RE: P.R. 21407: Sunken Court Roadway construction Project from Twin City Highway to
North Park Drive, Change Order No. for a waterline tie-in, tree cutting and extension of
contract time, increasing the contract by $20,515.12; Project No.: ST1 P02.
Introduction:
The intent of this Agenda Item is to authorize the City Manager to execute Change Order No. 3 for four
additional tie-ins,tree cutting and removal,and extension of the contract time that increases the contract by
$20,515.12 for the Sunken Court Reconstruction Project from Twin City Highway to North Park Drive.
Background:
Pursuant to Resolution No. 19-412, Excavation&Construction,LLC of Port Arthur,Texas was awarded the
project for the Sunken Court Reconstruction Project from Twin City Highway to North Park Drive. Change
Order No. 1 was approved by Council pursuant to Resolution 20-026 that increased original contract amount
of $2,268,343.13 by $41,225.48 to the new contract amount of $2,309,568.61 for the removal and
replacement of an existing waterline. Change Order No. 2 was approved by Council pursuant to Resolution
20-146 for a waterline tie-in at Bernhardt Drive that increased the contract amount by$11,206.66 to the new
contract amount of$2,320,775.27. Excavation along Sunken Court exposed existing utilities that were not
shown on any City record drawings resulting in the need for four additional tie-ins. Trees located at four
intersections need to be cut back to allow for the relocation of street light poles by Entergy. Additionally, a
time extension of 60 calendar days addresses the tree cutting and removal, assisting with locates and
exploratory excavation. Change Order No. 3 is being submitted to address these changes and increases the
original contract amount of$2,320,775.27 by $20,515.12 to the new contract amount of$2,341,290.39.
Change Order No. 3 also extends the time of completion by adding 60 calendar days to the original
completion date June 21,2020 changing it to the new completion date of August 20, 2020.

Budget Impact:
Change Order No. 3 impacts funds in the Capital Improvement Account for the Street Maintenance and
Repair, Account No. 307-1601-591.86-00. Project No. STI P02.
Recommendation:
It is recommended that the City of Port Arthur City Council approve PR 21407 with Excavation &
Construction, LLC of Port Arthur, Texas authorizing the City Manager to execute Change Order No. 3
increasing the original contract amount of $2,320,775.27 by $20,515.12 to the new contract amount of
$2,341,290.39 and extending the time of completion by 60 days to the new date of August 20, 2020.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE CHANGE ORDER NO. 3 TO THE CONTRACT BETWEEN
THE CITY OF PORT ARTHUR AND EXCAVATION &
CONSTRUCTION, LLC OF PORT ARTHUR, TEXAS FOR THE
SUNKEN COURT ROADWAY RECONSTRUCTION PROJECT
FROM TWIN CITY HIGHWAY TO NORTH PARK DRIVE FOR
WATERLINE TIE-INS, TREE CUTTING, AND EXTENSION OF
THE CONTRACT TIME BY 60 CALENDAR DAYS INCREASING
THE ORIGINAL CONTRACT AMOUNT OF $2,320,775.27 BY
$20,515.12 TO THE NEW CONTRACT AMOUNT OF
$2,341,290.39. FUNDING IS AVAILABLE IN THE CAPITAL
IMPROVEMENTS STREET ACCOUNT NO. 307-1601-591.86-00.
PROJECT NO. ST1P02.
WHEREAS, pursuant to Resolution No. 19-412, the City of Port Arthur City Council
awarded a contract for the Sunken Court Reconstruction Project from Twin City Highway
to North Parke Drive to Excavation & Construction, LLC (Contractor) of Port Arthur, Texas
with a projected budgetary impact of $2,268,343.13 and a term of 230 calendar days;
and,
WHEREAS, pursuant to Resolution No. 20-026, the City of Port Arthur City Council
approved Change Order No. 1 submitted by Excavation & Construction, LLC of Port
Arthur, Texas for the removal and replacement of an existing water line that increased
the contract amount by $41,225.48 from the original contract amount of $2,268,343.13
to the new contract amount of $2,309,568.61; and,
WHEREAS, pursuant to Resolution No. 20-146, the City of Port Arthur City Council
approved Change Order No. 2 submitted by Excavation & Construction, LLC of Port
Arthur, Texas for the waterline tie-in at Bernhardt Drive that increased the contract

amount by $11,206.66 from the original contract amount of $2,309,568.61 to the new
contract amount of $2,320,775.27; and,
WHEREAS, during excavation for proposed utilities along Sunken Court Drive,
Excavation & Construction, LLC of Port Arthur, Texas, exposed existing utilities that were
either not shown on any City record drawing or were unable to locate through one-calls
resulting in the need for four (4) additional waterline tie-ins; and,
WHEREAS, there was difficulty in securing a tree service to cut and remove trees
at four (4) intersections to allow for the relocation of street light poles by Entergy of
Texas, the Contractor has proposed to cut, trim, and remove the tree limbs; and,
WHEREAS, an extension of 60 calendar days is requested to allow for time utilized
for exploratory excavation for existing utilities, the modification of waterlines under
pavement, and the tree cutting; and,
WHEREAS, proposed Change Order No. 3 is being submitted to the contract by
Excavation & Construction, LLC of Port Arthur, Texas to address these changes and
increases the original contract amount of $2,320,775.27 by $20,515.12 to the new
contract amount of $2,341,290.39. See Exhibit A; and,
WHEREAS, proposed Change Order No. 3 also extends the time of completion by
adding 60 calendar days to the original completion date of June 21, 2020 changing it to
the new completion date of August 20, 2020. See Exhibit A; and,
WHEREAS, approval of Change Order No. 3 is herein deemed an appropriate
action; now, therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, Change Order No. 3 is herein approved and the City Manager is authorized
to execute said Change Order No. 3 to the contract between the City of Port Arthur and
Excavation & Construction of Port Arthur, Texas for additional waterline tie-ins, tree
cutting and removal, and an addition of 60 calendar days to the contract; and,
THAT, Change Order No. 3, submitted by Excavation & Construction, LLC of Port
Arthur, Texas will increase the original contract amount of $2,320,775.27 by $20,515.12
to the new contract amount of $2,341,290.39; and,
THAT, Change Order No. 3, submitted by Excavation & Construction, LLC of Port
Arthur, Texas will extend the time of completion by adding 60 calendar days to the
original completion date of June 21, 2020 changing it to the new completion date of
August 20, 2020; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

Dear Mr. Elefano,
Attached you will find Change Order No. 3 for the above referenced project. Upon excavation
of proposed utilities along Sunken Court the contractor exposed existing utilities that were not
shown on any City record drawings or were unable to locate through one-calls. Additional tie-
ins were required and discussed with City staff in the field. Time included with this change order
is associated with the trimming of trees in coordination with Entergy at the City's request and
time spent assisting the City locate existing utilities and exploratory excavation with City staff.
Also, field directives discussed with PW-E and water utilities City personnel to modify waterlines
under proposed pavement, along with grades and pavement location along North Park. It was
determined that adjustments to the proposed improvements were required to be made in order
to tie in the existing utilities and match existing grades. These items are value added and will
promote the success of the overall project. Any information determined on existing utility
locations throughout the construction process will be included on the final record drawings for
future use.
This change order reflects the minimum items necessary to accomplish this work. If you have
