HomeMy WebLinkAboutPR 21438: EXTEND ARCENEAUX, WILSON & COLE, LLC CONTRACT urt rthur 7e ' r• INTEROFFICE MEMORANDUM Date: June 10, 2020 To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Donald Stanton, Interim Director of Water Utilities RE: PR 21438 —Extend Arceneaux, Wilson& Cole, LLC Contract Introduction: The intent of this Agenda Item is to seek City Council's approval for City Manager to extend the contract with Arceneaux, Wilson & Cole, LLC of Port Arthur, Texas. This extension of the contract with Arceneaux, Wilson& Cole, LLC is for eighteen (18) months in order to encompass the construction phase as well as the support for FEMA reimbursement. Arceneaux, Wilson & Cole, LLC is not requesting any additional compensation. Background: Pursuant to Resolution Number 19-309, Arceneaux, Wilson & Cole, LLC of Port Arthur, Texas was awarded the contract for design and construction phase services for the remediation and mitigation of all lift stations damaged by Tropical Storm Harvey. Budget Impact: This is a zero budget impact resolution. Recommendation: It is recommended that City Council approve PR 21438, allowing City to extend the contract with Arceneaux, Wilson & Cole, LLC in a zero total amount. A RESOLUTION AUTHORIZING THE CITY MANAGER TO AMEND THE CONTRACT FOR THE DESIGN AND CONSTRUCTION PHASES FOR TWELVE(12) LIFT STATIONS DAMAGED BY TROPICAL STORM HARVEY WITH ARCENEAUX, WILSON & COLE, LLC, OF PORT ARTHUR, TEXAS, BY CORRECTING THE OMITTED AMOUNT OF TIME BY 365 DAYS FOR THE CONSTRUCTION PHASE PLUS AN ADDITIONAL 180 DAYS TO EXTEND THE PROJECT CONSTRUCTION WITH A NEW CONTRACT COMPLETION DATE OF DECEMBER 31, 2021,AT NO ADDITIONAL COST WHEREAS, pursuant to Resolution Number 19-309, Arceneaux, Wilson& Cole, LLC of Port Arthur, Texas was awarded the contract for the design and construction phases for all lift stations damaged by Tropical Storm Harvey; and, WHEREAS,the original contract submitted by Arceneaux, Wilson& Cole, LLC to the City of Port Arthur mistakenly omitted the time of performance for the construction phase; and, WHEREAS, during the course of the design phase of the contract, Arceneaux, Wilson & Cole, LLC recommended to extend the project construction duration an additional 6-months for a total time frame of 545 days; and, WHEREAS, this additional time will provide a buffer for administrative tasks that may arise due the funding agency (FEMA); and, WHEREAS,Arceneaux, Wilson and Cole,LLC still anticipates the construction period to be approximately 270 days; and, WHEREAS,the project closeout may take a little longer to complete than the current 365 day construction phase; and, WHEREAS, the Utilities Department recommends amending the original contract to accomplish this work with no change in contract amount. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P. R. No. 21438 6/10/20 bw Page 2 of 3 THAT, the City Manager of the City of Port Arthur is hereby authorized to amend the contract with Arceneaux Wilson & Cole, LLC correcting the omitted days for the construction phase and extending the total contract time by 180 days with a new contract completion date of December 31, 2021 to encompass the construction phase as well as provide support during the time for reimbursement from FEMA; and, THAT,this project is not increasing in cost by the passage of this resolution; and, THAT a copy of the caption of this resolution be spread upon the minutes of the City Council.
