A RESOLUTION AUTHORIZING THE CITY MANAGER AND
FIRE CHIEF TO APPLY FOR THE 2007 SUPPLEMENTAL
PORT SECURITY GRANT
WHEREAS, the Fire Department seeks permission to apply
for the 2007 Supplemental Port Security Grant to assist the
Fire Department in obtaining needed equipment; and
WHEREAS, the City Council of the City of Port Arthur
finds it to be in the best interest on the citizens of Port
Arthur to authorize application for the grant; and
WHEREAS, the Fire Chief received notification that
funds will be available from the 2007 Port Security Grant
Supplement; and
WHEREAS, the grant will be used to purchase three (3)
fully equipped SW type vehicles for the Fire Marshal,
Assistant Fire Marshal and Explosives K-9 Handler and
safety equipment including body armor and hydrocarbon
monitor; and
WHEREAS, the total estimated project cost is
$140,587.58 with the federal share being 75% or $105,440.68
and the local share is 25% or $35,146.90.
NOW THEREFORE, BE IT RESOLVED BY THE CITH COUNCIL OF
THE CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the
preamble are true and correct.
Section 2. That the City Manager and Fire Chief are
authorized to apply for the 2007 Supplemental Port Security
Grant as denoted in Exhibit "A" and to execute such other
documents as necessary to apply for the grant.
Section 3. That the total estimated cost of the
project is $140,587.58.
Section 5. The local share of the project is
estimated at 250 or $35,146.90.
Section 6. That the budget will need to be amended if
this grant is approved as to identify funds for the local
share of the project.
Section 7. That a copy of the caption of this
resolution shall be spread upon the Minutes of the City
Council.

Investment Justification
I. Background.
I.A. Provide an overview of the port system in which this Investment will take place.
The City of Port Arthur Fire Department is a local municipal Public Safety agency that provides
layered response in the event of fire, specialized rescue, medical first responder, explosive canine
response and fire and explosion origin and cause investigations for all waterside and landside
petrochemical facilities under an MOU within its jurisdiction, or though mutual aid agreements.
The waterside petrochemical facilities (regulated entities) consist of the following:

The Port Arthur Fire Department provides around the clock emergency response through the 911
Enhanced system or request for assistance via 800 MHz radio through our local dispatch center
for all of the above listed facilities in conjunction with USCG Operation Neptune Shield
requirements. The Port Arthur Fire Department is also a comprehensive component of the USCG
Area Maritime Security Plan for the Sabine Neches Waterway in providing explosive canine
response to check regional port safety and security.
The City of Port Arthur has experienced substantial growth during the past four years. In
addition, an estimated $25+ billion in expansion projects are under construction or officially
approved for construction. Growth has occurred in all economic sectors including industrial,
commercial and residential. This substantial economic growth, coupled with a large geographical
area, 82.9 square miles of land area and 54.2 square miles of surface water has placed an ever
increasing burden on the Port Arthur Fire Department to provide and sustain quality public safety
and protection to the citizenry and private industry. With the previously described surface water
area of 54.2 square miles, which includes a large portion of the 56 nautical mile Sabine-Neches
Intercoastal Waterway, the susceptibility to terrorism acts, especially explosive devices such as
improvised explosive devices (IED'S) delivered via small craft or underwater certainly exists.
Some of the nations largest petrochemical waterside facilities as previously referenced above are
located along the City of Port Arthur's portion of the Sabine-Neches Intercoastal Waterway,
which includes the Motiva Refinery, which will expand its operations and become the nation's
largest petrochemical refinery. The U. S. economy is dependent upon the regions capabilities to
safely receive, store, process and transport refined and unrefined petroleum and petroleum based
products. Within the Sabine-Neches Intercoastal Waterway, the following statistical information
is of paramount importance:
• # 1 in the U.S. in Crude Tanker Visits (MARAD 2005)
• #4 World Wide in Crude Tanker Visits (MARAD 2005)
• 2"d Largest Commercial Military Out Load Port World Wide (Military Surface
Deployment and Distribution Command)
• #4 Largest Port Total Tonnage USA (AAPA 2004)
• Estimated $25+ Billion in Expansion Projects

• Sabine-Neches is responsible for 10.1% of the nation's daily refined crude oil.
• Sabine-Neches is responsible for 1,125,500 barrels per calendar day (BCD)
refined crude oil which is 26.5 % of all refined products in the state of Texas.
• (2) of the nations (4) Strategic Petroleum Reserve Sites that account for over 50%
of the nations reserve storage capacity are located in our COTP (Captain of the
Port) Zone.
• Sabine-Neches Waterway delivers 400,000 BCD of waterborne crude via pipeline
to (7) states and Canada (ACOE)
• In 2006, (47,497) vessel movements were identified by the Marine Safety Unit
(MSU) Port Arthur Vessel Traffic Service within the Sabine-Neches Waterway.
• There are 104,154 miles of underground pipelines located within the Sabine-
Neches Intercoastal region, including several transcontinental pipelines such as
the Colonial Pipeline, which provides most of the natural gas to the Northeast
U.S.

