RE: Proposed Resolution No. 21364—Authorizing the First-Year Renewal of contracts
with seventeen(17) vendors on a Rotation Basis for the Mowing of Privately-
owned and City-own Vacant and Developed Lots in Areas of the City Designated as
Area B-E.
Recommendation:
Staff recommends that City Council adopt P.R.No. 21364,authorizing the first-year renewal of
the contracts with seventeen (17) vendors for the mowing of privately-owned and city-owned
residential and commercial vacant and developed lots in Areas B-E. Area B is bordered to the
west by Foley Street, and to the east by Savannah Avenue, its southern border is West Procter,
and its northern border is Zwolle Road. Area C is bordered to the west by Savannah Avenue,to
the east by 9th Avenue, to the south by Lakeshore Drive, and the north by 25th Street. Area D is
bordered to the west by 9th Avenue and the eastward boundary of the City,the southern boundary
is Lakeshore Drive, and the northern boundary is 25th Street(Griffin Drive). Area E is bordered
to the south by 25th Street, its northern border is Aero Drive, its western border is Memorial
Boulevard, and its eastern border is Jefferson Drive (Twin City Highway). The vendors are: (1)

foot. Each contractor has demonstrated that they are qualified and capable to perform mowing
services in Area B-E.

Background:
The contracts with the seventeen (17) vendors were approved by Resolution 19-183 on May 7,
2019. The contracts were approved for one-year with an option to renew for two (2) additional
years. The seventeen vendors have been providing quality service and have met the terms of
their contracts with the City. The vendors response and services has been commendable. Three
(3) contracts which were approved at that time (Oceguera Landscaping, JB Lawn Service and
All-Knight Lawn Service) will not be renewed due to failure of the vendor to meet their
contractual obligations. These contracts are necessary due to an abundance of high grass in Port
Arthur and the Environmental Health Division needs multiple vendors to maintain each area.
Below is the order of rotation for the vendors as was previously determined at the May 7, 2019
city council meeting. This contract will be the second year of the contract with the option to
renew for one (1) additional year.

Budget and Revenue Impact:
Acceptance of this recommendation will not require a budget amendment. Funding is available
in Account No. 001-1304-541.59-00.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE FIRST RENEWAL OF CONTRACTS
PURSUANT TO RESOLUTION NO. 19-183 BETWEEN THE CITY OF PORT
ARTHUR AND(17)VENDORS FOR GRASS MOWING SERVICES OF PRIVATELY-
OWNED AND CITY-OWNED VACANT AND DEVELOPED LOTS IN AN AREAS OF
THE CITY DESIGNATED AS AREAS B-E. FUNDS ARE AVAILABLE IN GENERAL
FUND ACCOUNT NUMBER 001-1304-541.59-00, (OTHER CONTRACTUAL
SERVICE).
WHEREAS,there are a large number of properties that the City maintains by mowing the
grass, due to the lack of care by the owners; and
WHEREAS, multiple contractors are needed for each area due to the volume; and
WHEREAS, the City Council originally awarded twenty(20) contracts on May 7, 2019,
pursuant to Resolution No. 19-183; and
WHEREAS, Oceguera Landscaping of Port Arthur does not wish to renew its contract.
Additionally, JB Lawn Service and All-Knight Services contracts were terminated for failure to
meet contractual obligations.
WHEREAS,the updated order of rotation is attached hereto as Exhibits"B - R"; and
WHEREAS, the City Council deems in the best interest of the City to renew the existing
contracts with the seventeen(17) remaining vendors; and
WHEREAS,this is first renewal of the five contracts attached hereto as Exhibit B-R,including
an option to renew each contract for one (1) additional year.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That,the facts and opinions in the preamble are true and correct.
Section 2. That, for the purposes of this Resolution, Area B is bordered to the west by
Foley Street and to the east by Savannah Avenue, its southern border is West Procter Street, and
its northern border is Zwolle Road. Area C is bordered to the west by Savannah Avenue, to the

THIS AGREEMENT, made this day _ of , 2020, by and between the
City of Port Arthur, a municipal corporation organized under the laws of the State of Texas,
hereinafter called "OWNER" or "CITY" and ISRAEL CONSTRUCTION herein acting by and
through ISRAEL LOPEZ JR. hereinafter called "CON TRACTOR".
WITNESSETH: That for and in consideration of the payment terms, conditions and agreements

7. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
