I recommend' approval of Proposed Resolution No. 14575 which authorizes settlement of the power surge
damage claim in the amount of $36,253.81 made. against Texas Municipal League Intergovernmental Risk
Pool (TML) for damage to various City properties as listed in the Damage Recap (Attachment "A"). TML has
~epairs; a howeverenthe Cityahas at Realand Personalr Property deductible of $5 000. 0, making thel fitnal
settlement $31,253.81. If additional costs are incurred, the City has up to one year from the date of the
hurticane to request supplemental payment. Therefore, this is considered a fair and reasonable settlement:

SUMMARY:

repairs; however, the City has a ReaF and Personal Property deductible of $5,000.00, making the final
settlement $31,253.81. If additional costs are incurred, the City has up to one year from the date of the
huricane to request supplemental payment. Therefore, this is considered a fair and reasonable settlement.
This settlement is for the power surge damage claim only. The windstorm claim is pending.

A RESOLUTION AUTHORIZING THE CITY MANAGER
TO DO ALL THINGS NECESSARY TO EXECUTE THE SETTLEMENT
OF CLAIMS IN THE AMOUNT OF $36,253.81 MADE AGAINST
TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TML)
AS A RESULT OF POWER SURGE D O VARIOUS CITY PROPERTIES UMBERTO (SEPTEMBER 13, 2007)
WHEREAS, on September .13, 2007, Hurricane Humberto struck the City of Port Arthur, resulting in power surge
damages to various City properties as listed in the Damage Recap (Attachment "A'~; and,
WHEREAS, as a resuR of the power surge damages, a Gaim was filed with Texas Municipal League Intergovernmental
Risk Pool (TML); and,
WHEREAS, TML has offered to settle these claims in the amount of $36,253.81 less the $5,000.00 deductible for the
properties, making the final settlemern $31,253.81; and,
WHEREAS, this has been determined to be a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS:
Section 1. That, the fads and opinions in the preamble are true and cored.
Section 2. That, the City Manager is hereby authorized to do all things necessary to execute settlement, as denoted in
the Damage Recap (Attachment "A'~, in the amount of $36,253.81, less the $5,000.00 deductible for the properties, making the
final settlement $31,253.81 forthe Gaim against Texas Municipal League Irnergovemmental Risk Pool (TML).
Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
