Langford, Director of Development Services RE: P.O.NO. 6811 —Amendment to the Zoning Ordinance creating Planned Development District No. 39 (PD-39) Introduction: A request is being made on behalf of City Staff to amend the Zoning Ordinance of the City of Port Arthur by creating Planned Development District No. 39 (PD-39) on approximately 8.512-Acres of Land consisting of part of Block 386, and all of Blocks 387, 402, and 403, with adjacent alleys, and rights-of-way, Port Arthur, Jefferson County, Texas. The purpose of this request is to allow for the continued use of municipal/county services, as well as construct a new municipal animal shelter. Background: On September 9,2019,the Planning and Zoning Commission held a public hearing on the application for any amendment or change prior to making its recommendation and report to the city council. When any such amendment or change relates to a change in classification or boundary of a zoning district,written notice of public hearing before the planning and zoning commission on the proposed amendment or change shall be mailed to all owners of real property lying within 200 feet of the property on which the change is requested. Such notice shall be given not less than ten days before the date set for hearing by depositing in the mail such notice, properly addressed and postage paid, to each taxpayer as the ownership appears on the last approved city tax roll. When any such amendment relates to a change of a zoning regulation or to the text of this ordinance not affecting specific property, notice of the public hearing of the planning and zoning commission shall be given by publication in a newspaper of general circulation in the City of Port Arthur without the necessity of notifying property owners by mail. Such notice shall state the time and place of such hearing and the nature of the subject to be considered, which time shall not be earlier than ten days from the date of publication. The Port Arthur City Council held a public hearing regarding the proposed change on December 3, 2020. Budget Consideration: None Recommendation: It is recommended that City Council approve P.O.NO. 6811,amending the Zoning Ordinance of the City of Port Arthur by creating Planned Development District No. 39 (PD-39)on approximately 8.512-Acres of Land consisting of part of Block 386, and all of Blocks 387, 402, and 403, with adjacent alleys, and rights-of-way, Port Arthur, Jefferson County, Texas. AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF PORT ARTHUR BY CREATING PLANNED DEVELOPMENT DISTRICT NO.39 (PD-39) FOR 8.512-ACRES OF LAND CONSISTING OF PART OF BLOCK 386 AND ALL OF BLOCKS 387, 402 AND 403, WITH ADJACENT ALLEYS, AND RIGHTS-OF-WAY, CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS (VIOLATION OF THIS ORDINANCE OR THE ZONING ORDINANCE OF THE CITY OF PORT ARTHUR IS PUNISHABLE AS PROVIDED IN CHAPTER 1, SECTION 1-13 OF THE CODE OF ORDINANCES, AS AMENDED, BY A FINE NOT EXCEEDING TWO THOUSAND [$2,000.00] DOLLARS); AND PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER OF THE CITY OF PORT ARTHUR AND EFFECTIVE IMMEDIATELY AFTER PUBLICATION DATE. 19-05—CITY OF PORT ARTHUR PLANNED DEVELOPMENT DISTRICT NO. 39 (PD-39) WHEREAS,all the requirements of Article XI of the Charter and the Zoning Ordinance,of the City of Port Arthur, Texas, including the Texas Local Government Code, Sections 211.006 and 211.007, having been fulfilled, the City Council held a public hearing December 3, 2019 at 6:00 P.M.; and, WHEREAS,the proposed change has not been protested in accordance with subsection(d) of said Section 211.006; and, WHEREAS, City Council instructed staff to provide additional written notice of the proposed change to property owners of real property lying within 200 feet of the property on which the change is requested. Written notices were mailed on January 28, 2020, as delineated in Exhibit "B"; and WHEREAS,having received and considered the recommendation of the Planning and Zoning Commission that the proposed change be approved, the City Council finds that it would be in the P.O.NO.6811 02/11/2020-PDL PAGE 2 OF 11 public interest and general welfare of the City to change the Zoning designation of the hereinafter described property; and, WHEREAS,pursuant to subsections (d) and (f) of Section 211.006 Texas Local Government Code, Section 24-105 of the City Zoning Ordinance requires, in order for the proposed change to take effect, the affirmative vote of at least three-fourths of all members of the City Council (i.e., at least six [6] members) if the proposed change is protested in accordance with said subsection (d) or the City's Planning and Zoning Commission recommends that the proposed change to a regulation or boundary be denied; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the zoning for the following tract of land be changed from Single Family (SF)to Planned Development District No. 39 (PD-39): 8.512-ACRES OF LAND CONSISTING OF PART OF BLOCK 386 AND ALL OF, BLOCKS 387, 402 AND 403 WITH ADJACENT ALLEYS,AND RIGHTS-OF-WAY PORT ARTHUR,JEFFERSON COUNTY, TEXAS (EXHIBIT "A") SECTION 2. That the Building Official and the Director of Development Services are authorized and directed to make all necessary changes to the "Zoning Map, City of Port Arthur, Texas", on file in the offices of the Building Official and the Planning and Zoning Commission, so as to reflect on said Map, the changes hereby made in conformity with the legend of said Map. SECTION 3. That if any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate,distinct,and independent provision and such holding shall not affect the validity of the remaining portions hereof. P.O.NO.6811 02/11/2020-PDL PAGE 3 OF 11 SECTION 4. That all ordinances and parts of ordinances in conflict herewith are hereby repealed, but only to the extent of such conflict. SECTION 5. That any person, firm or corporation who violates any provision of this Ordinance or the City's Zoning Ordinance shall be guilty of a misdemeanor and shall be punished by a fine not exceeding Two Thousand ($2,000.00) Dollars as provided in Chapter 1, Section 1- 13 of the Code of Ordinances, and each day such violation shall be permitted to exist shall constitute a separate offense. SECTION 6. That this Ordinance or its caption and penalty shall be published at least one (1) time within ten days after formal passage hereof in the official newspaper of the City of Port Arthur. This Ordinance shall take effect immediately after the date of such publication. SECTION 7. That because the proposed change to a regulation has not been protested in accordance with Section 211.006 of the Texas Local Government Code and Section 24-105 of the Zoning Ordinance, a three-fourths (3/4) majority (6 votes) is not required for the adoption of this Ordinance. NO.6811 02/11/2020-PDL PAGE 6 OF 11 PLANNED DEVELOPMENT DISTRICT -39 SECTION 1: AREA That the zoning designation of the following described tract of land be and the same is hereby zoned"PD-39", Planned Development-39 District under the provisions of Section 19: 8.512-Acres of Land consisting of part of block 386 and all of,Blocks 387,402 and 403 with adjacent alleys, and rights-of-way; all of that land north of the centerline of 19t Street to the Kansas City Southern Railroad Tract,between Charleston Avenue and New Orleans Avenue (Lots 1, 2, & 3, Block 387) SECTION 2: PERMITTED USES Use regulations for the "PD-39", Planned Development-39 District permits uses as prescribed in Sections 7 for: 1. All uses permitted in the"SF", Single Family District. 2. All uses permitted in the "HC", Heavy Commercial District with the exception of the following are prohibited: a. Public building, ship or yard of a governmental agency b. Water reservoir, well or pumping station c. Water treatment plant d. Animal pound (public or private) e. Warehousing SECTION 3: DEVELOPMENT STANDARDS 1. The density, coverage, off-street parking, off-street loading, height, and yards shall equal or exceed the standards established for the use in Section 7, unless otherwise authorized herein or on the Comprehensive Site Plan or development plan approved by the Planning and Zoning Commission. 2. Noise standards shall be those established for Commercial Districts for all non-industrial uses. 3. No building, sign, structure or other structural improvement shall be erected nearer than twenty-five (25) feet to the right-of-way of 19th Street. Driveways may be constructed across the land strip created by such setbacks but no portion of any such driveway which may be parallel to or approximately parallel to any street right-of-way line nor any off- street parking area adjacent to right-of-way shall be located nearer than fifteen(15) feet to such right-of-way line;it being the purpose and intent of this provision to create a minimum fifteen (15) foot strip for lawn, planting and general landscaping purposes between any building and the street right-of-way and to permit only the construction of essential driveways and walks crossing such strip.