Union Pacific, Kansas City Southern, and Burlington Northern Santa Fe are the
principle cargo railways around Port Arthur. Most major private waterside
facilities are equipped with rail spurs to offer direct access to the national rail
network and marshalling yards scattered throughout the area.
Several major bridges carry the highway system across the Sabine-Neches Waterway in the
region. The Martin Luther King Bridge carries Texas Highway 82 across the Sabine-Neches
Waterway at the southeastern edge of Port Arthur. The Rainbow Bridge carries southbound
traffic on Texas Highway 87 over the shipping channel, and Veterans Memorial Bridge carries
northbound traffic on Texas Highway 87. The West Port Arthur Bridge at the southern extremity
of Port Arthur carries road traffic over the Intercoastal Waterway along the Texas Highway 87,
traveling parallel to the main shipping channel towards the communities of Sabine and Sabine
Pass. Should any of the aforementioned bridges be compromised by IED attacks involving small
craft or underwater swimmers, or by conventional means, the entire Sabine-Neches Waterway
would be paralyzed, and would cripple or shut down the described waterside and landside
petrochemical facilities (regulated entities) which would adversely affect the national economy.
I.B. Describe the applicant's current and required capabilities.
In order to effectively provide and sustain quality public safety and protection within the Port
Arthur Fire Department's Area Of Responsibility (AOR), a coordinated response from numerous
public safety and public service organizations is necessary. The City of Port Arthur is a
waterfront community along the Sabine-Neches Intercoastal Waterway and within the (AOR) for
the Captain of the Port (COPT) for the USCG Marine Unit Port Arthur. In the event of a
waterside attack or terrorist threat, the USCG must rely on the Port Arthur Police Department for
immediate assistance as MSU Port Arthur considers the PAPD as their first line of defense
within the described AOR. MSU Port Arthur is responsible for Southeastern Texas,
Southwestern Louisiana and the offshore waters up to 200 miles from land.
The Port Arthur Fire Department Explosive Canine and Handler would be a resource available as
part of that response. Since January 2002 to current, a total of seventy-five (75) responses were
made by the Port Arthur Fire Department involving a reported terroristic threat, where explosive
ordnance or components were located, or threatened as being the intended weapon, or in some
cases, validating a suspect object located within our response area posing a threat to the
community. In addition, fire and explosion investigators are also an available resource. These
investigators have conducted a total of seven hundred and fourty-three (743) cause and origin, or
other type investigations since January 2002 to current, within their jurisdiction. The Port Arthur
Fire Department Canine Unit and Investigators must have the ability to effectively communicate,
obtain, and share vital information with surrounding local, county, state and federal responding
agencies in a timely fashion. A public safety agency is virtually powerless if it cannot effectively
communicate in a timely manner.
Directed Patrols are also provided at facilities that require specific security involving inspections,
searches and inventories of all personnel and equipment at points of ingress and egress. Searches
include the use of Explosive Detection utilizing Certified Canines/Handlers, and Thermal
Imaging and Surveillance Camera Equipment. The Port Arthur Fire Department's response
capabilities include an Explosive Canine and Fire and Explosion Investigators. Transportation of
these resources and their equipment are vital in providing the immediate and necessary response.
Current vehicles used are older model vehicles and in poor repair which do not meet the needs
for carrying all of the PPE and investigation equipment to incidents responded to.
I.C. Provide a brief abstract for this investment.
The Port Arthur Fire Department Investigative Unit, under the Fire Marshal's Office, currently
consists of one (1) Fire Marshal, one (1) Assistant Fire Marshal, (1) Fire Inspector, six (6) on
shift Fire and Arson Investigators, and one (1) Canine Handler with one (1) Explosive Canine.
Three (3) 2008 Ford Expedition, or similar type vehicles, will be used to replace the two Ford
Crown Victoria units and one Chevrolet Caprice unit currently being used for Fire and
Explosion Investigation response and for response of the Explosive Canine and Handler to
scenes within the jurisdiction, or regional response upon request. The vehicle used for transport
of the explosive canine would provide a K-9 Insert for both comfort and protection of the canine.
Communication equipment including 800 MHz radios, MDC's and MVR's would be installed on
all three vehicles. Body Armor will also be provided for the Fire and Explosion Investigators,
the Canine Handler, and the Explosive Canine for safety and protection.
II. A. Describe how the Investment will address one or more of the National Port Security
Priorities.
Reports from the public citizenry regarding suspicious or dangerous items found in residential
neighborhoods, and threats received by public institutions, businesses, or industrial facilities
require response and investigation to determine the threat level to the public or specific facility.
Often, these threats require the operation of the Explosive Canine unit to validate the threat. A
large number of industrial facilities and ports exist in the region and growth of these facilities is
increasing. With the large increase in vessel traffic due the construction of (3) LNG facilities and
large expansion projects of waterside petrochemical facilities, the Port Arthur Police and Fire
Departments will be tasked with the responsibility of assisting the USCG and other federal, state,
county and local law enforcement agencies in prevention and detection of all terrorist motivated
activities.
II.B. Describe how the investment will support priorities outlined in the applicable Area
Maritime Security Plan (mandated under the MTSA).
Section 5000 "Preparedness for Response" of the Sabine-Neches Area Maritime Security Plan
clearly delineates the response of the Fire Department to control and mitigate an incident and
assist in any investigation of that incident.
II.C. Describe how the Investment supports any COTP Port-specific security priorities.
The Federal Maritime Security Coordinator (FMSC) has designated that during any initial
response activation to a Transportation Security Incident (TSI), the resources required will be

