R.No. 21260—Negotiate a contract with LSPS Solutions,LLC for Consulting Services to Comply with the American Water Infrastructure Act of 2018. Introduction: The intent of this Agenda Item is to seek the City Council's approval for the City Manager to negotiate a contract with LSPS Solutions,LLC,of Victoria,Texas for consulting services related to compliance with the American Water Infrastructure Act of 2018. A Request for Qualifications (RFQ) was solicited according to the City's purchasing policy. Five (5) firms sent in qualification packets in response to the RFQ. An RFQ review committee was formed and LSPS Solutions, LLC, of Victoria, Texas was determined to have the best qualifications. Background: On October 23, 2018, America's Water Infrastructure Act (AWIA) was signed into law. AWIA Section 2013 requires community (drinking) water systems serving more than 3,300 people to develop or update risk assessments and emergency response plans(ERPs). The law specifies the components that the risk assessments and ERPs must address, and establishes deadlines by which water systems must certify to EPA completion of the risk assessment and ERP. Budget Impact: Contract amount to be negotiated. Recommendation: It is recommended that City Council approve the City Manager to negotiate a contract with LSPS Solutions, LLC, of Victoria, Texas for consulting services related to America's Water Infrastructure Act of 2018, as discussed and/or outline above. A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND LSPS SOLUTIONS, LLC, OF VICTORIA, TEXAS FOR CONSULTING SERVICES RELATED TO AMERICA'S WATER INFRASTRUCTURE ACT OF 2018. WHEREAS, the City of Port Arthur advertised in the Port Arthur News for Request for Qualifications (RFQs) on March 17 and March 24, 2020 for consulting services on America's Water Infrastructure Act of 2018; and, WHEREAS,the City of Port Arthur received qualifications from five (5) firms; and, WHEREAS,RFQs were received and opened on April 1, 2020; and, WHEREAS,the RFQ evaluation committee,having reviewed said statements and having used the published evaluation criteria, recommends LSPS Solutions, LLC, of Victoria, Texas for these services (Exhibit A); and, WHEREAS,the City Council finds it to be in the best interest of the citizens of Port Arthur to authorize the City Manager to negotiate a contract for the providing of these services; and, WHEREAS, staff will expedite to the City Council a proposed resolution with the negotiated contract price, returning for City Council approval as soon as possible due to the time- sensitive nature of this item and the COVID-19 virus delays. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, THAT, the City Manager is hereby authorized and directed to negotiate a contract on behalf of the City of Port Arthur with LSPS Solutions, LLC, of Victoria, Texas for consulting services related to America's Water Infrastructure Act of 2018; and, P.R.No. 21260 04/21/2020 bw Page 2 of 3 THAT a copy of the caption of this resolution be spread upon the minutes of the City Council.
