Some items are related to Hurricane Harvey, and some are not. Included in the repairs is a need for Asbestos Abatement, Mold Remediation and Lead paint removal. Items related to Harvey will be paid from insurance and some requested as reimbursement from FEMA. Other repairs, including this abatement, will be paid from the Hotel Occupancy Tax account. Inland Environments Ltd of Kingwood, Texas will perform the abatement for a cost of$31,750.00. Funds available in hotel tax account 140-1405-551.59-00. ANALYSIS/CONSIDERATION: There are a lot of needed repairs at the building. Included in the repairs is a need for Asbestos Abatement, Mold Remediation and Lead paint removal. The abatement is the first step in the process to repair and renovate the Department Club. Three quotes were received: • Inland Environments,Ltd $31,750.00 • Sitek Omni $34,800.00 • AAR Inc $44,645.00 RECOMMENDATION A resolution authorizing the City Manager to enter into an agreement with Inland Environments, Ltd of Kingwood,Texas for asbestos abatement, mold remediation and lead paint removal from the Department Club in the amount of$31,750.00. WHEREAS,the Department Club needs repairs; and WHEREAS, included in the repairs is a need for asbestos abatement, mold remediation and lead paint removal; and WHEREAS, Total Safety performed an asbestos and lead-based paint survey and obtained quotes; and WHEREAS, three quotes were received with Inland Environments Ltd. of Kingwood, Texas being the lowest and most responsive to perform the asbestos abatement, mold remediation and lead paint removal (see bid tabulation attached hereto as Exhibit"A"); and WHEREAS, Inland Environments Ltd. will do this work for$31,750.00. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to enter into a contract with Inland Environments Ltd. of Kingwood, Texas for asbestos abatement, mold remediation and lead paint removal at the Department Club, in substantially the same form as attached hereto as Exhibit"B". Section 3. That, the funding for said agreement in the amount of $31,750.00 is available in Hotel Tax Account 140-1405-551.59-00, Project No. M97910. Section 4. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The term of this Contract shall be 45 days from start date on Notice to Proceed. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle with ten(10) days written notice. 2. The Contractor will perform work as stated in the Contract Documents. 3. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies,tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 4 The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the sum of $ 31,750.00. 5. SCOPE OF WORK: $31,750.00 Inland will provide proper removal and disposal of asbestos containing drywall material that was discussed in the walk through. Mold remediation will be according to the mold assessment dated September 29,2019. Loose flaking lead paint will be removed on the exterior of the building and a few small areas with loose flaking lead paint on the interior of the building will be removed. We provide Asbestos Specific Liability Insurance with $2,000,000 aggregate and $1,000,000 occurrence. Provide only personnel licensed to perform asbestos abatement and trained in accordance with the E.P.A. Model Accreditation Plan as either an asbestos supervisor "competent person" or an asbestos worker. Provide O.S.H.A.monitoring as required. Air monitoring will be per NIOSH Method 7400 and performed by an O.S.H.A. certified person who is license by the state. Lab analysis will be by an N.V.L.A.P. and N.I.S.T.accredited laboratory. All work was performed in accordance with the scope of environmental consulting services outlined in our proposal. Our services included the investigation for possible suspect asbestos-containing materials(ACM)and, if applicable, subsequent collection of bulk material samples and the corresponding evaluation of the material(s). Suspect ACM were discovered and samples were collected to establish if asbestos is present in the materials. If the laboratory analysis indicated asbestos amounts greater than 1%, a physical assessment and response action are listed. FIELD FINDINGS Ms. Fran Crochet conducted the asbestos survey on September 24, 2019. Ms. Crochet is licensed as an Asbestos Inspector(DSHS license nos. 60-3246) and her license is included in Appendix C. Samples were carefully placed in asbestos sample bags. The bags were then wiped, sealed and labeled for transport to the licensed laboratory for analysis. A chain of custody accompanied the samples to the laboratory. A total of eighteen bulk asbestos samples(36 layers)were collected from six homogeneous materials. One of the six materials sampled contained greater than 1% asbestos. In accordance with the Environmental Protection Agency(EPA), materials containing greater than 1% asbestos by weight are considered asbestos-containing materials. The homogeneous materials were then assessed in terms of friability, condition and, if applicable, quantity. The term friable means any material that, when dry, can be reduced to powder using only hand pressure. (EMSL) for analysis. The samples were analyzed by polarized light microscopy (PLM) in compliance with guidelines established by the USEPA(50 CFR Part 763.115). EMSL is a successful