RE: P.R.21255: 8th Avenue Improvement Project from 32nd Street to the Deadend-Change Order No.
1 for the modification of existing paving and drainage that increases original contract amount by
$23,092.00; Project No.: ST1P11.
Introduction:
The intent of this Agenda Item is to authorize the City Manager to execute Change Order No. 1 which increases the
original contract amount by$23,092.00 to the new contract amount of$904,485.50 for the 8th Avenue Improvement
Project from 32nd Street to the Deadend for the modification of existing paving and drainage.
Background:
Pursuant to Resolution no. 19-129,Excavation&Construction, LLC of Port Arthur,Texas was awarded the project
for the 8th Avenue Project from 32nd Street to the Deadend. Change Order No. 1 has been submitted that increases
original contract amount of $881,393.50 by $23,092.00 to the new contract amount of $904,485.50 for the
modification of an existing junction box, installation of concrete storm grates and the relocation of meters.
Budget Impact:
Change Order No. I impacts funds in the Capital Improvement Account for the Street Maintenance and Repair,
Account No. 307-1601-591.86-00. Project No. ST1P11.
Recommendation:
It is recommended that the City of Port Arthur City Council approve PR 21255 with Excavation & Construction,
LLC of Port Arthur,Texas authorizing the City Manager to execute Change Order No. 1 increasing original contract
amount of$881,393.50 by$23,092.00 to the new contract amount of$904,485.50 for the modification of an existing
junction box, installation of concrete storm grates and the relocation of meters.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN
THE CITY OF PORT ARTHUR AND EXCAVATION &
CONSTRUCTION, LLC OF PORT ARTHUR, TEXAS FOR THE 8TH
AVENUE IMPROVEMENT PROJECT FROM 32ND STREET TO THE
DEADEND FOR ADDITIONAL PAVING AND DRAINAGE
MODIFICATIONS THAT INCREASE THE CONTRACT AMOUNT
BY $23,092.00 FROM THE ORIGINAL CONTRACT AMOUNT OF
$881,393.50 TO THE NEW CONTRACT AMOUNT OF
$904,485.50. FUNDING IS AVAILABLE IN THE CAPITAL
IMPROVEMENTS STREET ACCOUNT NO. 307-1601-591.86-00.

WHEREAS, pursuant to Resolution No. 19-129, the City of Port Arthur City Council
awarded a contract for the 8th Avenue Improvement Project from 32nd Street to the
Deadend to Excavation & Construction, LLC of Port Arthur, Texas with a projected
budgetary impact of $881,393.50 and a term of 241 calendar days; and,
WHEREAS, proposed Change Order No. 1 is submitted to the contract by
Excavation & Construction, LLC of Port Arthur, Texas for the modification of the existing
junction box, installation of concrete storm grates and the relocation of meters that
increases the contract amount by $23,092.00 from the original contract amount of
$881,393.50 to the new contract amount of $904,485.50; and,
WHEREAS, approval of Change Order No. 1 is herein deemed an appropriate
action; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,

THAT, Change Order No. 1 is herein approved and the City Manager is authorized
to execute said Change Order No. 1 to the contract between the City of Port Arthur and
Excavation & Construction of Port Arthur, Texas; and
THAT, Change Order No. 1, submitted by Excavation & Construction, LLC of Port
Arthur, Texas will increase the contract amount by $23,092.00 from the original contract
amount of $881,393.50 to the new contract amount of $904,485.50; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

Re: 8th Avenue (Res. 18-190) —Change Order No. 1
Water Service—This Change Order Item is for meter relocation to the property line. Existing
meters are currently in the future ditch. Bid Item called for long side and short side service.
In discussions with the water department during plan development it was assumed the City
would relocate meters in right-of-way to near property line. Water Utilities say the
Contractor is responsible for moving meters with their supervision.
Drainage - Bob Hope side of 8th Avenue had grate inlets in the driveways at the ditch. In
design it was decided that replacement of all of them was not necessary due to new road
grades. Upon view a storm event in the field, it is important to add 2 new inlets and adjust
an existing box.
