A RESOLUTION AUTHORIZING THE PURCHASE OF CEMENT SLURRY FROM SOUTHERN CEMENT SLURRY, LLC OF PORTER, TEXAS, FOR THE PUBLIC WORKS DEPARTMENT STREETS DIVISION WITH A PROJECTED BUDGETARY IMPACT OF$200,000.00. FUNDS ARE PROVIDED IN ACCOUNT NOS. PUBLIC WORKS STREETS DIVISION — STREETS 001- 1203-531.36-00 AND CAPITAL IMPROVEMENTS FUND — CAPITAL PROJECTS—STREETS 307-1601-591.86-00. WHEREAS, cement slurry is a mixture of cement, water and assorted dry and liquid additives that produces less dust and is more structurally sound than other cement mixtures; and, WHEREAS, this product will be used in the rehabilitation of streets throughout the city; and, WHEREAS, Southern Cement Slurry, LLC of Porter, Texas is a sole source vendor; and, WHEREAS, this purchase is authorized by Procurement Policies and Procedures Section 3-105 Sole Source Procurement, a) One-of-a-Kind —the product has no competitive product and is available from only one supplier. The product has essential unique design/performance features providing superior utility not obtainable from similar products; and, WHEREAS, this procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions (A)(7)(A), items that are available from only one source because of patents, copyrights, secret process, or natural monopolies; and, WHEREAS, the sole source for bid has been evaluated by the Public Works Department and Purchasing Division, attached as Exhibit"A"; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT,the City Manager is hereby authorized and directed to purchase, on behalf of the City of Port Arthur, cement slurry, for the unit price listed in Exhibit"B",with a projected P. R.21391 05/13/20 aw budgetary impact of$200,000; and, THAT, funding for these materials is provided for in account numbers Public Works Department Streets Division Streets 001-1203-531.36-00 and Capital Improvement Fund Capital Projects Streets 307-1601-591-86-00; and, THAT, a copy of the caption of this Resolution be spread upon the -Minutes of the City Council. One product we produce using SuperSlurry technology is cement slurry. At significant cost to itself, Martin Marietta has developed the processes and components necessary to manufacture SuperSlurry through internal experimentation, expertise and inventiveness. However, because of the proprietary nature of the SuperSlurry products, manufacturing processes and delivery system, Martin Marietta is the sole supplier in the Dallas/Ft. Worth area that can provide you with SuperSlurry or its equivalent. Martin Marietta will license the cement SuperSlurry production process so that cement SuperSlurry will be widely available wherever it is needed. Martin Marietta currently holds a patent on the SuperSlurry product,so we intend to protect the proprietary nature of the product and processes so that only licensed suppliers will be allowed to produce and sell the cement SuperSlurry product to the quality standards established by Martin Marietta. At the present time, Martin Marietta has licensed other manufacturers of cement SuperSlurry throughout Texas and various parts of The United States. Southern Cement Slurry is the sole source provider in the Southeast Texas region, including the greater Houston and Port Arthur areas.
