SUBJECT: Council Action Memorandum on Proposed-Resolution No. 14510
Appointing a Negotiating Team to ConductCollective Bargaining
With the Port Arthur Police Association; Inc. .
COMMENT
Recommendation: - '
I recommend that the City Council adopt Proposed. Resolution No. 14510, which appoints
a negotiating .team to conduct collective bargaining with the Port Arthur Police
Association representatives.
Background:
Written notice was received on December 28, 2007 from the -Port Arthur Policeā¢
Association of their intent to engage in collective bargaining. Currently, we are operating
under athree (3) year contract covering the period October 1, 2005 through September
30, 2008, which authorizes a three and one-half percent (3%%) pay increase in each of
the three years.
Staff has had several discussions with association representatives within the last year
regarding what the Union perceived as unfair pay practice, stemming from how non-civil
service employees were .paid during Hurricane Rita as compared to civil service
employees. -
All non-exempt-non-civil service employees who did not. work received their regular
pay for the thirteen (13) days. All non-exempt-non-civil'service employees who worked
were paid for all the time worked in addition to receiving-pay for the thirteen (13) days
that other employees who did"not work received.
Civil service employees received their regular pay in addition to any overtime-pay earned
for all hours worked. No additional pay consideration was given. This is the basis of their
complaint.
We are recommending ±opening negotiations early in attempt to resolve their complaint
through the collective bazgaining process. '
Budaetarv/Fiscal Effect: None.
Employee/Staff Impact: No.
Summary'
I recommend that the City Council adopt Proposed Resolution No. 14510, which appoints
a negotiating team to conduct collective bargaining with representatives of the Port
Arthur Police Association.

A RESOLUTION APPOINTING A NEGOTIATING TEAM
UNDER CHAPTER 174 OF THE TEXAS LOCAL
GOVERNMENT CODE ANNOTATED, TO CONDUCT
COLLECTIVE BARGAINING- WITH THE BARGAINING
AGENT OF THE PORT ARTHUR POLICE ASSOCIATION
OF THE CITY OF ,PORT ARTHUR POLICE
DEPARTMENT
WHEREAS, the City Manager has received a letter from the Port Arthur Police
Association to engage in collective bargaining, as denoted in Exhibit "A",
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR: ,
THAT, pursuant to Chapter 174 of the Texas Local Government Code Annotated, the
following persons are hereby designated to conduct collective bargaining on behalf of the City
with representatives of the Port Arthur Police Association, the bargaining- agent of the Police
Officers of the City of Port Arthur Police Depaztment: City Manager, Director of Human
Resources, Assistant Director of Human Resources, Director of Finance and City Attorney; and,
THAT, the City Manager is hereby authorized to designate a chief spokesperson; and,
THAT, the City Manager is also hereby authorized to provide a suitable place for the
collective bazgaining sessions, and to provide such supporting City personnel as needed by the
City negotiating team,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