provided by the Port Arthur Police and Fire Departments as outlined in the Area Maritime
Security Plan, Section 5220: Incident Command Activation.
II.D. Describe how this Investment will support one or more of the Priorities of the
National Preparedness Goal.
During any response to a TSI within the Sabine Neches River region, an explosive canine and
investigation unit will provide assistance to the Port Arthur Police and Fire Departments which is
tasked with the responsibility of assisting the USCG and other federal, state, county and local
law enforcement agencies in prevention, detection, and investigation of all terrorist motivated
activities for the Ports and waterside petrochemical facilities.
This region, through the Southeast Texas Regional Response Plan, and as identified through the
PortSTEP Exercise After Action Report, train and exercise as a whole, not as individual cities or
jurisdictions. City and county officials within the region are obtaining ICS certification in a
timely manner.
This Investment complies with the following National Directives and Strategies:

III. A. Describe how the project offers the highest risk reduction potential at the least cost.
MSRAM identifies several of the Highest Risk scenarios within the jurisdictional boundaries of
the Port Arthur Police and Fire Departments. Additionally, expansion projects which include:
• Motiva - 2008- 600,000 BCD (barrels per calendar day)
• Valero (formally Premcor) 2009- 450,000 BCD
• TOTAL Refinery - 2009- $900 million investment -Coker Plant
• Exxon Mobil-Golden Pass LNG Facility (currently under construction, FERC
and USCG approved)
• Sempra LNG Facility (FERC and USCG approved)
• Cheniere LNG Facility (under construction, FERC and USCG approved)

The (3) listed LNG Facilities represent 47% of all LNG imports in Texas, and 35% of all LNG
imports in the United States. Data reports from the Department of Energy (DOE) indicate that
the COTP Port Arthur AOR currently represents 19.5 % of the nation's refined crude oil, which
will increase with the described expansion projects. The aforementioned expansion projects will
also increase vessel traffic within the Sabine Neches Intercoastal Waterway by 80% by the year
2010. As these expansion projects come on line operationally, this investment becomes more
critical in reducing risk in the region by providing immediate communications to the Regional
Incident Command (RIC) on changing conditions, to ascertain possible evacuations or shelter-in-
placeprocedures for citizens by use of the FIRSTCALL Notification System.
III.B. Describe what the potential homeland security risks of not funding this Investment
are.
The Federal Maritime Security Coordinator (FMSC) has designated that during any initial
response activation to a Transportation Security Incident (TSI), the resources required will be
provided by the Port Arthur Police and Fire Departments as outlined in the Area Maritime
Security Plan, Section 5220: Incident Command Activation.
The Port Arthur Fire Department's current response capabilities are significantly hampered due
to the worn condition of our current vehicles. Without the necessary vehicles and equipment, our
ability to efficiently respond, coordinate, communicate and investigate any type of terrorist
activity across jurisdictional boundaries in a timely manner is limited.
In the event this Investment is not funded, and a catastrophic event was to occur, the impact, both
economic and psychological could have nationwide consequences. As previously stated, the
Sabine Neches region produces 1/5 of the nations refined crude oil products and with LNG
expansions on the horizon, this region will produce over 1/3 of the nations LNG.

