RE: P.R. No. 21168 —Appointing a member to the Planning and Zoning
Commission
Introduction:
Attached is P.R. No. 21168 appointing a member to the Planning and Zoning
Commission, pursuant to Article XI, Section I, of the Charter of the City of Port Arthur,
for a five (5) year term to expire on October 30, 2024.
Background:
In accordance with Article XI, Section I, the City Planning and Zoning Commission
shall be composed of five (5) members and appointed for a term of one, two, three,
four and five years, respectively, and annually thereafter one member shall be
appointed for the term of five (5) years. Members of the City Planning and Zoning
Commission shall be appointed by a majority vote of the members of the City Council
and may be removed for cause at any time.
Previously, this position was held by Fernando Ramirez. Mr. Ramirez was first
appointed to the Planning & Zoning Commission October 3, 1989 by Resolution No.
89-204. He diligently served on the Commission for thirty (30) years without
disruption.
Earnest James Stevenson, Jr. was appointed by Resolution No. 19-488, to fill the
vacancy created by the term expiration of Fernando Ramirez; however, does not
meet the resident requirement as established in Article XVI, Section 14 of the City
Charter, which states, all appointees of Boards and Committees, where possible,
shall become residents of the City of Port Arthur and shall remain so, as long as
such appointment is held. Mr. Stevenson currently resides in Groves, Texas.
Budget Impact:
None
Recommendation:
It is recommended that City Council approve P.R. No. 21168 appointing a member to
the Planning and Zoning Commission, pursuant to Article XI, Section I, of the Charter
of the City of Port Arthur, for a five (5) year term to expire on October 30, 2024.

RESOLUTION NO.
A RESOLUTION APPOINTING A MEMBER TO THE
PLANNING AND ZONING COMMISSION
WHEREAS, the term of Planning and Zoning Commissioner Fernando Ramirez
expired on October 31, 2019, as delineated in Exhibit "B"; and,
WHEREAS, in accordance with Part I, Article XI, Section I of the City Charter, the
members of the City Planning and Zoning Commission shall be appointed by a majority
vote of the members of the City Council and may be removed for cause at any time;
and,
WHEREAS, Earnest James Stevenson, Jr. was appointed by Resolution No. 19-
488, to fill the vacancy created by the term expiration of Fernando Ramirez; however,
Mr. Stevenson does not meet the residency requirement as delineated in Exhibit "A";
thus, his appointment must be terminated and a new member should be appointed to fill
the vacancy created by this action; and,
WHEREAS, pursuant to Section 1 of Article XI of the Charter of the City of Port
Arthur, it is necessary to appoint or reappoint a person to serve the term set to begin on
November 18, 2019; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1: That the facts and opinions in the preamble are true and correct.
Section 2: That the appointment of Earnest James Stevenson, Jr. is hereby
terminated.
Section 3: That is hereby appointed to serve as
a member of the Planning and Zoning Commission to fill the vacancy created by the
termination of the appointment of Earnest James Stevenson, Jr. and shall serve for a
five (5) year term, expiring October 30, 2024, as delineated in Exhibit "C".

Section 4: That the appointee shall immediately contact the City Secretary's
Office and be sworn in.
Section 5: That this Resolution shall be effective immediately.
Section 6: That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.
READ, ADOPTED AND APPROVED this day of November, A.D., 2019, at
a Regular Meeting of the City Council of the City of Port Arthur, Texas by the following

ARTICLE XVI. - GENERAL PROVISIONS
Section 14. - Resident Requirement.
All employees appointed by the City Council of the City of Port Arthur (the City
Manager, City Attorney, City Secretary, and Municipal Court Judge) shall become
residents of Port Arthur and shall remain so, as long as such appointment is held. All
appointees of Boards and Committees, where possible, shall become residents
of the City of Port Arthur and shall remain so, as long as such appointment is
held.
