Williams, Director of Human Resources RE: A Resolution Approving a Property Damage Settlement in the Amount of$9,980.43 for Damages to City of Port Arthur Transit Vehicle#2286 Nature of the request: On April 16, 2020, a transit operator drove on the median to proceed around a solid waste unit and the roof of the bus was damaged by a large hanging branch. StaffAnalysis, Considerations: The City has Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TML-IRP) with a $2,500.00 deductible. TML has offered the City a settlement of$9,980.43, less the $2,500.00 deductible, making the final settlement offer $7,480.43 (Exhibit "A" attached). This amount is sufficient to repair the unit. If additional damages are discovered, TML-IRP may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 21415 authorizing the property damage settlement against TML-IRP for damage sustained to Transit Vehicle #2286 (2018 Starcraft Cutaway). TML-IRP has offered to settle the claim for $9,980.43, less the $2,500.00 deductible, making the final settlement offer $7,480.43. This is considered a fair and reasonable settlement. Budget Considerations: The funds received will be deposited in the Miscellaneous Income- Insurance Proceeds Account#625-0000-369.85-00. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF AN AUTOMOBILE PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $9,980.43 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TML-IRP) AS A RESULT OF THE PROPERTY DAMAGE TO TRANSIT VEHICLE #2286 WHEREAS, on April 16, 2020, City of Port Arthur Transit Vehicle #2286 (2018 Starcraft Cutaway) was damaged when it was involved in an accident; and, WHEREAS, as a result of the damage, a claim was filed with the Texas Municipal League Intergovernmental Risk Pool (TML-IRP); and, WHEREAS, it has been determined that damages sustained by Transit Vehicle #2286 were in excess of the fair market value of the vehicle; and, WHEREAS, the TML-IRP has offered to settle the claim for $9,980.43, less the Automobile Physical Damage deductible amount of $2,500.00, making the final settlement $7,480.43, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1 . That, the facts and opinion in the preamble of this RESOLUTION are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $9,980.43, less the Automobile Physical Damage deductible amount of $2,500.00, making the final settlement $7,480.43, for the claim against TML-IRP in substantially the same form as delineated in Exhibit "A". Section 3. That a copy of this RESOLUTION be spread upon the minutes of the City Council. P.O.
