No. 21294, amending the contract between the City of Port Arthur and SETMA and changing the name to Steward Medical Group. Introduction: The intent of this Agenda Item is to seek the City Council's approval to amend the contract between the City of Port Arthur and SETMA to reflect the City of Port Arthur and Steward Medical Group. This will allow Dr. William D. George to continue to serve as the Health Authority for the health department and supervising physician of the Employee Health Services clinic. Background: Dr. George became an employee of the Southeast Texas Medical Associates (SETMA) in June 2011 and has been the Health Authority and Supervising Physician for the Health Department since 1995. The contract between the City of Port Arthur and SETMA was approved on September 24, 2019 per Resolution No. 19-410, and now The Southeast Texas Medical Associates (SETMA)has transitioned to The Steward Medical Group. Budget Impact: Compensation was provided to SETMA on behalf of Dr. George for services rendered in the month of October in the amount of$4300.00. SETMA was still in operation but did not sign said contract because of the new transition, therefore approval is needed to ratify payment for the services rendered for the month of October. Funds are budgeted in the FY 2020 city's professional service account. Recommendation: It is recommended that the City Council approve P.R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND SOUTHEAST TEXAS MEDICAL ASSOCIATES (SETMA) TO REFLECT A NAME CHANGE TO STEWARD MEDICAL GROUP FOR THE SERVICES OF WILLIAM D. GEORGE, MD TO CONTINUE TO ACT AS THE CITY'S HEALTH AUTHORITY AND SUPERVISING PHYSICIAN FOR THE EMPLOYEE HEALTH SERVICES CLINIC. FUNDS ARE BUDGETED IN THE FY 2020 GENERAL FUND PROFESSIONAL SERVICE ACCOUNT 001-1301-541.54-00 ($34,100.00); EMPLOYEE HEALTH PROFESSIONAL SERVICE ACCOUNT 001-1303-541.54-00 ($12,000.00), AND FIRE DEPARTMENT ACCOUNT NO. 001-1121- 522.54-00 ($5,500.00) FOR A TOTAL OF $51,600.00. WHEREAS, the FY 2020 contract was approved with SETMA for Dr. William George to continue to serve as the Health Authority for the City of Port Arthur Health Department on September 24, 2019 per Resolution No. 19-410; and, WHEREAS, as of November 2019 SETMA transitioned to Steward Medical Group, and now approval is needed to enter into contract between the City of Port Arthur and Steward Medical Group; and, WHEREAS, approval is needed to ratify payment of $4,300.00 made to SETMA for the work Dr. George performed during the month of October before the name changed and before contract signatures were completed. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR: SECTION 1. That, the facts and preamble are true and correct. P.R. 21294 02/21/2020-js SECTION 2. That, the City Council of the City of Port Arthur hereby authorizes the City Manager and Director of Health to execute said Amended Contract, in substantially the same form as is attached hereto as Exhibit "A." SECTION 3. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Smith, RN, BSN City Manager Director of Health Services P.R. 21294 02/2112020-js EXHIBIT "A" AMENDED CONTRACT FOR INDEPENDENT PROFESSIONAL SERVICES This Amended Agreement is made between the City of Port Arthur, Texas hereinafter referred to as "City" and Steward Medical Group, herein referred to as "Contractor." I. TERM OF CONTRACT This Contract shall be for a period beginning November 2019, and shall remain in force through October 2020. Thereafter, this Agreement shall be renewed annually at the discretion of the parties. II. PROFESSIONAL SERVICES This Contract will allow for Dr. William D. George, an employee of Steward Medical Group, to serve as the City's Health Authority and Supervising Physician of the City's Employee Health Services clinic. As the City's Health Authority, Dr. George shall: 1) Administer state and local laws relating to public health within the City's jurisdiction in accordance with Section 121.021 Texas Health and Safety Code, as amended. 2) Do all things necessary to implement and enforce the law to protect the public health. 3) Perform each duty applicable to the City's jurisdiction as prescribed by the Texas Department of State Health Services (DSHS). 4) Establish, maintain, and enforce quarantine in the City's jurisdiction. 5) Aid the Texas Board of Health and other public health officials in relation to local quarantine, inspection, disease prevention and suppression, birth and death statistics, and general sanitation in the City's jurisdiction. 6) Report as necessary the presence of contagious, infectious and dangerous epidemic diseases to the Texas Board of Health in the manner and at the times prescribed by said board. 7) Perform all acts for the Port Arthur City Health Department which are required by law to be performed by a licensed physician or which if provided by a person other than a licensed physician would constitute the unlicensed or unlawful practice of medicine. 8) Provide consultant services in policy, planning, procedure, administrative and other matters to the Director of the Health Department as requested by said Director. 9) Provide Medical Director advisory services to the City's Fire Department First Responders Program registered with the Department of State Health Services. 10) Meet with the City's Fire Department representatives on a monthly basis to review emergency medical incidents, exposures and debriefings, establish and review medical protocols, review and make recommendations concerning DSHS certifications and continuing education. 11) Provide professional assistance to the City's Fire Department in administrative matters before boards, DSHS, and the City Council on an as needed basis. As the Supervising Physician of the City's Employee Health Services Clinic, Dr. George shall: 1) Function as the supervising physician of the City's Employee Health Services Clinic. 2) Review patient charts as needed and required. 3) Review and approve all protocols and standing delegation orders/guidelines for the effective operation of the Employee Health Services Clinic to include prescriptive authority for the mid-level provider. 4) Provide consultation as needed to the Employee Health Services Clinic mid-level provider and staff. III. COMPENSATION The Contractor shall be paid One Thousand Dollars ($1,000) per month for services provided for the Employee Health Services Clinic in addition to the Three Thousand, three hundred Dollars ($3,300.00) per month for professional services performed as the Health Authority. The hours of work shall be mutually agreed upon by the Director of Health of the City of Port Arthur and the City's Fire Chief. IV. LICENSURE/LIABILITY INSURANCE 1) The Contractor shall provide proof of licensure for Dr. George to practice medicine in the State of Texas. 2) The Contractor shall be covered under the City's liability insurance for services performed as the Health Authority. IV. TERMINATION This Agreement can be terminated with sixty (60) days prior written notice by either party. SIGNED AND AGREED TO on the day of , 2020.
