The Planning and Zoning Commission met in Special Session on Monday, March 2, 2020, at 5:30 p.m. in

NATURE OF REQUEST: The Planning and Zoning Commission is being asked to consider a request
for a zoning amendment of Appendix A (Zoning), Sections 7-100 (Schedule of Uses), 22-101
(Special Conditions by Use), 26-100 (Definitions), of the City of Port Arthur Code of Ordinances.
Introduction:
The Planning and Zoning Commission is being asked to consider a request to amend Sections 7 -
100 (Schedule of Uses), 22-101 (Special Conditions by Use), and 26-100 (Definitions), of the City
of Port Arthur Zoning Ordinance, to regulate and provide for special conditions related to
workforce housing, in the City of Port Arthur, Texas.
The overall goal is to continue to improve the standards set forth for these developments in an
effort to promote safe, orderly, and healthful development within the City of Port Arthur.
Summary and Request:
Staff is requesting amendments to Appendix A, Zoning, Section 7, Use of Land and Buildings; 22-
101, Special Conditions by Use; and 26-100, Definitions, of the City of Port Arthur Zoning
Ordinance, to regulate and provide for special conditions related to workforce housing, in the City
of Port Arthur, Texas.
The request is to add the allowance of workforce housing as a permitted use by special use permit
in the agricultural zoned districts within the city.
Section 1202 of Texas Occupations Code provides municipalities full authority to regulate
industrialized housing, including, as applicable:
(1) land use and zoning requirements;
(2) building setback requirements;

(3) side and rear yard requirements;
(4) site planning and development and property line requirements;
(5) subdivision control; and
(6) landscape architectural requirements.
Except as provided by Section 1202.253, of the Texas Occupations Code, requirements and
regulations not in conflict with this chapter or with other state law relating to transportation,
erection, installation, or use of industrialized housing or buildings must be reasonably and
uniformly applied and enforced without distinctions as to whether the housing or buildings are
manufactured or are constructed on-site. Thus, it is staff’s recommendation add the following
allowance(s):

(31) Workforce Housing: means a conglomerate of five (5) or more industrial housing untis or
buildings, or any other movable structure(s) serving as housing exclusively or primarily for
construction, industrial, or oilfield related workers and which provide accessory units for one of
the following: common restroom/showering facilties and eating facilities, in compliance with
Chapter 22, Article XII, of the Code of Ordinances of the City of Port Arthur, Texas.
Section 26-100. Definitions
For the purpose of this ordinance, certain terms, phrases, words and their derivatives shall have
their meanding as specified in theis section and in section 22. Where terms are not defined, they
shall have their ordinary accepted meanings within the context with which they are used.
Webster’s Ninth New Collegiate Dictionary, Copyright 1987, shall be considered as providing
ordinary accepted meaning.

buildings, or any other movable structure(s) serving as housing exclusively or primarily for
construction, industrial, or oilfield related workers and which provide accessory units for one of
the following: common restroom/showering facilties and eating facilities.
Staff is also requesting to add Workforce Housing to the chart located in Appendix A, Section 9,
Agricultural District Regulations, in order to provide anyone who may be interested in developing
Workforce Housing to the appropriate section where the development standards are located.

Purpose of request: This request is being made by Motiva Enterprises, LLC for
the purpose of expansion and project site safety.
Project Background:
Notification of this proposed abandonment was submitted to all utility entities servicing
the City of Port Arthur, for comment and acceptance. The Planning Staff has not
received any objections to this request.
Public Notice:
On Wednesday, February 19, 2020, thirteen (13) notices were mailed to adjacent
property owners within a 200 ft. Radius, as well as published in the Port Arthur News
more than twn (10) days before the P&Z public hearing scheduled for March 2, 2020.
FISCAL IMPACT/BUDGET IMPLICATIONS:
An appraisal for the Street ROW was conducted by Cook & Associates, Inc. of Beaumont,
Texas in December 2020.
As a result of the investigation and analysis and by the opinion of a licensed and
qualified real estate appraiser, a fair and reasonable consideration for the proposed
acquisition of said rights-of-way is $224,000 collectively.
RECOMMENDED ACTION:
Staff recommends that the Planning and Zoning Commission accept the request to
abandon portions of the street rights-of-way referenced above.

Purpose of request: This request is being made by USA Railway Terminals
Beaumont, LLC for the purpose of constructing a railyard.
Project Background:
Notification of this proposed abandonment was submitted to all utility entities servicing
the City of Port Arthur, for comment and acceptance. The Planning Staff has not
received any objections to this request.
Public Notice:
On Wednesday, February 19, 2020, five (5) notices were mailed to adjacent property
owners within a 200 ft. Radius, as well as published in the Port Arthur News more than
twn (10) days before the P&Z public hearing scheduled for March 2, 2020.

FISCAL IMPACT/BUDGET IMPLICATIONS:
An appraisal for the Street ROW was conducted by Cook & Associates, Inc. of Beaumont,
Texas in December 2020.
As a result of the investigation and analysis and by the opinion of a licensed and
qualified real estate appraiser, a fair and reasonable consideration for the proposed
acquisition of said right-of-way is $54,700.
RECOMMENDED ACTION:
Staff recommends that the Planning and Zoning Commission accept the request to
abandon portions of the street right-of-way referenced above.
