No. 6837 02/26/20 ht/sv ORDINANCE NO. AN ORDINANCE AUTHORIZING THE CITY MANAGER TO FACILITATE THE TRANSFER OF CITY-OWNED PROPERTIES ACQUIRED THROUGH THE NEIGHBORHOOD STABILIZATION PROGRAM(NSP)AND ASSIST TENDER LOVING CARE CENTER FOR CHILDREN, D/B/A LEGACY CDC IN SELLING NEWLY CONSTRUCTED HOUSES TO QUALIFIED HOMEBUYERS THAT ARE ELIGIBLE TO PARTICIPATE IN THE DOWNTOWN REVITALIZATION AFFORDABLE HOUSING PROGRAM. WHEREAS,the Neighborhood Stabilization Program(NSP),a HUD funded program authorized by the Housing and Economic Recovery Act of 2008 (HERA), provided funds to state, county, and local government entities to purchase foreclosed,vacant or abandoned homes and residential properties,in order to rehabilitate, resell, or redevelop them, stabilize neighborhoods and halt the decline of property values in communities impacted by the housing crisis; and WHEREAS,the City of Port Arthur acquired properties in the downtown vicinity through the NSP, with a purpose of redeveloping foreclosed and vacant properties that might otherwise become sources of abandonment and blight in the downtown targeted area; and WHEREAS, the City, along with the Port Arthur Economic Development Corporation (PAEDC), desires to promote economic development and provide incentives for the new construction of single-family residential structures as described in 42 U.S. Code § 12745; and WHEREAS, pursuant to Resolution No. 19-186 and 19-516, the City executed Ground Leases for NSP lots as delineated in Exhibit "A", with Tender Loving Care Center for Children, d/b/a Legacy CDC, herein referred to as TLCCC dba Legacy CDC, for the development of affordable houses in the downtown targeted area; and WHEREAS, pursuant to Resolution Nos. 19-187 & 19-517, the City also executed Fixed Priced Contracts with TLCCC dba Legacy CDC, for the construction of said houses in the downtown targeted area; and WHEREAS,TLCCC dba Legacy CDC,a CHDO,acting as Project Manager for the new construction and sale of the single-family residential structures have found and notified the City of qualified homebuyers; and WHEREAS, Section 272.001(g) of the Local Government Code provides that a municipality may convey land for the development of low-or moderate-income housing provided that the conveyance serves a public purpose; and WHEREAS,it is in the best interest of the City Council to authorize the City Manager to facilitate the transfer of lots and assist TLCCC dba Legacy CDC in the sale of newly constructed homes to qualified homebuyers in order to promote the public purposes of maintaining high quality,safe and affordable housing in the City's downtown targeted area. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That the City Council herein authorizes the City Manager to facilitate the transfer of city-owned properties acquired through the NSP and assist TLCCC dba Legacy CDC in selling newly constructed houses to qualified homebuyers that are eligible to participate in the downtown revitalization affordable housing program. SECTION 3. That the conveyance shall serve as a public purpose pursuant to Section 272.001(g)of the Texas Local Government Code. SECTION 4.
