AN ORDINANCE TRANSFERRING LOTS 20 & 21,
BLOCK 1, SCHMYSER 3 TO CITY OF PORT
ARTHIIR SECTION 4A ECONOMIC DEVELOPMENT
CORPORATION
WHEREAS, per a motion made by the City Council at -the
May 8, 2007 Council Meeting, the .City Attorney, City
Manager, and the Tax Attorney were authorized to take such
action as to seize the remaining property of Block 1,
Schmyser 3 for unpaid property taxes; and
WHEREAS, on November 6, 2007, the City purchased Lots
20 & 21, Block i, Schmyser at a Sheriff's Sale for $1,440,
as delineated in Exhibit "A", attached hereto; and
WHEREAS, the City of Port Arthur Section 4A Economic
Development Corporation has provided the City a check for
$1,440; and,
WHEREAS, the City desires to deed the property to the
City of Port Arthur Section 4A Economic Development
Corporation; and _ - .
WHEREAS, this property will be a part of the City of
- Port Arthur Section 4A Economic Development Corporation
.Industrial Development Park that was' designated by
.Resolution No. 04-417.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COIINCIli OF

THE CITY OF PORT ARTHiTR:
Section 1. That the facts. and opinions in the
preamble are true and correct. .
Section 2. That the City Manager and the City
Attorney are herein authorized to deed the .property,
legally described as Lots 1 & 2, Block 1, Schmyser 3, to
the ,City of Port- Arthur Section 4A Economic Development
Corporation Industrial Business Park, in substantially the
same form as attached hereto as Exhibit "B".
Section 3. That a copy of the caption of this
Ordinance be spread; upon the Minutes of the City Council.
READ, ADOPTED, AND APPROVED this day of

KNOW ALL MEN BY THESE PRESENTS THAT, WHEREAS, by virtue of a certain Tax
Warrant issued out of the 136TH District Court in and for Jefferson County, Styled MffZIAM K.
JOHNSON TAX ASSESSOR/COLLECTOR FOR CITY OF PORT ARTHUR, ET AL vs. ROBERT
ASBERRY, Case number D-0179944. On a Tax Warrant Executed on September 10, 2007, I, G.
Mitch Woods, Sheriff of said County, did upon November 6, 2007, levy upon and advertise the time
and place of said sale by an advertisement in the English language, published once a week for three
consecutive weeks preceding such sale, the first publication appearing not less than twenty days
immediately preceding the day of sale, October 16, 2007, in the Beaumont Enterprise, a newspaper
published in the County of Jefferson, stating in said advertisement the time and place of sale, a brief
description of the property to be sold; the original survey, its locality in the County, and the name by
which the land is generally known, and by delivering a similar notice to each of the defendants, and
on the first Tuesday in November, 2007, within the hours prescribed by law, sold said hereinafter
described land or lots at the premises hereinafter described were bid off to
City of Port Arthur, for the sum of $1.444.00, for the use and benefit of City of Port Arthur, et al
and possibly other entities for title to the hereinafter described property or the amount of taxes,
interest, penalties and costs.
NOW, THEREFORE, I, G. Mitch Woods; Sheriff aforesaid, by virtue ofthe authority vested
in me bylaw have BARGAINED, SOLD and CONVEYED, and by these presents do benefit the
City ofPort Arthur and their assigns, subject, however, to the provisions hereinafter set out, all the
right, title and interest of the defendants, in and to the following described land that said defendants
had in and to said land at the date said suit was filed, together with, all and singular, the rights,
privileges, and appurtenances to the same belonging, and the said lands being described as follows,
to-wit:
LOT- TWENTY (20) & TWENTY-ONE (21) BLOCK ONE (1) SCHMYSER
THREE (3) ADDITION LOCATED IN THE CITY OF PORT ARTHUR AS PER
MAP OR PLAT IN JEFFERSON COUNTY, TEXAS
TO HAVE AND TO HOLD unto the said City of Port Arthur, for the use and benefit of C
of Port Arthur, et al and possible entities subject, however, to the right of defendants to redeem the
same in the manner prescribed by law within rivo years on residential homestead and agricultural use
property and within six months on all other properties from the date of the filing for records of this
deed, and to such other further conditions and stipulations as may be applicable under the provisions
of Section 34.21 of the Property Tax Code ofTexas, as fully and absolute as I, sheriffaforesaid, can
convey by virtue of said Tax Warrant.
