Notice is hereby given in accordance with the revised Civil Statutes and the
Zoning Ordinance of the City of Port Arthur that the City Council of the City of
Port Arthur will .hold a Public Hearing on Tuesday, January 15, 2008, at 7:00
p.m. in the Port Arthur City Hall Council Chamber, 444 4th Street, to consider

The applicant is requesting the property West of Hwy. 366 and North of Hwy. 87/73 be
rezoned from Single Family and Light Commercial to Heavy Commercial.
BACKGROUND:
TOTAL is requesting that this property be rezoned to Heavy Commercial to permit the
property to be used for a laydown yard and equipment storage. They also state that some
assembly will be done on the property. I have attached a copy of my recommendation to
the Planning and Zoning Commission.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission met on Monday, November 19, 2007 and
recommended the request for rezoning the property to Heavy Commercial be denied.
They felt that the proposed use was inappropriate for the azea adjacent to the school and
Highland Heights.
PUBLIC COMMENT:
40 property owners were notified of the proposed zoning change.

Section 1. Use Regulations
A. All uses in the "SF°', Single Family District by right
B. Specifically permit alay-down yard and equipment storage subject to the
following Special Development Standards
Section 2. Development Standards
A. General Development Standazds
1. The coverage, off-street pazking, height and yazds shall comply with the
standazds established for the "SF", Single Family District for all residential
uses unless authorized or specified herein or on'a site development plan
approved by the Planning and Zoning Commission
2. The coverage, off-street pazking, height and yards shall comply with the
standazds established for the "LC", Light Commercial District unless
authorized on a site development plan approved by the Planning and Zoning
Comnssion, subject to the Special Development Standards.
B. Special Development Standards
1.. That use of the property as alay-down Yazd shall not exceed three (3) yeazs
-from the date of commencement of that use but in no case shall that use be
permitted to continue operation past five (5) years from the date of this
Ordinance. Existing activities shall not expand and shall not be pemutted to
continue past five (5).yeazs from the date of this Ordinance.
2. That assembly activities may be conducted within-the lay-down yard only
within 350 feet of Hwy 366.
3. All access to the lay-down yard shall be from Hwy 366.
4. That an earthen berm, a minimum of eight (8) feet in height(above natural
ground), shall be constructed along the common boundary of this Planned
Development and the Highland Heights Subdivision, the David Cavazos
property and Taft Elementary School at a distance not less than 100 feet-from
the property line: This berm shall have a minimum side-slope of 5:1. All
slopes shall be seeded to prevent erosion.
5. A solid screening fence, a minimum of eight (8) feet in height shall be placed
on top of the berm, with a vegetative screen of pampas grass or similaz plant
material every 10 feet or less.
6. All security and other lighting shall be duected so as to not shine into
.residential azeas. .
,7. No work shall be conducted except during daylight hours.
8. ~ No hazardous materials shall be stored on site.

The applicant proposes to construct a 160 foot monopole tower at this location. The
proposed tower meets all of the setback requirements from residential zoning districts.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission met on Monday, February 4, 2008 and. considered
this request. They recommended that this request be approved.
