Attached is P: R. No. 14562 as it pertains to the approval
of a payment to 5.156 Acres Ltd. The Project Engineer has
indicated-that all of the improvements have been completed and
recommends payment of the incentive amount of $66,000. This
amount is 30% of the construction and related costs. Copies of
the invoices and cancelled checks that are se Officeeaornyour
Newsome's letter are in the City Secretary
review.

RSSOLIITION N0.
A RESOLIITION AS IT PERTAINS TO THE
APPROVAL OF A PAYMENT TO 5.156 ACRES LTD
WHEREAS, on April 24, 2007, the City Council approved
Ordinance No. 07-27, which is a Developer Participation
Agreement between the City of Port Arthur and 5.156 Acres, Ltd.;
and
WHEREAS, pursuant to Resolution No. OS-001, the
improvements have been made, which were approved and accepted by
the City of Port Arthur at its January 2, 2008 meeting; and
WHEREAS, the Project Engineer has submitted a letter
attached hereto as Exhibit "A" indicating that the work has been
completed, along with appropriate invoices and cancelled checks;
and
WHEREAS, Section Five of the Developer Participation
Contract states that the City will pay thirty percent (30%) of
the project costs, up to $66,000; and
WHEREAS, the Council deems it in the best interest of the
City to approve payment of $66,000 to 5.156 Acres, Ltd.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF' THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble
are true and correct.
