City of I _ 4 4l 40 rat, Teras www.PortArthurTx.gov INTEROFFICE MEMORANDUM Date: August 22, 2019 To: The Honorable Mayor and City Council Through: Ron Burton, Interim City Manager From: Alberto Elefano, P.E., Public Works Director RE: P.R. 21029—Authorizing the City Manager to negotiate a contract with Freese and Nichols to Engineer and Design a Plan to Improve the Central Business District of Port Arthur, TX Introduction: The intent of this Agenda is for the City Council to authorize the City Manager to negotiate a contract with Freese and Nichols to Engineer and Design a Plan to improve the Central Business District of Port Arthur, Texas. Funding will be available at a later date. Background: The City of Port Arthur in an effort to revitalize Downtown Port Arthur hired a firm to do a study on how to make it a reality in 2015. A Developer, Aurora Capital Holdings, LLC (Aurora) is utilizing land in Downtown Port Arthur and this has sparked the first project that is needed to accomplish the Revitalization of Downtown Port Arthur. Port Arthur needs to improve the infrastructure (streets, drainage and water utilities) to support Aurora and the future businesses in Downtown. Aurora has made a proposal to the Tax Increment Reinvestment Zone (TIRZ) Board to assist financially with the downtown infrastructure project. These improvements will have to be completed by the time Aurora finishes construction in July 2021. The City advertised for Requests for Qualifications to engineer and design a plan to improve the Central Business District of Port Arthur and received five (5) responses from Engineering Firms. Freese and Nichols from their qualifications proved most responsive from their project approach and timeline. They will have enough staff and expertise in their organization to complete the design "Remember,we are here to serve the Citizens of Port Arthur” 444 4th Street X Port Arthur,Texas 77641-1089 X 409.983.8182 X FAX 409.983.8294 of the plans in 6 months as their timeline suggests. Once the City has the complete design and advertised for bids are submitted,the City can then manage the construction of Downtown. Budget Impact: Funding will be available through a reimbursement/developer agreement between the developer and the TIRZ Board. Recommendation: Approval of P. R. No. 21029 authorizing the City Manager to negotiate a contract with Freese and Nichols from Houston,Texas to Engineer and Design a Plan to improve the Central Business District of Port Arthur, Texas. A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT WITH FREESE AND NICHOLS OF HOUSTON, TEXAS TO ENGINEER AND DESIGN A PLAN TO IMPROVE THE CENTRAL BUSINESS DISTRICT OF PORT ARTHUR, TEXAS. WHEREAS, the City of Port Arthur in an effort to revitalize Downtown Port Arthur hired a firm to do a study on how to make needed improvements a reality in 2015 ; and, WHEREAS, a Developer, Aurora Capital Holdings, LLC (Aurora) , is utilizing land in Downtown Port Arthur and has sparked the first project that is needed to accomplish the revitalization downtown Port Arthur; and, WHEREAS, Aurora has made a proposal to the Tax Increment Reinvestment Zone (TIRZ) Board to assist financially with the downtown infrastructure project; and, WHEREAS, Port Arthur needs to improve the infrastructure to support Aurora and the future businesses in Downtown and these improvements will need to be completed by the time Aurora finishes construction in July 2021; and, WHEREAS, the City advertised for Requests for Qualifications (RFQ) to engineer and design a plan to improve the Central Business District of Port Arthur, Texas on July 19, 2019 and July 26, 2019 ; and, WHEREAS, the City received responses from five (5) Engineering Firms; and, WHEREAS, the City staff has reviewed such proposals and have scored each using the published Evaluation Criteria plus a five percent preference for local firms, as delineated in Exhibit "A" ; and, WHEREAS, the City staff finds that Freese and Nichols of Houston, Texas has the highest rating in their evaluation scores, as delineated in Exhibit "A" , and recommends Freese and Nichols to perform the engineering and design of Downtown Port Arthur; and, WHEREAS, the City Council of the City of Port Arthur finds it to be in the interest of the citizens of Port Arthur to negotiate a contract to engineer and design a plan to improve the Central Business District of Port Arthur, Texas . NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct . Section 2 . That the City Manager is hereby authorized to negotiate a contract with Freese and Nichols on behalf of the City of Port Arthur to engineer and design a plan to improve the Central Business District of Port Arthur, which is subject to final approval by the City Council . Funding will be available through a reimbursement/developer agreement between the developer and the TIRZ Board. Section 3 . That a copy of the Resolution shall be spread upon the Minutes of the City Council .
