow Account No. 001-0000-369.30-00 (Misc. Fees) on September 3,
2019.
Recommendation:
It is recommended that City Council approve Proposed Resolution No. 21036,
authorizing an excavation permit for 44.2-acres of Land out of and part of Lots 1-4,
Block 13, Range "M", Port Arthur Land Company Subdivision, Port Arthur, Jefferson
County, Texas.

A RESOLUTION AUTHORIZING AN EXCAVATION PERMIT TO
BE ISSUED PURSUANT TO CHAPTER 94, ARTICLE VII
(EXCAVATIONS) OF THE CODE OF ORDINANCES, FOR 44.2-
ACRES OF LAND OUT OF AND PART OF LOTS 1-4, BLOCK 13,
RANGE "M", PORT ARTHUR LAND COMPANY SUBDIVISION,
PORT ARTHUR, JEFFERSON COUNTY, TEXAS.
V. INVESTMENTS, LLC
WHEREAS, V. Investments, LLC has requested an excavation permit for 44.2-
acres of land out of and part of Lots 1-4, Block 13, Range "M", Port Arthur Land Company
Subdivision, Port Arthur, Jefferson County, Texas; and,
WHEREAS, in accordance with Chapter 94, Article VII, Section 94-452 of the City
of Port Arthur Code of Ordinances, an excavation permit may be granted for a retention
pond or commercial excavation; and,
WHEREAS, in accordance with Chapter 94, Article VII, Section 94-427 of the City
of Port Arthur Code of Ordinances, upon receiving the recommendation of the Planning
and Zoning Commission, the City Council shall approve or disapprove the issuance of an
excavation permit, and such decision of the City Council shall be final; and,
WHEREAS, the City's Planning and Zoning Commission after review recommends
to the City Council that the permit be approved, and finds that the proposed excavation
is consistent with the public health, safety and welfare; that the requirements of Article VII
are met; and, in addition, the excavation provides for a future use of the property in
harmony with development planned for the surrounding areas as reflected in the zoning
ordinance, subdivision plans, comprehensive plan for the city, deed restrictions and
existing usage; and,
WHEREAS, the City Council hereby concurs in the recommendation and findings
of the City's Planning and Zoning Commission; now therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct.
THAT, an excavation permit is hereby granted to V. Investment, LLC for the
excavation of earth material on the following tract of land:
44.2-ACRES OF LAND OUT OF AND PART OF
LOTS 1-4, BLOCK 13, RANGE "M"
PORT ARTHUR LAND COMPANY SUBDIVISION
PORT ARTHUR,
JEFFERSON COUNTY, TEXAS
LOCATED ON THE SOUTH SIDE OF F.M. HIGHWAY 365, WEST OF MAIN CANAL "C"
EXHIBIT "A"
THAT, the excavation permit shall be issued in accordance with Chapter 94, Article
VII of the City of Port Arthur Code of Ordinances, and Exhibit "A" attached hereto and
which are incorporated and made part hereof by reference.
THAT, this permit shall be for a time period of fifteen (15) years. Excavation
operations thereafter shall constitute a violation of City Ordinances.
THAT, V. Investments. LLC shall signify acceptance of the Permit by subscription
of a certified copy thereof.
THAT, a copy of the caption of this Resolution be spread upon the minutes of the
City Council.

Dear Sir:
This letter is to be construed as a permit application to operate a commercial
excavation(dirt pit). Please find attached a check in the amount of$250.00 as required by
Sec. 94-453 —Application; Fee, and a drawing noting the excavation areas relative to this
permit application.
For reference,this site was previously permitted by Ordinance 08-03. This permit
is requested to be permitted under the same as was in said Ordinance 08-03 which is V
Investment,LLC,Mr. Mark Vernon. Sec. 94-452(3)Conditions required for granting are:
The site is to be located in the area bounded by Highway 73, Highway 365, West Port
Arthur Road and Highway 69, subject to the following conditions:
1. Commercial excavations shall be limited to areas with a natural ground elevation
of+2 feet MSL or less. The site is at+1 and in some areas at elevation-3.0.
2. Shall provide supplemental stormwater storage for Alligator Bayou Ponding area.
The site is adjacent to and west of Main C that drains to Alligator Bayou and
therefore will provide supplemental stormwater storage for Alligator Bayou
Ponding area.
3. Shall be acceptable to the city and Drainage District No. 7(DD7) as an
operational part of the drainage system. This was previously agreed upon when
the original permit was issued in 2008. A recent discussion with Mr. Brady
Girouard with DD7 said that if the City needs a new letter then DD7 would
provide one.
4. In December of 2007, Berg—Oliver Associates of Houston made a study of
approximately 60 acres(the site)to determine the areas that are jurisdictional
waters of the United States. A portion, being in the NE corner,of the site was
classified as jurisdictional wetlands that will not be part of the excavation area.

There were other isolated small areas of wetlands found but they were considered
non jurisdictional. The Supreme Court of the United States on January 9,2001
ruled that isolated wetlands may not be considered jurisdictional wetlands except
in specific cases.
Other restrictions include that the excavation is to be at least 30 feet from any property
line and or pipeline at this site. The side slopes are to be 4:1 from the top of the
excavation to the normal water level and then no more than 3:1 below the normal water
level.
Please note that the excavation along the west side of the property will be over
pipelines. These lines are at or below 60 feet from the surface and they are aware of this
commercial excavation being approximately 30 feet in depth. That is the reason these
pipelines are 60 feet deep.