participant in the National Institute of Standards and Technology's National Voluntary Laboratory Accreditation Program (NVLAP). EMSL's NVLAP license number is 102106. EMSL's Department of State Health Services license number is 30-0159. ASBESTOS SAMPLE RESULTS The results of the laboratory analyses are presented in Appendix B. Samples from the following material indicate the presence of asbestos in amounts greater than 1%. Condition assessments are also included for each material. During this survey of the vacant building located at 1924 Lakeshore Drive in Port Arthur, Texas, the following material was identified as containing asbestos: • Sheetrock/Joint Compound with Smooth Texture contained 3% chrysotile asbestos. Bulk samples of this material were collected in the large open room. This material is non-friable, in good condition and may be located in other areas of the building. NOTE: Please note that all material(s) that resemble the above listed asbestos containing material(s) shall be considered to contain asbestos. RECOMMENDATIONS Contact Total Safety for further federal and state regulatory required action regarding the above listed asbestos containing material(s). Total Safety's recommendations include interim controls and abatement alternatives. We have formulated these recommendations from our assessment of the risk associated with the materials found to contain asbestos. Once a hazard has been identified and prior to its abatement, it is necessary to institute interim controls. These interim controls should include an Operations & Maintenance (O&M) Program which includes good housekeeping and maintenance programs; training of building managers and maintenance personnel; updating building records to indicate the presence of asbestos-containing materials, marking of materials which could present a hazard; and periodic surveillance to identify changes in conditions, if any. Based on the conditions observed and identified at the Department Club building located at 1924 Lakeshore Drive in Port Arthur, Texas, Total Safety offers the following recommendations for addressing the identified asbestos: Total Safety recommends that all of the materials or components identified as containing asbestos in good condition be placed in an O&M program until they are removed. This program should include interim control measures for those materials posing a high hazard, and will act as a passive abatement alternative for those materials posing a low to moderate hazard. The O&M Program should include appropriate measures to reduce the potential for disturbance, as well as enclosure and encapsulation to increase the effectiveness of the program. 2 1924 Lakeshore Drive Port Arthur, TX Asbestos Survey Report September 2019 In addition, the asbestos containing materials must not be disturbed. In the event renovation and demolition activities will potentially disturb the ACM, or in the event damaged asbestos containing material is present, Federal and State law requires that proper abatement activities be conducted. A licensed consultant must be notified. The removal and disposal of any asbestos-containing material is regulated by the Environmental Protection Agency(EPA);the National Emission Standard for Hazardous Air Pollutants(NESHAP),and the Department of State Health Services,Asbestos Health Protection Rules. All removal activities must be designed by a licensed and certified consultant and performed by a licensed abatement contractor utilizing proper engineering controls. Third-party air monitoring must be conducted by a State of Texas- licensed asbestos consulting agency during the abatement/demolition activities. The Department of State Health Services requires a 10-day notification be submitted prior to abatement/demolition activities. This document shall not be used for abatement bid purposes. CLOSING The asbestos survey indicated that asbestos above the regulatory standard is present in the sheetrock/joint compound with smooth texture material at the Department Club building located at 1924 Lakeshore Drive in Port Arthur, Texas. All work was performed in accordance with the scope of environmental consulting services outlined in our proposal. Our services included the investigation for possible suspect lead-based paint (LBP), subsequent collection of bulk paint samples and the corresponding evaluation of the material(s). Suspect areas were discovered and samples were collected to establish if lead above the regulatory standard is present in the paint. The laboratory analyses indicated lead amounts greater than 0.5% by weight. FIELD FINDINGS Total Safety conducted the lead paint survey on September 24, 2019. Twelve lead-based paint samples were collected. All layers of paint down to the substrate materials were sampled during this survey. By Housing and Urban Development (HUD) guidelines, five of the twelve paint samples contained lead in an amount to be considered lead-based paint (0.5% by weight). A complete summary of the lead-based paint samples is included in Appendix A of this report. EMSL's accreditation includes AIHA Environmental Lead Laboratory Approval Program #157245. EMSL's internal quality assurance/quality control (QA/QC) program includes the re-analysis of at least 10% of all bulk samples analyzed.
