PR 21411: PHASE II REPAIRS TO THE DEPARTMENT CLUB
Memorandum City of Port Arthur, Texas Robert A. "Bob"Bowers Civic Center To: The Honorable Mayor and City Council Through: Ron Burton,City Manager From: Adam J Saunders,Civic Center Dir RE: Proposed Resolution No. P.R. 21411 REQUEST: The Department Club at 1924 Lakeshore Drive is in need of repair and maintenance. Some items are related to Hurricane Harvey, and some are not. In March, 2019 the Council passed Res 19-108 and in December, 2019 the Council passed Res 19-560. These two Resolutions were for Architectural fees and Asbestos, lead and mold abatement. These activities are Phase I of the repairs and maintenance. More repairs are needed for the building to be open and operational. These repairs will be done in at least two more phases. Phase II will consist of repairs to seal the building to prevent any further deterioration and protect the building from the elements. This includes mainly exterior work, along with work on the wood floor. The floor work is reimbursable by insurance. All other work will be paid from the Hotel Occupancy Tax account. McInnis Construction, Inc. of Silsbee will perform the work for a cost of$224,000.00. Funds available in hotel tax account 140-1405-551.59-00. ANALYSIS/CONSIDERATION: There are a lot of needed repairs at the building. Phase I has been performed, which included Asbestos Abatement, Mold Remediation and Lead paint removal. Phase II is the next step in the repairs and restoration of the Department Club. The Purchasing Division advertised for this on 2/4&2/11/20. One quote was received: • Mclnnis Construction, Inc $224,000.00 RECOMMENDATION A resolution authorizing the City Manager to enter into an agreement with McInnis Construction, Inc. of Silsbee for repairs and renovations of the Department Club in the amount of$224,000.00. User Notes; (1232169027) ARTICLE 5 PAYMENTS § 5.1 Progress Payments § 5.1.1 Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the Architect,the Owner shall make progress payments on account of the Contract Sum to the Contractor as provided below and elsewhere in the Contract Documents. § 5.11 The period covered by each Application for Payment shall be one calendar month ending on the last day of the month,or as follows: § 5.1.3 Provided that an Application for Payment is received by the Architect not later than the Fifteenth day of a month,the Owner shall make payment of the amount certified to the Contractor not later than the Fifteenth day of the following month.If an Application for Payment is received by the Architect after the application date fixed above, payment of the amount certified shall be made by the Owner not later than Thirty ( 30 )days after the Architect receives the Application for Payment. Standard Worker's Compensation Insurance: 2. Commercial General Liability occurrence type insurance City of Port Arthur,its officers, agents, and employees must be named as an additional insured): a.Bodily injury$500,000 single limit per occurrence or$500,000 each person/$500,000 per occurrence for contracts of$100,000 or less;or Bodily injury$1,000,000 single limit per occurrence or$500,000 each person/$1,000,000 per occurrence for contracts in excess of$100,000; and, b. Property' Damage$100,000 per occurrence regardless of contract amount; and, c. Minimum aggregate policy year limit of$1,000,000 for contracts of $100,000 or less; or,Minimum aggregate policy year limit of$2,000,000 for contracts in excess of$100,000. 3. Commercial Automobile Liability Insurance (Including owned, non-owned and hired vehicles coverage's). a. Minimum combined single limit of$500,000 per occurrence,for bodily injury and property damage. b. If individual limits are provided, minimum limits are $300,000 per person, $500,000 per occurrence for bodily injury and $100,000 per occurrence for property damage. Contractor shall cause Contractor's insurance company or insurance agent to fill in all information required (including names of insurance agency, contractor and insurance companies, and policy numbers, effective dates and expiration dates)and to date and sign and do all other things necessary to complete and make into valid certificates of insurance and pertaining to the above listed items,and before commencing any of the work and within the time otherwise specified, Contractor shall file completed certificates of insurance with the Owner. Contractor shall also file with the City of Port Arthur valid CERTIFICATE OF INSURANCE on like form from or for all Subcontractors and showing the Subcontractor (s) as the Insured.