This Investment will enhance Maritime Domain Awareness by providing the Regional Incident
Commander and the Unified Command with on site and timely Situation Reports (SITREPS) of
current conditions in any Transportation Security Incident. This project provides information to
the Incident Commander as outlined in the National Response Plan by providing the mechanism
to maximize the integration of incident-related prevention, preparedness, response and recovery.
No additional funding (non-FY07 PSGP) will be leveraged for this Investment.
IV.B. Identify up to five (5) potential challenges to the effective implementation of this
Investment.
1. Unforeseen local budget constraints.
2. Timeline constraints from actual order and manufacture of vehicles and equipment
conflicts with timeline parameters in grant guidelines.
As with previous cash-match Federal grant awards, the City of Port Arthur's economic base
should support the cash-match for this Investment. The chief elected officials and City Manager
have a track record of complete support for Federal grants requiring acash-match.
Time line constraints will be addressed by working closely with the manufacturer to set realistic
specifications that can be completed in a timely manner.
IV.C. Describe the management team, including roles and responsibilities, that will be
accountable for the oversight and implementation of this Investment, and the overall
management approach they will apply for the implementation of this investment.
The Management Team will consist of following personnel:
1. Fire Chief, Deputy Chief, Fire Marshal and Battalion Chiefs
2. Support Services Personnel (Telecommunication Officers)
3. Emergency Management Personnel
The Fire Department Office of Administration, with the assistance of the city Finance
Department will oversee the budget execution and grant administration functions. The
responsibilities of implementation and oversight of the Investment will be handled by the Police
and Fire Department (which include a police SWAT team, an explosive canine unit, fire and
explosion investigation unit, and a fire hazardous material team). Through the Office of
Emergency Management, the Police and Fire Departments routinely train, respond and mitigate
potential man-made and natural incidents. The aforementioned Support Services Personnel are
specifically trained to dispatch Police and Fire calls for service that include emergency calls and
disaster response and recovery operations.

IV.D. Discuss funding resources beyond FY07 PSGP that have been identified and will be
leveraged to support the implementation and sustainment of this investment.
Should the application be approved, no other funding sources will be necessary to adequately
sustain the implementation and operation of the investment. As previously indicated, the City of
Port Arthur can meet the required cash-match. The Police and Fire Department budgets
collectively are 22 million dollars. Of that amount, $260,500 is budgeted for annual vehicle
maintenance.
IV.E. Provide ahigh-level timeline, milestones and dates, for the implementation of this
Investment. Possible areas for inclusion are: stakeholder engagement, planning, major
acquisitions or purchases, training, exercises, and process/policy update
Timeline:
• Upon grant award, receive City Council approval for acceptance
• Contact designer/manufacturer to approve final specifications of vehicles and
equipment
• Solicit manufacturer bids per city ordinance/guidelines
• Prepare Council Action Memorandum for Purchase of Mobile Command Center
and request Council approval
• Issue Purchase Order for vehicles and equipment
• Take delivery of vehicles and equipment
• Train Personnel on vehicles and equipment operations
• Place vehicles and equipment in service
Notwithstanding any unforeseen delays, the above-referenced timeline should be completed
within (18) months from grant award notification.
IV.F. Describe the planned duration for this overall Investment. Discuss your long-term
sustainability plans for the investment after your FY07 PSGP funds have been expended, if
applicable.
The planned duration (lifespan under normal operating conditions) for this Investment is
expected to be approximately (10 - 12) years. This investment and maintenance thereof will be
budgeted with Police and Fire Department vehicle maintenance funds.
IV.G. Describe the technical implementation plan for this investment. Discuss the
innovativeness of the solution proposed.
During any response to a TSI within the Sabine Neches River region, this project will provide
vehicles and equipment for the explosive canine and handler, and fire and explosion investigators
to effectively respond with up to date equipment enhancing capabilities during the response. This
region, through the Southeast Texas Regional Response Plan, and as identified through the
PortSTEP Exercise After Action Report, train and exercise as a whole, not as individual cities or
