RE: PR 21423: Interlocal Agreement between the City of Port Arthur and Jefferson County
Precinct 3 to cut the grass at the North and South Levee Roads in Pleasure Island.
Introduction:
The intent of this Agenda Item is to authorize the City Manager to enter into an Interlocal Agreement between
Jefferson County Precinct 3 and the City of Port Arthur to cut the grass at the North and South Levee Roads
in Pleasure Island.
Background:
Jefferson County, Texas through Commissioner Precinct 3 has, in the past, provided labor and
equipment to cut the grass at the North and South Levee Roads in Pleasure Island. The City of Port
Arthur does not have the labor or equipment suited maintaining the grass in the Levee Roads. Jefferson
County has agreed to furnish labor and equipment subject to the requirements of the Texas Government
Code, Sec. 791.014.
Budget Impact:
To maintain the grass in the Levee Roads twice a year. The budget impact shall not exceed $16,879.70
Funding is available in the Public Works Maintenance Account No. 001-1203-531.36-00
Recommendation:
It is recommended that the City of Port Arthur City Council approve PR 21423 authorizing the City Manager
to enter into an Interlocal agreement between the City of Port Arthur and Jefferson County Precinct 3 to cut
grass at the North and south Levee Roads in Pleasure Island.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF
PORT ARTHUR AND JEFFERSON COUNTY PRECINCT 3 FOR
CUTTING THE GRASS AT THE NORTH AND SOUTH LEVEE
ROADS IN PLEASURE ISLAND FOR A BUDGETARY IMPACT OF
$16,879.70. FUNDING IS AVAILABLE IN THE PUBLIC WORKS
MAINTENANCE ACCOUNT NO. 001-1203-531.36-00
WHEREAS, the purpose of this agreement is for Jefferson County Precinct 3 to
cut the grass of the North and South Levees of Pleasure Island two times this year as
needed and determined by Pct. 3 or the City of Port Arthur; and,
WHEREAS, the City of Port Arthur shall provide Jefferson County Precinct 3 with
materials and payments in exchange for the labor and equipment, See Exhibit A; and,
WHEREAS, the City of Port Arthur approached Jefferson County Precinct 3 for
assistance with cutting the grass at the North and South Levee Roads in Pleasure Island;
and,
WHEREAS, the Commissioners Court of Jefferson County has agreed to this
proposition by passage of said resolution at its Commissioner's Court meeting and signed
an Interlocal Agreement, See Exhibit B, on April 21, 2020; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City of Port Arthur City Council hereby authorizes the City Manager to
enter into an Interlocal Agreement between the City of Port Arthur and Jefferson County

Precinct 3 for cutting the grass at the North and South Levee Roads in Pleasure Island.
See Exhibit B; and,
THAT, there is a not to exceed budgetary impact of $16,879.70 for this Interlocal
Agreement; and,
THAT, funding is available in Public Works Maintenance Account No. 001-1203-
531.36-00; and,
THAT, this resolution is contingent upon the Jefferson County Commissioner's
Court approval and authorization for the County Judge to execute the Interlocal
Agreement between Jefferson County and the City of Port Arthur to allow Precinct 3 to
perform work and services pursuant to Sec. 791.014, Texas Government Code; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

RE: Assistance through Inter-local Agreement
Dear Commissioner Sinegal:
The City of Port Arthur requests the assistance of Jefferson County through an inter-local agreement for the North and
South Levees of Pleasure Island.
1. Cut the grass for the North and South Levees of Pleasure Island by using one slope mower,two side arms
and two bush hogs. One Gradall and a dump truck to clean the scattered pieces of waste and trash.
Additionally,the City requests your spraying crew to put herbicide spraying(2 times). The City of Port
Arthur Requests mowing the North and South Levee twice a year(typically on April and October)
The City of Port Arthur will provide the following for your assistance:
1. Pct.3 shall accept 14 tons of High Performance Hotmix and 1200 gallons of CRS-Oil for the next time
Pct.3 cuts the grass at the North and South Levee.
- High Performance Hotmix— 14 tons X$98.25 =$1,375.50
- CRS-Oil— 1200 gallons x$2.11 =$2,532.00
Total=$3,907.50 x 2(twice per year)_$7,815
2. To provide the City of Port Arthur assistance in the North and South Levee,Jefferson County Pct. 3 will
have to work on overtime because the Pct. 3 is already working with the City for Jetty Road. The payment
to Pct.3 will be overtime, fuel for equipment used and miscellaneous items.
Labor—22 hrs of overtime X 46.75 hr.X 8 employees=$8,228
Fuel— 184.5 Gallons X 2.1954/gallon=$405.05
Miscellaneous—5%total=$431.65
Total=$9,064.70
Sum Total=$16,879.70
In total,the City shall not exceed the amount of$16,879.70 to cut the grass in the North and South levee.

STATE OF TEXAS §
§ INTERLOCAL AGREEMENT
COUNTY OF JEFFERSON §
WHEREAS, Jefferson County, Texas, by and through its Commissioners' Court as
authorized by Chapter 791 of the Government Code and the City of Port Arthur along
with the Jefferson County, Texas, for the mutual benefit of the citizens they serve,
desire to enter into a contract to provide certain services to each other; and,
WHEREAS, Jefferson County, Texas through the Commissioner Precinct 3 has, from
time to time, capacity to provide labor and equipment suitable for mowing, cleaning
and spraying ditches and performing the work requested in the attached order; and,
WHEREAS, the City of Port Arthur, requires the assistance, the need for mowing,
spraying and conducting maintenance work within the corporate limits of the City of
Port Arthur; and,
WHEREAS, the City of Port Arthur, does not have an adequate supply of the labor or
equipment suited for such a task and would specifically as for assistance in the Port
Acres area; and
NOW, THEREFORE, KNOW ALL MEN BY THE PRESENTS:
City of Port Arthur and Jefferson County hereby agree as follows:
1. Jefferson County shall assist the City with labor and equipment suitable
for the mowing, cleaning and spraying of ditches on the North and South
Levees of Pleasure Island area when and as determined at the discretion
of the Commissioner for Jefferson County Precinct Three, subject to the
requirements of Section 791.014 of the Government Code.
2. Consideration for the work herein contemplated shall be determined and
mutually agreed from time to time depending on the scope of the
maintenance work needed.
3. This agreement shall be effective on the date of its execution and may be
terminated at the will of either party.
4. This agreement shall be construed according to the laws of the State of
Texas.
5. Nothing in this agreement shall be construed to create the existence of an
agency relationship between the parties.
6. Any employee of a party performing services pursuant to this agreement
shall not be deemed to be the agent of the party receiving services under
this agreement.
7. The parties further agree, pursuant to Sec. 791.015, Texas Government
Code, that any dispute regarding the terms of this agreement will be
submitted to an agreed upon mediator for resolution.
