INVOCATION, PLEDGE & ROLL CALL Councilmember Jones gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Regular Session on Thursday, February 13, 2020 at 10:11 a.m. in the City Council Chamber, City Hall, with the following members present: Mayor Thurman "Bill" Bartie; Mayor Pro Tem Harold Doucet, Sr.; Councilmembers Raymond Scott, Cal Jones, Thomas Kinlaw, III, Charlotte Moses and Kaprina Frank; City Manager Ron Burton; City Secretary Sherri Bellard; City Attorney Valecia R. Tizeno and Sergeant At Arms Police Chief Tim Duriso. II. ITEMS REQUIRING INDIVIDUAL ACTION — NON-CONSENT (1) P. O. No. 6814 — An Ordinance Continuing The Juvenile Curfew Ordinance As Delineated In Sections 62-101 To 62- 106 Of The Code Of Ordinances Of The City Of Port Arthur The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Frank, seconded by Councilmember Jones and carried, Proposed Ordinance No. 6814 was adopted becoming Ordinance No. 20-09. Voting Yes: Mayor Bartle; Mayor Pro Tem Doucet; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. The caption of Ordinance No. 20-09 reads as follows: ORDINANCE NO. 20-09 AN ORDINANCE CONTINUING THE JUVENILE CURFEW ORDINANCE AS DELINEATED IN SECTIONS 62-101 TO 62-106 OF THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR (2) P. O. No. 6826 — An Ordinance Providing For The Conduct Of A General Election On May 2, 2020, For The Purpose Of Electing Six (6) Councilmembers, In The City Of Port Arthur, Texas; And Providing For A Joint Election With The Port Arthur Independent School District, The Sabine Pass Independent School District And The Sabine Pass Port Authority In Accordance With Chapter 271 Of The Texas Election Code, And Providing For The Publication Of The Election Notice The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Frank, seconded by Councilmember Kinlaw and carried, Proposed Ordinance No. 6826 was adopted becoming Ordinance No. 20-10. Voting Yes: Mayor Bartle; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. The caption of Ordinance No. 20-10 reads as follows: ORDINANCE NO. 20-10 AN ORDINANCE PROVIDING FOR THE CONDUCT OF A GENERAL ELECTION ON MAY 2, 2020, FOR THE PURPOSE OF ELECTING SIX (6) COUNCILMEMBERS, IN THE CITY OF PORT ARTHUR, TEXAS; AND PROVIDING FOR A JOINT ELECTION WITH THE PORT ARTHUR INDEPENDENT SCHOOL DISTRICT, THE SABINE PASS INDEPENDENT SCHOOL DISTRICT AND THE SABINE PASS PORT AUTHORITY IN ACCORDANCE WITH CHAPTER 271 OF THE TEXAS ELECTION CODE, AND PROVIDING FOR THE PUBLICATION OF THE ELECTION NOTICE (3) P. O. No. 6827 — An Ordinance Providing For The Conduct Of A Special Election On May 2, 2020 To Submit A Proposition As To The Adoption Of Sales And Use Tax For Projects Related To Recreational Or Community Facilities As Authorized Pursuant To Section 505.152 Of The Texas Local Government Code And Providing For Publication Of The Election Notice The Mayor introduced the above-mentioned Proposed Resolution. The motion was made by Councilmember Frank and seconded by Councilmember Moses that Proposed Ordinance No. 6827 be adopted. John Beard appeared before the City Council to speak regarding the above-mentioned topic. Parks and Recreation Director Chandra Alpough appeared before the City Council to answer inquires regarding the above-mentioned topic. Voting Yes: Mayor Bartie; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. Proposed Ordinance No. 6827 was adopted becoming Ordinance No. 20-11. The caption of Ordinance No. 20-11 reads as follows: ORDINANCE NO. 20-11 AN ORDINANCE PROVIDING FOR THE CONDUCT OF A SPECIAL ELECTION ON MAY 2, 2020 TO SUBMIT A PROPOSITION AS TO THE ADOPTION OF SALES AND USE TAX FOR PROJECTS RELATED TO RECREATIONAL OR COMMUNITY FACILITIES AS AUTHORIZED PURSUANT TO SECTION 505.152 OF THE TEXAS LOCAL GOVERNMENT CODE AND PROVIDING FOR PUBLICATION OF THE ELECTION NOTICE City Council Minutes Special Meeting - February 13, 2020 2 (4) P. No. 6828 — An Ordinance Providing For The Conduct Of A Special Election On May 2, 2020 To Submit Propositions Regarding Proposed Amendments To The City Charter; Providing For Notice Of Election, And Providing For Publication Of The Election Notice The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Frank, seconded by Councilmember Jones and carried, Proposed Ordinance No. 6828 was adopted becoming Ordinance No. 20-12. Voting Yes: Mayor Bartie; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. The caption of Ordinance No. 20-12 reads as follows: ORDINANCE NO. 20-12 AN ORDINANCE PROVIDING FOR THE CONDUCT OF A SPECIAL ELECTION ON MAY 2, 2020 TO SUBMIT PROPOSITIONS REGARDING PROPOSED AMENDMENTS TO THE CITY CHARTER; PROVIDING FOR NOTICE OF ELECTION, AND PROVIDING FOR PUBLICATION OF THE ELECTION NOTICE (5) P. O. No. 6830 — An Ordinance Providing For The Conduct Of A Special Election On May 2, 2020 To Submit A Proposition Regarding The Sale Of Various City Parks And Providing For Publication Of The Election Notice The Mayor introduced the above-mentioned Proposed Resolution. The motion was made by Councilmember Frank and seconded by Councilmember Moses that Proposed Ordinance No. 6830 be adopted. Upon the motion of Councilmember Moses, seconded by Councilmember Kinlaw and carried, to amend Proposed Ordinance No. 6830 to use Option 1 language. Voting Yes: Mayor Bartle; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. Upon the motion of Councilmember Kinlaw, seconded by Councilmember Frank and carried that Proposed Ordinance No. 6830 be amended by adding the reason for the proposition. Voting Yes: Mayor Bartle; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. Proposed Ordinance No. 6830 was adopted, as amended becoming Ordinance No. 20- 13.
