Re: P.R.21313—Authorization to execute a change order with the Construction Managers of
Southeast Texas(CMOST)to construct PAT's new maintenance building and electric
charging infrastructure
Nature of Request: Proposed Resolution No. 21313 requests authorization for the City Manager to
execute change order No. 1 with Construction Managers of Southeast Texas (CMOST) to construct
PAT's new maintenance facility and electric bus charging infrastructure.
Background: Resolution No. 20-042 authorized the City Manager to execute a contract with the
Construction Managers of Southeast Texas(CMOST)to construct PAT's new maintenance facility and
electric bus charging infrastructure, and supply specified tools and shop equipment. In an effort to
consolidate project cost PAT and its engineer (Huitt-Zollars) elected to value engineer (VE)
CMOST's$3,495,000.00 base bid. The VE effort resulted in a$154,199.64 reduction and a new base
bid total of$3,340,800.36.
The$154,199.64 base bid reduction enables PAT to fund Alternates No. 1 and No. 2. Alternate No. 1
consists of constructing an in-ground pit in the new maintenance building. CMOST's bid price for
Alternate No. 1 is $254,794.13 which was value engineered to remove $28,450.43, resulting in a
revised total of$226,343.70. Alternate No. 2 is the purchase and installation of an in-ground at a bid
price of$194,671.57. CMOST was tasked with obtaining additional quotes from qualified vendors
who meet the Buy America and equipment specifications. CMOST obtained a vendor who met these
requirements at a reduction of $30,215.27; therefore the revised total for Alternate No. 2 is
$164,456.30.
The inclusion of Alternate No. 1 and No.2 allows PAT to construct a maintenance facility that is fully
equipped to maintain its fleet of fixed-route and paratransit vehicles. The VE reductions and adding
on Alternate No. 1 and No. 2 result in a new project total of$3,731,600.36 which is an additional
$236,600.36.
Recommendation: It is recommended that the City Council approve proposed P.R. 21313,authorizing
the City Manager to enter into a change order with CMOST to construct PAT's new maintenance
facility and electric bus charging infrastructure in the amount not to exceed$3,731,600.36.
Budgetary/Fiscal Effect: The Federal 5307 and 5339(b)funds for this project are 100%reimbursable
in account 401-1509-561.82-00 with a local match of$58,700 required for the Federal 5339(c)funds.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CHANGE ORDER WITH THE CONSTRUCTION MANAGERS OF SOUTHEAST
TEXAS OF PORT ARTHUR, TEXAS TO CONSTRUCT PORT ARTHUR TRANSIT'S
NEW MAINTENANCE BUILDING AND ELECTRIC CHARGING
INFRASTRUCTURE, IN AN AMOUNT NOT TO EXCEED $3,731,600.36; FUNDS
AVAILABLE IN ACCOUNT 401-1509-561.82-00.
WHEREAS, pursuant to Resolution No. 20-042, the City Council authorized the City
Manager to execute an agreement with the Construction Managers of Southeast Texas
(CMOST) to construct the new maintenance building and electric charging infrastructure for
Port Arthur Transit(PAT) in the amount not to exceed$3,495,800.36; and,
WHEREAS, PAT has been allotted federal funding to construct the maintenance
building and electric charging infrastructure; and,
WHEREAS, PAT and its engineer (Huitt-Zollars) chose to value engineer (VE) the
base bid which resulted in a$154,199.64 reduction attached hereto as Exhibit"A";; and,
WHEREAS, the base bid reduction has enabled PAT to include Alternate No. 1
(inspection pit) and No. 2 (in-ground lift) in the project scope at an additional cost of
$236,600.36; and,
WHEREAS, PAT is recommending that the City of Port Arthur by its City Manager
enter into a change order with CMOST, as delineated in Exhibit"B".
WHEREAS, a change order agreement between the City of Port Arthur and CMOST is
attached hereto as Exhibit"B".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct.
THAT, the City Manager is hereby authorized to enter into a change order with the
Construction Managers of Southeast Texas (CMOST) of Port Arthur, Texas, to construct Port
Arthur Transit's maintenance building and electric charging infrastructure, in an amount not to
exceed $3,731,600.00, in substantially the same form as attached hereto as Exhibit"B".
