RECOMMENDATION:
I recommend that Proposed Resolution No. 11952 be approved. This Resolution would
increase the amount of funds available for the purchase of two Type II transit vans.
BACKGROUND:
The Texas Department of Transportation had previously allocated $168,000 to the City
for the purchase of two new vans to replace existing transit vehicles used for the
transportation of the elderly and handicapped. We had money left fi.om an earlier grunt
with TXDOT and they have agreed to roll those remaining funds into this grant
increasing the available funding to $182,512 with $45,628 in toll credits.
BUDGETARY/FISCAL EFFECT:
Increases available funding by $14,512.
STAFFING/EMPLOYEE EFFECT:
None
SUMMARY:

A RESOLUTION AUTHORIZING AMENDMENT NO. 1 TO
PROJECT NO. VCR 0202 (20) WFFI4 THE TEXAS
DEPARTMENT OF TRANSPORTATION TO PROVIDE
FOR ADDITIONAL TRANSIT CAPITAL FUNDS
WHEREAS, the City Council of the City of Port Arthur authorized by Resolution No. 02-109 a
contract with the Texas Department of Transportation for financial assistance for the purchase of
two transit vehicles for the Port Arthur Transit System in the amount of $168,000; and,
WHEREAS, the City of Port Arthur has been approved to receive additional funds in the amount of
$14,512; and; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT the City Manager is hereby authorized to execute an amendment to Project No. VCR 0202
(20) between the State of Texas, acting by and through the Texas Department of Transportation and
the City of Port Arthur for additional financial assistance, a copy of said amendment being attached
hereto as Exhibit "A'.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.

STATE/LOCAL PUBLIC TRANSPORTATION GRANT AGREEMENT
AMENDMENT #1
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas~ actfng through the Texas Department of
Transportation, hereinafter cal~ed the 'State", and the City of Port Arthur hereinafter called the ~Subreceipent".
WlTNESSETH
WHEREAS, the State and the Subrecipient executed a contract on Apdl 24, 2002 to effectuate their agreement to provide
for the expenditure of ~unds pursuant to the provisions of 49 U.S.C., § 5309, which authorizes the U.S. Secratar~ of
Transpodation to make grants to state governments to assist in financing capital projects that will benefit the COuntry's
transit systems; and.
WHEREAS, it has become necessary to amend that grant agreement;
NOW THEREFORE, in COnsideration of the premises and of the mutual covenants and agreements of the parties hereto,
the State and the Subrecipient do agree as follows:
AGREEMENT
Article 1. Description of Amended Items:
The State has approved the distribution of additional federal funds from expired prior year contracts to the Subreceibent.
Article 3A, page 2, sentence 1 is revised to reed he max mum amount payable under this agreement without

and shall replace the budget included with the above-mentioned Grant.
All other provisions of the original grant agreement are unchanged and remain in full force a
