RE: P.R. NO. 21322—A resolution calling for a public hearing to consider an abandonment for
a portion of a street right-of-way.
Introduction:
This Agenda Item intends to request a public hearing for a proposed abandonment of approximately 1.845-
acre of land consisting of a portion of a dedicated public right-of-way, known as 53rd Street and being part of
Blocks 8 & 9, Range "G," Port Arthur Land Company Subdivision, Port Arthur, Jefferson County, Texas.
USA Railway Terminals Beaumont, LLC, is making this request, to construct a railyard.
Background:
The Planning & Zoning Commission will hold a public hearing on Monday, March 16, 2020. Public Notice
was published in the Port Arthur Newspaper on March 7, 2020, as well as notices sent to property owners
within a 200 ft. Radius of the proposed sites.
Budget Impact:
None
Recommendation:
It is recommended that City Council approve P.R. No. 21322, calling for a public hearing to consider a
proposed abandonment of approximately 1.845-acre of land consisting of a portion of a dedicated public
right-of-way, known as 53rd Street and being part of Blocks 8 & 9, Range "G," Port Arthur Land Company
Subdivision, Port Arthur, Jefferson County, Texas.
The public hearing shall be held on April 14, 2020, at 6:00 p.m.

A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A
PROPOSED ABANDONMENT FOR APPROXIMATELY 1.845-ACRE OF LAND
CONSISTING OF AN UNIMPROVED PORTION OF THE 53RD STREET RIGHT-OF-
WAY LOCATED IN THE PORT ARTHUR LAND COMPANY SUBDIVISION, CITY
OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS.
A20-02 (CITY OF PORT ARTHUR)
WHEREAS, the Port Arthur Planning and Zoning Commission is recommending that City Council
consider an abandonment for approximately 1.845-acre portion of a dedicated public right-of-way, known as
53rd Street and being part of Blocks 8 & 9, Range "G," Port Arthur Land Company Subdivision, Port Arthur,
Jefferson County, Texas, as delineated in Exhibit"A"; and,
WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to consider the
abandoning, vacating and relinquishing streets, alleys and easements; and,
WHEREAS, the City Council has the authority to vacate, abandon or close a street under Section
311.001 and 311.007 Transportation Code; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
SECTION 1. That the facts and opinions in the preamble are true and correct.
SECTION 2. That the Planning and Zoning Commission will hear this case on March 16, 2020.
SECTION 3. That upon abandoning and vacating the street, the City shall have the right, if it so
desires, to retain utility easements.
SECTION 4. That a public hearing to consider whether to grant the applicant the abandonments as
delineated in Exhibit"A"shall be held on April 14, 2020, at 6:00 p.m. in the City Council Chambers, Fifth Floor,
City Hall, 444 Fourth Street.
SECTION 5. That notice of the public hearing shall be published at least fifteen (15) days before
the date of the hearing in the official newspaper of the City pursuant to 211.006 of the Texas Local Government
Code.

SECTION 6. That a copy of the caption of this Resolution shall be spread upon the Minutes of the
City Council.
